MINUTES OF November 14, 2005

PUBLIC HEARING:

A.    Call to Order

Ken Metzler called the Public Hearing to order at 7:30 p.m.

W 2005-25 Application to construct a single family dwelling within the upland review area on property at Ruby Road (Map 33, Lot 17) Owner: Ruby Road Associates; Applicant: BHS Construction. (Received 7/25/05, Site Walk 10/23 at 10:15am; Decision by10/14/05)
William Tracy, Esq. and Annette Turnquist, P.E. appearing on behalf of the applicant gave revised plans to commission members which they believed addressed all the issues raised by commission members.
Turnquist pointed out the subject parcel in Chart 1. She then passed out the proposed access information requested by the committee. The impact of access and wetlands was then discussed. The parcels owned by the applicant were pointed out by Tracy, at the request of Metzler. Metzler asked Jorgenson about the lot limitation for a single access, and was told that it depended on whether a loop or a cul-de-sac was built. A cul-de-sac may have 15 lots.
Metzler asked for plans on how to use the entire property. None have been set according to Tracy. Metzler added that the comments and concerns of the town engineer needed to be addressed. Turnquist replied that most of the issues had been addressed. Revisions, survey notes and benchmarks have been added. The construction sequence and the addition of two emergency vehicle turnarounds on the driveway as well as a widening of the end of the driveway have been added.
A new sheet (Sheet 3 of 3) shows that the site distances are adequate. The existing culvert measures 36” wide by 2” high. Blessing asked if there were spot grades on the driveway, and was told that they have been added within Ruby Road.
Metzler inquired about the Shaffer report. He will read this document.
Tracy stated that all issues raised had been addressed.
Metzler informed Tracy that staff had found the plans for the earlier subdivision proposal, and that he believed these plans were important as part of the commission’s consideration of this application. Mr. Tracy looked over the plans.
Metzler pointed out the road access points and stated that the earlier proposal does not show the entire parcel being developed, but that there could have been future development. An Open Space parcel was dedicated to the town in this earlier plan.
Tracy wanted to know why the older plans would be used during the deliberations. Metzler stated that assuming that the larger parcel would be developed in the future made this document important because it showed what the other applicant found to be important, and then compare these two plans.
Tracy said that his client wanted to stay out of wetlands areas.
Metzler stated that in the older plan, some parcels were not to be developed, but the land involved is not exactly the same. The water crossing is the key to the commissions’ hearing, so the approach needs to be feasible. Dirrigl wanted to know how the driveway would be maintained so that the streambed would be preserved. Turnquist responded that this would occur because of the open arches. There is a small foundation for all sides of the arches. The flow will not change. The footings will be 16” deep. Tracy added that each stream thread was very shallow. Dirrigl wanted to know if the stream is channeled, and if the area is dug in and was told this was so.
Metzler said that the distance of the footings from the channel needed to be known. Plans with more detail would protect the channel. Tracy said that the town engineer could be present during this construction. Dirrigl wanted to know details about the reseeding to be done in the disturbed area. Tracy did not have that information.
Yorgensen commented that she was looking over the revised plans, and wanted to know the drainage basin size. She was told it would be 184 acres.
The public was then asked if there were questions or comments about this application.
Dave Lytwyn was a bit confused about the ownership of the properties involved. Tracy pointed out the properties owned by the applicant.
Metzler added that properties can be purchased and combined in the future.
Gene Courier of 153 Ruby Road asked what effect this disturbance would have on his property, as the streambed comes into his property. Tracy stated that there would be no change in flows post-construction from their pre-construction levels.
Metzler asked Tracy if the drainage calculations had been submitted. They have not. Yorgensen stated that the rule was that there could be no increase in flow. Blessing asked if the pipe under Ruby Road were adequate. Turnquist will check. Tract stated that the area closest to the driveway was not chosen for soil, but for drainage properties.
Another neighbor was concerned that if the owner of the two lots in the area developed both that there could be drainage issues and that runoff could increase. Turnquist said that for one house, a plunge pool would not be needed, but it would be needed if there were further development.
Metzler wanted to know if the pipes were adequate for drainage and if there was an easement. Yorgensen did not know and said this would be a state easement. Yorgensen also pointed out that it was not stated in the plans that there would be a 0% increase of runoff and that this was needed. She was also unsure if soil testing had been done in an alternative location. Turnquist was unsure. Yorgensen stated that, in addition to an alternate location on the lot or an adjoining lot a smaller house on the property might be an alternative for the applicant to consider. Tracy stated that the septic/well configuration was as far away from the wetlands boundary as possible.
Metzler stated that the commission needed to have the drainage calculations. Dirrigl concurred that more information was needed. A discussion of the history of these lots ensued. Yorgensen commented that the lots could be combined at some point. Dirrigl wanted to know if the applicant had considered conservation easements for the wetlands. Yorgensen stated that the language about a conservation easement would be on the deed so future owners would be aware of restrictions.
Metzler stated that, since the two seem reliant on each other, he was uncomfortable not having development plans for the other larger lot in the area. This information is needed by the commission. Tracy agreed to extend application so the Public Hearing could continue.
Metzler listed the minimum additional information and cooperation that the commission would need in order to make an informed decision:
1. Drainage calculations
2. Engineering detail about the arched culvert
3. Information on the planned reseeding of the disturbed area adjacent to the culvert
4. The town engineer could be on site during the culvert construction
5. A detailed erosion control narrative
6. A complete erosion control plan
7. Soil testing results on both properties.
8. Alternatives

Metzler then thanked the applicant’s representatives for appearing at this public hearing.

W2000-49 Request to extend a permit on Mihaliak Road, [Lot 4, Block 4]. Applicants: Stefan and Karen Gruczki (Application received 11/14/05).
No one was present to represent the applicant. The applicant or a representative needs to appear before the commission.

W2005-34 Application to dredge pond and remove silt from existing property at 125 Tolland Turnpike [Map 29, Lot 28] Owner/Applicant: Evelyn A. Parizek (Received 10/14/05, Decision by 12/12/05)

Metzler asked Miss Parizek if she had decided what to do with the dredged silt from her pond. . Miss Parizek plans to bring it to property she owns on Glass Factory School Road, and that it will be placed onto Mr. Hipski’s truck after being removed from the pond and brought directly there. She plans to do this next summer.  
Yorgensen commented stat what is dug up from a pond is wet, and that this is usually piled and then transported. She added that the pond flow is regulated by the stream.
Miss Parizek has no plans to pile this material. Mr. Hipsky will use an excavator with a 1 yard wide container. There will be no flow during this. The equipment will be on logs so it can get to all areas of the pond. Water will be piped around the dredging area. The entire job should less than a week Yorgensen commented that this was a good plan. When asked if the risk of siltation could be lessened, Yorgensen thought that fabric could be put up where work was to be done. A condition of a motion to approve could include the condition that the work is done during the dry season.

W2005-37 Application for a permit for a timber harvest at a location at Marsh Road and Boston Turnpike; Owners & Applicants: Michael and Jennifer Jenneray.; Submitted 11/14/05.

Chris Casiday, a forester, of JJ Logging LLC appeared before the commission on behalf of the applicant. He stated that all required information had been submitted. A piece had been cut in this area 15 years ago. Existing roads could be used for this harvest, with the exception of the road over Fisher Brook. Intermittent streams will be fortified during the logging. He added that a site map would make this application stronger. He pointed out 3 streams, and said it would be a 2-3 week project. He will harvest in the buffer zones, not in the wetlands. Yorgensen asked what would happen to the materials used for this harvest and was told that they would all be removed. Metzler asked Casiday if he wanted to do this harvest during the winter. Casiday does. Metzler asked Yorgensen to be sure that Gary Jones got on site before the meeting of December 12th.

W2005-38 Application for a Daycare Center on River Road; Applicant: Daniel Conti; Submitted: 11/14/05

No one appeared to represent the applicant. This will be a new building on an empty lot on the east side of River Road. A letter from Michael Greg Nolette, a soil scientist, was included in the application. Nolette had examined properties for wetlands and watercourses. None exist on this property or within 100 feet of it. It is clear, historically.
After some discussion it was determined that the commission may have no jurisdiction over drainage issues and that it would await a report form Karl, the town engineer before making a decision.

W2005-39 Application for a single family home on Boston Turnpike; Applicants: Kenneth and Jessica Ives, Jr. Submitted: 11/14/05

Rick Rivers appeared on behalf of the applicant. He stated that he had submitted the application fee, four sets of site plans, a completed IWW application, notification envelopes, a Connecticut EPA Activity Form, GTS maps, Eastern District Department of Health Septic Approval, CT DOT Approval for a curb cut at Route 44.
Rivers stated that there were wetlands on this 47.3 acre property. The same flagging was used as in 1999. He pointed out the wetlands, forested areas, fields and where the future driveway would be located (which was dictated by the DOT). There is an area that will be cleared. The driveway will be 50-60 feet long. The upland review area was indicated. An edge of the upland review area touches the drive so some grading will be needed. The dwelling will be located on the flat area on top of the knoll on the property, so there will be no wetlands disturbances. Rivers stated that he had an erosion control plan, a vegetative planting/replanting plan, the development sequence and septic construction notes in his plan. He asked that the commission review it. Rivers pointed out the grading down to Route 44, away from the wetlands.
A discussion on the drainage onto Route 44 ensued. It was decided that the town engineer would look this over, and that Rivers would get more information. Metzler asked if the clearing around the home were realistic and was told that it was realistic. The house will have a circular drive and 5 bedrooms. Metzler thanked Rivers for appearing before the commission.

W 2005-29 Application to construct Phase II Willington Senior Housing [32 units]. Complex on property at 60 Old Farms Road [Map 17, Lot 1], Owner: Town of Willington; Applicant: Access Senior Housing of Willington, Inc. (Received 9/12/05, Decision by 11/14/05)
A request for an extension for this application needs to be made.
Tabled.

Cease and Desist Order issued to Joseph Vorobil Re: Clover Springs Subdivision Wetlands Permit #2004-04 off Battye Road.
The road and curbs are in and look good. There is a guide wire on the top of a pole where Clover Springs Road borders Battye Road. It should be removed. There is already a street sign there. Yorgensen said the Public Works had put it up as the fire department requested this because people will be already living there.

File #2003-49 – Notice of Violation: Travel Centers of America (the Lessee) and George Giguere of Royce Properties (the owner) of property located at 327 Ruby Road.

Lengthy discussion. Letters to be sent to state DEP and to Travel Centers of America.  Tabled.
