REGULAR MEETING:
Ken Metzler called the IWWC meeting to order at 7:34pm.

D. Schreiber made a motion to seat Roger Peloquin as an alternate.  

New Business

Review of Operation and Maintenance for Storm Water Systems at Town Library.

G. Blessing said he looked over the report from the library, he said the town engineer also has a copy.  S. Yorgensen said that Mr. Acimovic wrote a memo regarding the report.  G. Blessing said he wanted to make sure all issues are covered in the memo regarding the drainage system.  He stated that he will add any additional changes to the memo that he fells are necessary.  

The commission discussed the maintenance plan for the library which was a condition of approval for their permit.  The commission stated that the “They” listed in the plan needs to be defined as well as more specific details included.  

L. Kouyoumjian asked if the commission should write a letter to the board of selectmen with their requests for the maintenance plan.  G. Blessing said that he would like to know what the town plans on doing with the sediment that they remove from the drainage system.  K. Metzler asked what leverage the commission has over this issue.  S. Yorgensen said that the library only has a temporary Certificate of Occupancy.  She suggested writing a letter to the Library board and the “Friend’s of the Library”.  
T. Gutowski asked why the architect developed the plan instead of the engineer.  She stated that the memo from Mr. Acimovic should be sent to the architect, public works, and Planning and Zoning.  
The commission discussed what the Library needed to complete to get their Certificate of Occupancy.  S. Yorgensen said that they need to complete the Storm Water Plan as well as their Planting and Landscaping plan or request modifications from the originally approved plan.   T. Gutowski said that the First Selectman should be notified that there are outstanding issues with the Library that need to be completed before they receive their Certificate of Occupancy.   

Old Business

File #W2007-06-Application for Activity within the Regulated Area for the construction of a two car garage located at 22 Old River Road (Map 43, Lot 7). ~Owner/Applicant Michael Anthony Robertino. ~(Received on 2/26/07, Hearing or Decision by 4/23/07). Sitewalk on 3/24/07.

K. Metzler said that he is still concerned with the water running into the foundation with Mr. Robertino’s proposed plan.  G. Blessing asked if this is ground water or surface water.  K. Metzler said that it is water from a water course at the edge of his property.  G. Blessing stated that Mr. Robertino must put in a trench with a curtain drain and crushed stone.  

The commission said that they are waiting for Mr. Robertino to come back with a new plan that he is creating with an engineer.  T. Gutowski said that she is concerned that Mr. Robertino will be dumping water onto the neighbor’s property.  K. Metzler said that he believes that the water will go back into the water course.  

File# W2007-03 – Application for Drainage Improvements within regulated area including catch basin at 90 Tinkerville Road (Map 40, Lot 41, Zone R80) Owner: David Hammaker; Applicant: Benny Pagani of Titan General Contractors, LLC. (Received 1/22/07, Public Hearing by 3/26/07; Decision by 4/23/07) ~Sitewalk on 3/24/07

When the town found out that the applicant was going to pay for the work himself, they said that he should not have to.  Thus they are still waiting for a decision from the town regarding who is responsible for the work.    

File# W2007-04 – Application for Re-Subdivision of Lot 7 on property at Mihaliak Rd. Ext. and Rosemary Lane (Map 50, Lot 3-7, Zone R80) Owner/Applicant: Mary C. Litwinczyk & Litwinczyk Children, LLC (Received 1/22/07, Public Hearing by 3/26/07; Decision by 4/23/07)
Sitewalk on 3/24/07.

The commission is still waiting for Mr. Pelletier to come back with a revised set of plans.

Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit W2004-04 off Battye Road. Site Walk 11/4/2006 at 9 a.m.

The commission read a letter from Scott and Valerie Rodgers regarding moving debris out of the wetlands.  They requested to be able to wait until Memorial Day weekend to do the work when the area is drier.  

K. Metzler asked S. Yorgensen if she was in contact with the town attorney regarding this issue.  She said that she did and that Mr. Branse will write a letter.  The commission discussed the issues that make up the cease and desist order.  The commission discussed what has been completed thus far.  S. Yorgensen said that the seeding and grading is done and the road has been stabilized.  The commission discussed the wetland violations including the piles of debris and cutting the road through the wetlands.  The asked when the woody material would be removed.  They discussed when they should require the work to be completed.  K. Metzler said that he would like the commission to do a site walk then have a letter written by the attorney stating the work that needs to be done with a completion date; and if it is not completed the bonds will be called.  

W2003-49 - Notice of Violation: ~Travel Centers of America (the Lessee) and George Giguere ~~of Royce Properties (the Owner) of property located at 327 Ruby Road.

S. Yorgensen asked F. Dirrigl if he had a chance to review the recordings.  He said he did not.  T. Gutowski asked if the town has received a response from the TA.  F. Dirrigl said that he requested a report as to what the environmental impacts were after the spill.  The report was received in November 2006, and it showed that things were responding well to the spill, that there were two areas of wetlands that had elevated petroleum.  This study was done in 2005 due to a DEP order.  The town does not know if there is a final consent letter.  The commission discussed the correspondence that occurred between the Town and the DEP.  S. Yorgensen said that she did receive a response from the commissioner of DEP.
The commission discussed the currant maintenance plan that the TA has regarding deliveries.  They stated that they are still waiting for a report that says why the spill happened and how spill will be prevented in the future.  The commission said t hat they will ask for a revised storm water plan.  S. Yorgensen said she will draft a letter to the commissioner asking if there has been a final order.

Staff report and Discussion

G. Blessing said that he received a phone call from a town resident who lives on Route 74.  The resident was concerned that he was finding fine sediment in his backyard which has two streams in it.  It is likely coming from Beckers quarry. S. Yorgensen said that Becker construction has been working on this issue.  She stated that they have put in some temporary measures and are working with Gardener and Peterson to develop a permanent plan.
