A motion was made by D. Schreiber to seat R. Peloquin as an alternate for the meeting. There was a second by F. Dirrigl. All in favor, thus the motion carries.
New Business
W2006-51-Application for Re-subdivision for (1) new lot on property at 167 Lohse Road (Map 52, Lot 28, Zone R80) Owner/Applicant: Mike Marino (Received 10/23/2006, Public Hearing or Decision by 12/11/2006)
Jim Luczak the applicants engineer was present to discuss the application. He explained that the applicant would like to have a 1 lot Re-Subdivision from the original parcel of land which is 17.4 acres. They would like to split off 2.4 acres to build a home for themselves. Both parcels of land will still have frontage if they are split. Wetland flagging has been done by a soil scientist and the proposed activity is 100 feet from the wetlands. Mr. Luczak stated that the closest thing to the wetlands will be the foundation drain.
R. Peloquin asked how many feet the drain is from the wetland boundary buffer. Mr. Luczak said that they are 2 feet from the boundary.
K. Metzler asked how the area is currently vegetated. Mr. Luczak said that there are small trees, as logging occurred recently. He stated that the undergrowth has been removed as well. K. Metzler stated that he would like to have the town engineer review the application. He also asked if the foundation will be on a slab or if there will be a basement. Mr. Luczak said that there will be a full basement.
D. Schreiber stated that the plans do not show detail of the footing drain discharge or where silt fencing will be placed. The commission encouraged the engineer to place the fencing with enough room for machines to be able to get in and do the work that is required. The engineer said that he will put those things on the map.
W2006-56- Application for Commercial Timber Sale on property on Balazs Road (Map 44, Lot 3, approx. 211 acres) Owners: Barrie Robbins-Pianka & Chris F. Robbins; Applicant: Connwwod Foresters, Inc. contact: John O’Donnell, Forester (Received 10/23/06, Public Hearing or Decision by 12/11/06)
John O’Donnell was present to discuss the application. He explained that they are planning a timber sale of 200 acres through a 10 year management plan. When they are through with the cut they will replant oak and hickory trees. Mr. O’Donnell stated that he had a site walk with Gary Jones where they showed that all the trees have been marked.
The commission asked how long it will take to do the cutting. Mr. O’Donnell said that the timber harvest must go to bid but they are open to a two year contract. He stated that when the wood is removed from the property it will be taken out on Balaz Rd. Mr. O’Donnell said that there are two locations on the road which will require road improvements in order to not cause any damage to the landing. He stated that they will be putting down 36 yards or stone at those landings. Mr. O’Donnell said that they will re-seed any areas that are needed when the harvest is completed. He also stated that all of the roads that they will be using for the harvest are existing roads from a previous harvest done in the early 90’s.
K. Metzler suggested that the application be remanded to staff. D. W2006-57-Application to construct a common driveway and related grading in regulated area for (2) dwellings on Lohse Road (Map 46, Lot 1-B, Zone R80) Owner/Applicant D.W. Fish Home Builders, LLC. (Received 10/23/06, Public Hearing or Decision by 12/11/06)
The applicant asked to table the application as they are still waiting for the town engineers comments.
W2006-58- Application to construct single family dwelling & septic in Upland Review Area at 87 Luchon Rd (Map 18, Lot 13, Zone R80) Owner/Applicant: Robert Dempsy (Received 10/23/06, Public Hearing or Decision by 12/11/06)
The applicant’s engineer was present to discuss the application. He stated that they are expanding one driveway to meet zoning regulations as well as removing the second driveway on the property.
The Commission discussed whether the debris removed from the driveway could be used as clean fill. The engineer stated that the DEP states that if the pieces are large than it is considered clean fill. The engineer said that he does not mind taking it off site though. The commission said that they would be concerned with using the driveway material as fill.
D. Schreiber made a motion to approved application W2006-58- Application to construct single family dwelling & septic in Upland Review Area at 87 Luchon Rd (Map 18, Lot 13, Zone R80) Owner/Applicant: Robert Dempsy with the acknowledgement that the concrete will be taken off site. Seconded by F. Dirrigl. All in favor, thus the motion passes.
W2006-60- Application for 3-lot Subdivision on corner of Daleville School & Busse Rds (Map 11, Lot 20, Zone R80) Owner/Applicant: S&P Ventures, LLC (Received 10/23/06, Public Hearing or Decision by 12/11/06)
John Ianni, soil scientist, was present to discuss the application. He stated that they are proposing a three lot subdivision on Busse Road. Mr. Ianni said that they had not received the town engineers comments back so at this time the applicant would like to know what information should be brought to the next meeting. Mr. Ianni said that they have received approval from Eastern Highlands Heath District for a three bedroom home on each lot. He said that they are proposing a conservation easement and the wetlands have been marked.
K. Metzler said that this application should be tabled until the comments from the town engineer come in. He also stated that a public hearing needs to be held next month. As well as having the commission members walk to site.
The commission discussed requirements for the hearing. Mr. Ianni said he will put together an indepth description of the wetlands as well as an assessment of indirect impact.
D. Schreiber made a motion to hold a public hearing for W2006-60- Application for 3-lot Subdivision on corner of Daleville School & Busse Rds (Map 11, Lot 20, Zone R80) Owner/Applicant: S&P Ventures, LLC. R. Peloquin seconded the motion. All members voted in favor. The public hearing is set for 12/11/06.
W2006-49 – Application for a ruling of no jurisdiction for proposed subdivision on River Rd (Map 10, Lot 21-0A, Zone R80) Owner/Applicant: ~Willington River Corp. (Received 10/23/06, Decision by 12/11/06)
W2006-59- Proposed activity within regulated area for proposed 60 condo unit development on River Road (Map 10, Lot 21-A, Zone R80) Owner/Applicant: Willington River Corp. (Received 10/23/06, Public Hearing or Decision by 12/11/06)
The commission stated that they would like to discuss the two applications together as a cohesive package.
D. Schreiber made a motion that the two files are too closely related and there is not enough information to make a decision as the two applications should be presented as a cohesive package per IWWC regulation 10.2-F. R. Peloquin seconded the motion. All members voted in favor. Thus the motion carried.

Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit #W2004-04 off Battye Road. Site Walk 10/24/05 9:30 a.m.
S. Yorgensen presented a list to the commission of items being stored in the conservation easement areas which included machines and construction debris. The commission said that staff should send an order to Joseph Voboril to remove all items in conservation easement. F. Dirrigl asked for a time limit to be placed on the order.
S. Yorgensen said that she will speak with the town attorney regarding this issue.
File #2003-49 - Notice of Violation: ~TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.
F. Dirrigl said he will present the commission with a report. The commission discussed making a site walk.

Approval of minutes
D. Schreiber made a motion to approve the minutes with minor corrections, F. Dirrigl seconded the motion. All members voted in favor of the motion.
Staff Discussion
K. Metzler reported that Garth Nichols called him regarding the pond next to his house. He said that after the DOT put in the new drainage system the pond is approximately six inches lower than it has ever been. The commission said that they will write a letter to the DEP and CC the commissioner as well.
The commission discussed that DOT projects that will have wetland impact should require DEP permits.
The commission scheduled site walks. They will walk Busse Road and the truck stop on 12/8/06 and on 12/3/06 they will walk the River Road project at 10:00am.
