Call to order
K. Metzler called meeting to order at 7:35 PM

Seat Alternatives
A motion was made by F. Dirrigl to seat R. Peloquin as an alternate for the meeting.  There was a second by D. Schreiber.  All in favor, thus the motion carries.

PUBLIC HEARING:

1.~~~~~~W2006-18 – Application for a 5 Lot Subdivision on property at Daleville School Rd and Busse Rd (Map 11, Lot 20) Owner/Applicant: ~S & P Ventures (Received 3/13/06, Public Hearing 5/8/06, Site Walk 4/10/06 at 6 pm; Decision by 6/12/06)

Applicant was not present for public hearing.  Commission decided to table the public hearing to the end of the regular meeting to see if the applicant was running late.

New Business

1.~~~~~~W2006-24 – Application for construction of two (2) single family dwellings within the regulated area on parcel A & B south of 69 Lohse Rd. (Map 46, Lot 1-B) Owner/Applicant: ~D. W. Fish Home Builders, LLC. (Received 5/8/06, Public Hearing/Decision by 7/10/06)

Mark Peterson the applicants engineer was present to discuss the application.  Peterson stated that Parcel A is 4.69 acres and Parcel B is a little over 3 acres, both having wetlands along the roadway.  
Peterson stated that he followed the town engineer’s common suggestions when deciding where to put in curb cuts, culverts, and storm drains.  He felt that in the proposed plan these would collect any sediment before it reached the wetland areas.  

K. Metzler asked if there were any defined watercourse in the area.  Peterson said that a property to the north has a pond, as well as flowing water.  

S. Yorgensen asked if there was a report from the soil scientist.  Peterson said that he has not received it back yet, but will have it for the next meeting.  
K. Metzler asked what the property is being used for currently.  Peterson said it is a wooded lot.
D. Schreiber asked how much disturbance there would be to the wetland areas on each of the proposed lots.  Peterson said that on Parcel A there would be .05 acres of disturbance and on Parcel B there would be .04 acres of disturbance.  

K. Metzler stated that he feels that a site walk is needed so the commission can look at the property and then determine if a public hearing is necessary.  
The commission stated they also need more information at the next meeting including a report from the soil scientist, the nature of the water course and a report from the site walk.  

A site walk was tentatively scheduled for 6:00 PM on 5/22/06.

2.~~~~~~W2006-25 – Application for construction of driveway, utilities, erosion control and grading within the regulated area on 37 Clover Springs Dr (Map 9, Lot 7-12) Owner/Applicant: Beyor Builders, Inc. (Received 5/8/06, Public Hearing/Decision by 7/10/06)

S. Yorgensen noted that item W2006-25 was here for a modification to their application.  
Mark Peterson the applicants engineer was present to discuss the modifications to the original application.  Peterson stated that the property is lot 12 of the Clover Springs Sub division.  He went on the explain the changes in the application, including disturbances to the wetlands in the original application were no longer being disturbed, but wetlands in another location were now being disturbed.  

K. Metzler asked if seepage of water comes onto the property and if so would the driveway impact the seepage or how the water is collected and removed from the site.  Peterson said he was not sure but would get back to the commission with an answer.  

D. Schreiber asked if the temporary catch basin is still on the property.  S. Yorgensen said that she believes it is now permanent.  

K. Metzler said he would like the town engineer to look at the driveway and how it affects the drainage.  
Peterson stated that the driveway will be paved due to the grading and the water should sheet flow down into the catch basin from the driveway.  

S. Yorgensen stated that she would like the town engineer to look and see if something other than a catch basin needs to be installed before the water gets to the storm drain.

R. Peloquin asked if the current cease and desist order on Cover Springs sub division affects current building.  S. Yorgensen said that it does not.  

The commission decided that they would like the town engineer to look at the property and make suggestions before they make a decision on the application.

Commission could not discuss due to applicant not presenting at public hearing.

2.~~~~~~Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit #W2004-04 off Battye Road. Site Walk 10/24/05 9:30 a.m.

S. Yorgensen stated that a final inspection of the subdivision needs to be completed, there is no date scheduled at this time.

3.~~~~~~ File #2003-49 - Notice of Violation: ~Travel Centers of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

S. Yorgensen stated that she wrote a letter to the DEP Commissioner stating that the matter of the diesel spill has gone on too long, that it has been over three years and that the commission needs to resolve the issue.  S. Yorgensen is waiting for a response from the DEP.  

Public Hearing

The public hearing was called to order at 8:15 PM by K. Metzler

Applicant still had not arrived for the public hearing.  The commission decided to hold the public hearing as notices were sent out and posted in the community.  There were several residents there for public comment.  The commission stated that they would use the information that they had available to them which included the application as well as the site walk that was conducted.  

K. Metzler stated that he did not agree with the soil scientist’s findings and that he also felt that the wetlands were not marked on the maps properly for lot two and had no accommodations for drainage.  He stated on lot four the property was flagged for wetlands but that was not reflected on the maps.  

Memo from Eastern Highlands Heath stated that no lots have been approved for septic tanks, that lots one and two are unsuitable for building and that lots three, four, and five need more work done before they can be approved for building.  

Memo from town engineer stated that he reviewed the proposed plans and he was concerned that there were no contours depicted on the maps for where grading will be.  

S. Yorgensen stated that she is including the commission’s resumes in the application to show that they all have proper background knowledge to review and comment on the proposed site plans.  

The commission felt that the application was missing several items including the environmental report which needs to state the wetlands functions and the effects building will have on them.  The soil reports are not signed by a soil scientist, and the characteristics of the water courses are not on file.

K. Metzler opened the floor for public comment

Bob Stukel stated that there is a culvert that goes from his property under the road to the proposed property.  He said that water already flows back onto his property from the culvert and is concerned that the culvert would be blocked during construction causing more water to flow back to his property.  

Dennis Ross stated that he feel there are more wetlands on the proposed property than are showed on the map.  

A motion to close the public hearing was made at 8:27 PM by F. Dirrigl and a second to the motion was made by D. Schreiber.  

K. Metzler stated that the commission will have G. Blessing listen to the tape of the public hearing so he is able to comment on the application at further meetings.

Approval of minutes

Two changes were made to the minutes; both were to the spelling of the commission’s names.  
F. Dirrigl made a motion to accept the minutes of April 10, 2006 as changed, D. Schreiber made a second to the motion, all in favor, thus the motion carries.  

Staff report and Discussion

The commission asked if anything had been done about getting a letter of resignation from Kathleen Pacholski due to her continued absence.  S. Yorgensen said that she had not, but will send her a pre-written resignation letter that she could sign and return it in a stamped self-addressed envelope.

F. Dirrigl made a motion to adjourn the meeting at 8:41 PM, D. Schreiber made a second to the motion, all in favor, thus the motion carries.
