Meeting Minutes

Regular Meeting:

A. Call to order
Chairman K. Metzler called meeting to order at 7:32 PM

B. Roll Call

C. Seat Alternates
A motion was made by D. Schreiber to seat R. Peloquin as an alternate, G. Blessing seconded the motion.  All in favor, thus the motion carries.

D. New Business

1. W2006-15- Application to construct a Fish & Wildlife Pond on the property at 15/17 Lusting Rd. (Map 36, Lots 16/17)  Owner/Applicant: John & Ann Starinovich (Received 2/27/06, Decision by 4/24/06)

Mr. & Mrs. Starinovich were present to discuss their application.  K. Metzler asked them if there had been any changes since their original application.  Mr. Starinovich said no, but they did receive their federal and state permits in the mail today.  He stated that he is still waiting to hear from the Army Core of Engineers.  
Mr. Starinovich presented the 404 permit from the federal government and the 401 permit from the state government.  G. Blessing stated that the federal government will monitor the digging of the pond through out the project.  
Mr. Starinovich stated that the work for the pond will be done outside of any wetland area on his property.  K. Metzler asked where the fill will be placed.  Mr. Starinovich said that has not yet been determined, that he could not get any definite answers about the project from contractors before the permits were received.  
K. Metzler asked if there is an access road to the location.  Answer- yes
G. Blessing asked if there were any special conditions put on the permits.  Mr. Starinovich said that he must sign a statement saying that he will follow his original plan and not make any changes.  The board looked over the permits and stated that they did not see any other conditions.  
K. Metzler asked if a basin will be dug.  Answer- yes.  A discussion regarding sediments in the surrounding soil.  D. Schreiber asked what type of soil was in the area.  Mr. Starinovich stated that there were several different types and they are all listed on the map.  
G. Blessing asked where the water will flow from the basin, if it will need to be pumped out.  Answer- The water will stay in the basin.
G. Blessing asked if the Starinovich’s had chosen a contractor.  Answer- no, they have spoken with Hipskey but no one would take the job until the permits were received.  

K. Metzler said that he recommends approval of the project based upon the information in the application.  He said he felt they should go back to staff with any further changes or information.  

G. Blessing made a motion to approve the application with the condition that the final location for the excavated material be reviewed and approved by staff and that the planting schedule be supplied to staff for review and approval as well.
Second by D. Schreiber, all in favor, thus the motion carries.

The commission asked the applicant to leave copies of all of the signed permits to be added to their application.  

2.      W2006-18- Application for a 5 Lot Subdivision on property at Daleville School Rd. and Busse Rd (Map 11, Lot 20) Owner/Applicant: S&P Ventures (Received 3/13/06, Public Hearing 5/8/06, Site Walk 4/10/06 at 6 PM; Decision by 7/10/06)

Application differed, public hearing to be held on 5/8/06

E.      Pre-Application

Evelyn Parizek of 125 Tolland Tpke. And her nephew Donald Parizek were present to discuss government sanction drainage in corn fields.

Mrs. Parizek said that is currently rents out her lot on Sharps Mill Road to a farmer who grows corn on the property.  She stated that there has been a large amount of erosion to the land due to water drainage.  Mrs. Parizek stated that she put in an application to the Natural Resources Conservation Service and it has been accepted.  

A discussion was held regarding the corn field and its currant drainage system.  D. Parizak stated that heavy rains have created a gully through the center of the field making it difficult for the farmer to work his crops.  D. Parizak went on to say that he would like to put in a 12 inch drainage pipe below the plow zone to move the water from one end of the field to the other with out creating erosion in the field.  He stated that a catch basin will be placed at the end of the pipe.  The elevation of the catch basin will not interfere with the hydrology of the wetlands.  

The commission asked why the Parizeks are not considering using a swale instead of the pipe.  D. Parizek said that there is currently a swale in the center of the field which reduces the amount of room the farmer has to maneuver his equipment.  
The commission discussed whether a swale would be less disruptive to the surrounding wetlands opposed to what would happen if a pipe was installed.  

D. Schreiber asked how many acres the field is.  Answer- 5 to 6.
How long is the pipe going to be?  Answer- It will be 400 feet when the final plan is completed.  

G. Blessing asked if the plans are being finalized currently.  Answer- The final plans should be complete in a few weeks.  

D. Schreiber asked if all the work to the field would be completed this season.  Answer- Yes

The commission discussed what their jurisdiction was on this particular property.  It was decided that there are wet lands on each end of the pipe.

K. Metzler stated that the proposal requires an application to be submitted to the commission due to a permit being required for the project.  He recommended that the application be remanded to staff and if staff feels that changes should be made to the application they can discuss those changes with the applicants.  

G.Blessing made a motion for a pre-application to be submitted to staff for proper permits.
Second by D. Schreiber, all in favor, thus the motion carries.

F.      Applications received after or post agenda filing:

W2006-21-Application to construct new community water system & leaching system for water treatment at the Senior Housing Complex on 60 Old Farms Road (Map 17, Lot1) Owner/Applicant: Town of Willington-Michael Eldredge (Received 4/10/06, Public Hearing by 6/12/06)

Selectman Eldredge and Patton were present to discuss the towns’ application for a community water system for the proposed senior housing.  
Mr. Patton stated that the pump house and leach filed would not be placed near any wetlands.  Mr. Eldredge stated that the tanks would be placed underground and that the four wells for the system had been approved by public health and public utility.  He went on to state that there will be two lines coming from the water tanks to the 32 unit building for water supply to the building and fire elements.  
Mr. Eldredge said that two of the four wells had a low level of magnize and iron in them, but those two wells will be bypassed until the levels drop.  
G. Blessing asked what type of water treatment system the town will be putting in.  Answer- an ionique exchange.  G. Blessing stated that he does not think that the commission has jurisdiction over this property due to the location of the water system.  

G.Blessing made a motion that the Inland Wetland and Watercourse Commission due not have jurisdiction over this application.  D. Schrieber seconded the motion.  All in favor, thus the motion carries.

G.      Old Business

Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit #2004-04 off Battye Road.  Site Walk 10/24/05 9:30 AM

G. Jones stated that the road is still not considered a public road as it has not been accepted by the town because it is too steep and buckling of the road will begin occurring in several years.  
K. Metzler stated that the stumps and gravel have been removed from the wetland area in which they were dumped and the area is beginning to stabilize.

File #2003-49- Notice of Violation: Travel Centers of America (the Lessee) and George Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

D. Schrieber stated that at the last meeting S. Yorgensen was going to send a letter to the Travel Center asking them to report back regarding what they have done so far to repair the damage to the water.

2.      Memo from Reynolds Engineering Services regarding pollution calculations
3.      Registration for 1st annual CT Wildlife Conservation conference


I.      Approval of minutes

Minutes from last meeting were unavailable.

J. Staff report and Discussion

The commission discussed asking Kathleen Pacholski for her resignation as she has not attended a meeting in many months.  The commission decided to send her a letter of resignation to sign and return to the commission.  

The commission members stated that the soil erosion at the new library construction site is holding up

K. Adjournment

G. Blessing made a motion to adjourn at 9:18 PM.  Second by D. Schreiber, all in favor, thus the motion carries.
