MINUTES OF DECEMBER 12, 2005

PUBLIC HEARING:

 Ken Metzler called the Public Hearing to order at 7:30 p.m.

W 2005-25 Application to cross wetlands to construct a driveway associated with a single family dwelling at Ruby Road [Map 33, Lot 17) Owner: Ruby Road Associates; Applicant: BHS Construction (Received 7/25/05, Site Walk: 10/23/05 at 10:15am; Public Hearing on 10./25/05 continued to 11/24, extension requested and granted to 12/12/05; Decision by 1/9/05).
William Tracy, Esq. and Annette Turnquist, appearing on behalf of the applicant gave revised plans to commission members, which they believed addressed all the issues raised by the town.
Turnquist stated that the drainage computations reveal that neither runoff nor flow will be affected. There will be no impact on the proposed culvert (chart marked 12/12 Exhibit1). Details for the foundations of the culvert were also given. The footings will be narrow, and placed a foot beneath the surface of the water. It will be anchored. A discussion regarding the culvert, the disruption its construction could cause ensued between commission members.
Turnquist then stated that the driveway area will be seeded with wetlands flowers. This recommendation appeared in the Klein report. There is an additional note on the plans that the town engineer can be on site during the construction phase of this culvert. Sheet 4 of the revised proposal has a Sediment & Erosion plan and narrative. The perc test results for testing done on the lot to the south this past May are now shown in the plans. A missing wetlands flag has been added to the plans.
Tracy stated that he has drafted a conservation easement for a portion of the property. The wetlands delineation will be used. This is of benefit to the town, as the town can enforce regulations and easements. The easement is very detailed: there can be no disturbance to areas of the property. This would make it possible for future owners to be aware of the restrictions.
Metzler stated that any grading or loaming of this property would require an appearance before this commission. Metzler commented that the language of the easement would preclude cutting a road to access the property from the south and wondered if an easement could be in conflict with a state regulation. Blessing wanted to be certain that the drainage calculations would be reviewed by the town engineer. Dirrigl was concerned with possible flooding and was told by Turnquist that the designs in the plan are for a 100-year flood. Metzler stated that the entire application will be reviewed as part of the process. He added that all commission members needed to listen to all of the tapes for this application. Metzler asked for comment from the public. There were no questions or comments.

W2005-37 Application for Timber Harvest on property at Marsh Road and Boston Turnpike (Rte 44) [Map 6, Lot 10] Owner: Michael and Jennifer Genesse; Applicant: J&J Logging LLC (Received 11/14/05, Public Hearing or Decision by 1/9/06)
Mr. Casaday appeared before the commission on behalf of J&J Logging. Jones let the commission know that he had looked over the application and the property where the proposed logging will take place. Jones said that a culvert will be needed for this job, and that he had changed some of the proposed 3 paths/crossings on the property. Casaday was asked what would happen to the culvert and other materials used to harvest the land, and he stated that all would be removed. Casaday said that the on by the road would be the most difficult to remove. He added that he had recently done a similar job and had used 16-foot culverts for it. Jones commented that the proposed plan was well marked. Blessing wanted to know when the logging would take place. Casaday replied that when the ground was hard (either in winter or summer), this job would be done.

W2005-38 – Application to construct a Day Care Facility on property on River Road [Map 30, Lot 31A] Owner/Applicant: Daniel Cote (Received 11/14/05, Public Hearing or Decision by 1/9/06)
Mr. Cote brought revised plans for the commission to review. There were 3 copies of the plans with minor revisions. The state DOT had requested changes in the sight line. The soil scientist has approved the site. An additional perc test by the state has been requested as well.
Metzler asked if Mr. Cote wished a decision of “No Jurisdiction” for this application.
Blessing wanted to be certain that the PZC and town engineer would be examining the drainage and runoff for this application. Jones said that a memo from the IWW to the PZC could be included in the application.
MOTION: THAT THE IWW HAS NO JURISDICTION OVER THIS APPLICATION AS THE DETENTION STRUCTURE MEETS STATE STANDARDS.

W2005-39- Application to construct a Single Family Dwelling on property on Boston Turnpike [Map 6, Lot 5] Owner/Applicant: Kenneth & Jessica Ives, Jr. (Received 11/14/05, Public Hearing or Decision by 1/9/06)
Rick Rivero representing the applicant stated that the site is a 47.3 acre site, and showed the upland review area on the property. In the application are: the application itself, plans, a DEP activity report, and an approval letter from the Connecticut DOT. Karl, the town engineer has received these plans.
The issues that have come up with this application involve the driveway and the curb on Rt 44. The driveway will be paved at the bottom, and gravel for the remainder due to the slope. The town engineer has required that pitch be added by using crown and cross. Karl added that the vertical accuracy (the survey conforms to Class C) and horizontal control for this area.
Jones stated that this application will need to go to the PZC and that the maximum grade for the driveway will need to be included in the plans submitted to the PZC.
Rivero stated that there is some gutter flow, and the grading will be kept as exists. There is no defined swale. DOT determined the location of the driveway. There is a 3% grade at the bottom of the driveway, and it is less than 3% for the last 60-70 feet before the pavement of Rt 44. He added that the crowns and horizontal accuracy required by the town engineer were the greatest changes made to the application. Metzler stated that there was minimal wetlands impact. Schreiber wanted to know how much of the lot were wetlands, and was told that about 15 acres of the 47 acres were wetlands. Property owners will be warned of the wetland crossing to the west. Jones stated that if the application were approved, that the limit of disturbance will be marked, although there are no guarantees against encroachment. Dirrigl commented many eastern Connecticut towns now use discs to delineate wetlands. Metzler said town regulations need to be changed to show wetlands locations.

E.      Old Business

W2005-25 – Tabled.

W2005-29 – Application to construct Phase II – Senior Housing (32 unit) Complex on property at 60 Old Farms Road [Map 17, Lot 1] Owner: Town of Willington; Applicant: Access Senior Housing of Willington, Inc. (Received 9/12/05, Decision by 12/12/05, extension granted).

Hank, representing the applicant passed out 2 sets of plans, and stated that there have been many discussions with Karl, the town engineer to resolve issues related to the Phase I Senior Housing. This application. Is a proposal for constructing 1 building with 32 units and the associated septic for the building. There is a dilution basin that dilutes nitrates, but there are problems. The ongoing issue with the drainage is that the Town of Willington, as well as many other properties, so water is bleeding out onto the wetlands on the property.
The current basin design will be for a 100-year storm. Discharge is as follows: the pipe system brings discharge to the dilution basin. This then overflows to the septic pipe system.  The flows then split. A bar is needed, and HUD will fund the septic system. The first two 15” pipes will be replaced by 24” pipes. The town engineer’s memo has caused changes to be made to this plan. Control for outflow is needed. The necessary detention basin will be built. Sedimentation and Erosion plans are needed. . There will be a ditch to catch some of the water.
Karl, the town engineer stated that a pipe needs to be placed for normal flow control. The proposed is for overflow. Originally, flow was to be dealt with by water detention and dilution basins. Currently catch basins now have sediment in them which needs to be removed. This property had been wooded. The new detention plan will emulate the earlier conditions. There is a large area of wetlands below the proposed construction. The runoff will be close to 0%. Ultimately, the water will flow to the brook that crossed Clint Eldridge Road. The current goal is to control damage.
Metzler asked if the dilution basin gets all stormwater and if it meets the stormwater quality requirements of 2004. He was assured that the current plan does meet this by Hank. Metzler asked if the septic would be expanded, and was told that it would be expanded for Phase III. If federal funds were granted, it might be done at the same time the improvements to the current system are made.
Karl, the town engineer said that he was very concerned about the new basin. It would be prudent to add bypass pumping. A basin is needed which can handle a 50-year storm.
Blessing asked who would maintain the system. The town will need to clean and maintain the pipes and the catch basins of sediment annually. Dirrigl asked Karl if this plan met the 80% standard, and was told that it did.
Metzler asked if the flow would increase or decrease with these plans. He was told that flow would decrease, and less runoff would go to the wetlands. Eventually, the detention basin will have plants and vegetation. A good access is needed to maintain the system.
Karl will continue having discussions with Hank to iron out an acceptable plan.

MOTION: TO APPROVE W2005-39 WITH THE FOLLOWING CONDITIONS:
1.      An approved maintenance and access plan by the town engineer; review and approval of the detention and dilution structures by the town engineer.
2.      Other issues identified in Karl Acimovic’s memo of 12/12/05 to be resolved to the satisfaction of the town engineer

Cease and Desist Order issued to Joseph Voboril Re: Clover Springs Subdivision Wetlands Permit #W2004-04 of Battye Road
Karl Acimovic stated that sediment in the basin at the development to be cleaned. More drainage has been added to lots 8 & 9 – 65 feet in total. The town wants access to areas that will need maintenance. The town will own the easements and the basins. Metzler stated that a few more details need to be attended to by Mr. Voboril, although the bond has been reduced. Until the action items for Voboril are all completed, this item will stay on the agenda. Karl can advise the staff when items are complete. Metzler added that the guide wire was gone. Karl stated that there are concerns about the impact on Battye Road, and that more action will need to be taken.

File 2003-49 – Notice of Violation: Travel Centers of America (the lessee) and George Giguere of Royce Properties (the owner) of a property located at 327 Ruby Road.
Metzler commented that the DEP has taken interest in this site.
