REGULAR MEETING:
Dave Schreiber called the IWWC meeting to order at 7:30pm.

D. Schreiber made a motion to seat Tess Gutowski and Roger Peloquin for Frank Dirrigl and Ken Metzler. .

File #W2007-06-Application for Activity within the Regulated Area for the construction of a two car garage located at 22 Old River Road (Map 43, Lot 7). ~Owner/Applicant Michael Anthony Robertino. ~(Received on 2/26/07, Hearing or Decision by 4/23/07). Sitewalk on 3/24/07.

G. Jones passed out maps and plans for the proposed drainage system.  Michael Anthony Robertino was present to discuss the application.  Mr. Robertino said that during the site walk K. Metzler said that he did not have any problems with the construction of the building but would like to see the drainage swale updated.  Mr. Robertino said he is working with Desato to create a plan for the swale.  D. Schreiber said that he thought the town engineer should look at the final plans as well.  Mr. Robertino said that he is working with an engineer from Desato named Alan Sherman.  

R. Peloquin asked if the catch basin should be moved up the hill.  Mr. Robertino said his engineer said that the catch basin needs to catch the water that is flowing down the hill, so it needs to be placed lower.  R. Peloquin asked if it will be below the frost line.  Mr. Robertino said that he did not know.  D. Schreiber said he though that the further up the catch basin is placed the drier the lawn would be.  

Tess asked what the distance from the back of the garage to the pipe is.  Mr. Robertino said it is six feet.  She asked where the pipe will discharge.  He said to the swale which is on the property line.  

G. Blessing asked if there can be a swale with out a catch basin.  Mr. Robertino said he thought there would be too much water running down the hill that it would go into the garage.  He said currently the water runs into his foundation.  

D. Schreiber asked if there would be a trench dug and porous pipe placed in it.  Tess asked Mr. Robertino if he felt he would be able to catch all of the water.  He said he felt he would.  D. Schreiber said he was worried that all the water would not be collected.  Mr. Robertino said he will put in a trench with gravel.  D. Schreiber said that the commission needs to know more details regarding how deep the trench will be, the contouring of the swale, details of the catch basin, pipe size, grades of the swale, slope of the pipe, etc.  
Mr. Robertino said that he will meet with his engineer and come up with a more detailed plan for the next meeting.  

File# W2007-03 – Application for Drainage Improvements within regulated area including catch basin at 90 Tinkerville Road (Map 40, Lot 41, Zone R80) Owner: David Hammaker; Applicant: Benny Pagani of Titan General Contractors, LLC. (Received 1/22/07, Public Hearing by 3/26/07; Decision by 4/23/07) ~Sitewalk on 3/24/07

G. Blessing asked if the town is requiring these updates.  D. Schreiber said that over the years there has been a build up of material along the side of the road which causes the water to no longer sheet flow off the road.  He said that water flows west into the applicant’s driveway.  

The commission went over the site plans and discussed how the water flows through the property.  G. Blessing asked if a burm could be built in the driveway to move the direction of the water flow.  

G. Jones went over Karl Acimovic’s memo and discussed how the site plan could be modified to include his suggestions.  G. Blessing asked if Mr. Acimovic should meet with the applicant and with Lynn Nichols to make changes to the plan and then re-submit it to the commission.  The commission said that would be the best course of action.  

File# W2007-04 – Application for Re-Subdivision of Lot 7 on property at Mihaliak Rd. Ext. and Rosemary Lane (Map 50, Lot 3-7, Zone R80) Owner/Applicant: Mary C. Litwinczyk & Litwinczyk Children, LLC (Received 1/22/07, Public Hearing by 3/26/07; Decision by 4/23/07)

Ed Pelletier the applicant’s engineer was present to discuss the application.  He went over the site plans with the commission.  He pointed out a water pond that is not flagged on the property as well as pointed out the buffer zone.  Mr. Pelletier said that the parcel is naturally divided by the wetlands.  
Tess asked how many lots are there currently.  Mr. Pelletier said that there are nineteen.  Mr. Pelletier said that he would like to split this lot into two building lots; one would be accessible from Rosemary Lane and the other from Mihaliak Road Ext.  Mr. Pelletier discussed the improvements that were done to Mihaliak Road Ext.  

G. Blessing asked what the activity will be in the wetlands.  Mr. Pelletier said that foundation drain, well, and driveway will all be in the buffer zone.  He said that the septic is in the process of being approved.  
R. Peloquin asked why the house could not be flipped around to get the driveway out of the regulated area.  Mr. Pelletier said that he usually puts the garage at the north or west of a home as it allows the morning light to come into the home, as well as it is easier to access the septic system.  

G. Blessing asked if they are proposing an engineered septic.  Mr. Pelletier said yes.  They discussed the possibility of moving the driveway over slightly to get it out of the regulated area.  

D. Schreiber said that he would like to hear from the health district and he would like to see an updated plan at the next meeting.  R. Peloquin said that he would like to see the house moved over a little.

Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit W2004-04 off Battye Road. Site Walk 11/4/2006 at 9 a.m.

The commission explained the issues to Tess and discussed that the applicant will be meeting with the Planning and Zoning Commission at their next meeting.    

W2003-49 - Notice of Violation: ~TravelCenters of America (the Lessee) and George Giguere ~~of Royce Properties (the Owner) of property located at 327 Ruby Road.

The commission explained the issues to Tess.  She suggested writing another letter to the commissioner of DEP.  She said when a town writes a letter they are supposed to get a response within ten days.  She stated that the commission should review the correspondence regarding this issue at the next meeting.  She also suggested having the attorney write a letter to Travel Centers requesting that they provide the commission with their spill prevention plan.  
Tess suggested having Planning and Zoning as well as the Conservation Commission write a letter together.

The commission discussed redoing the regulations.  Tess said that she was willing to work on them.  R. Peloquin said he would help.
