W2005-21 – Application to construct a single family dwelling within the upland review area on property at Parcel A Mihaliak Rd. Ext. (Map 50, Lot 3) Owner/Applicant: Charlene Angelico (Received 7/11/05, Decision by 9/12/05)
The representative for the applicants appeared on behalf of this application. He described the property as having no wetlands disturbances within 100 feet, and that it had 15-foor slopes exist on the lot. The limits of disturbance lie outside the 100-foot limit; there is activity within 250 feet. The Health Department has approved the septic.
Mr. Blessing asked if the discharge point were isolated or connected and was informed that it was isolated. It is located near where the new house across the street lies. Mr. Dirrigl added that based on the map that the entire slope is located on the other side of the hill.
Mr. Blessing noted that this was not to be part of a subdivision, that the driveway is fairly steep and that it will channel a lot of water onto Mihaliak Road, be it paved or unpaved. He was told that the last part of the driveway will be flat, and shouldn’t channel water.
Mr. Blessing asked where the water went, and was told that it goes to the west.
The question of whether there were drainage issues was brought up. The water will drain into vacant state forest land.
Mr. Blessing asked what would happen when water reached Mihaliak Road, and was told that there were no swales there. Vice Chairman Schreiber said that the drains and the culvert were not on the map. The suggestion that retention be added was brought up, although the road is very graveled. Vice Chairman Schreiber commented that it would be better to shunt the water away from the septic. The issue of damage to another’s property was discussed. As this was state land, permission might possibly be needed.
Mihaliak Road #2 (where this application is located) is a narrow gravel road. There is a stone wall on the west side of the property. The utility line will be underground, and they will need to break through a small portion of the stone wall to install it. The three utility lines won’t follow the driveway. There were no further questions.
MOTION TO APPROVE THIS APPLICATION

Mr. Blessing expressed his concerns about runoff, and though that spot grades on the driveway showing that it will be to the west should be added. A swale or a culvert to deal with the runoff could be added. A pipe should be on the edge of the road as it is a safety issue for the driveway.
The motion to approve was amended with the following conditions:
1. That spot grades be included on the driveway;
2. That swales and pipes are located at the intersection of the driveway and the road; and
3. That a small area of the stone wall may be removed for the utility trench.
RESULT: THE MOTION PASSES UNANIMOUSLY.
W2005-23 – Application to modify existing permit W2004-38 Rd. (Map 46, Lot 1) Owner/Applicant: D. W. Fish Builders, LLC. (Received 7/25/05, Decision by 9/26/05)
Eric Peterson, representing the applicant, said that there would be no intersection with Lohse Road and Spak Road. He described the Open Space and the detention basin areas of the application. Two cul-de-sacs have been created: Angela Lane and Ashley Road, and drainage have been rechecked for the cul-de-sacs. There will be no impact on Spak Road. The pipe discharges outside the regulated area and collects runoff from Spak Road. The detention basin reduces flow.
Mr. Blessing asked Ms. Yorgensen if the town engineer had gone through the application, as there would now be more impervious surface. He asked if all the calculations had been done. Vice Chairman Schreiber asked if this application had been approved by the Conservation Commission and/or the Planning and Zoning Commission. Ms. Yorgensen provided the commission members with all of the correspondence from the town engineer.
Mr. Blessing asked Mr. Peterson if headwaters had been examined for the pipe size. There is a water surface elevation. If there is a headwater, can the water flow? Flow might be limited. Flow could be adjusted via inlet pipes, which may be needed.
Ms. Yorgensen said that the busses wanted the cul-de-sacs to be widened.
Mr. Blessing noted that the difference is the size of the roadway. The number of lots has not changed. It would seem that after the basins, the water would flow to Spak Road.
Mr. Peterson said that there would be no bypassing on the basin. Ms. Yorgensen commented that the town engineer was fine with the new cut. Mr. Blessing asked if there were any other comments from the town engineer. Ms. Yorgensen explained the town engineer’s recommendations for the splitting of two lots, and how it related to the PZC. Mr. Blessing asked if the easement could be a border between lots, or run through two lots. Were the easement run between lots 11 and 12, it would be part of the perimeter.
Mr. Peterson commented that if that were so, the pipe would need to be closer to the wetlands.
Vice Chairman Schreiber asked if there were any policy about having easements through other peoples’ yards. Ms. Yorgensen that this is why the town wants to own the easement strip, as people will be upset if work needs to be done. The PZC included information on the deed. Mr. Blessing said that the alternative would be to dig much deeper, and was told by Ms. Yorgensen that this would be difficult. Mr. Blessing said that the headwater issue may cause a possible culvert redesign. There was no further discussion. Tabled
W2005-24 – Application for a re-subdivision to divide Lot 1/ 2 on property at Spak Rd. (Map 46, Lot 1) Owner/Applicant: D. W. Fish Builders, LLC. (Received 7/25/05, Decision by 9/26/05)
Eric Peterson, on behalf of the applicant, stated that these two lots were to be divided. There will be no wetlands disturbance. A lot needs to be added to the subdivision. The plan has been reconfigured since meetings with IWW and the PZC. Vice Chairman Schreiber asked if there were sufficient buildable area in lot 1 and was shown that there was. The original and revised plans for lots 1 and 3 were examined. It made sense to take both of these actions together.
The committee agreed this was a good idea. Tabled
W 2005-25Application to construct a single family dwelling within the upland review area on property at Ruby Road (Map 33, Lot 17) Owner: Ruby Road Associates; Applicant: BHS Construction. (Received 7/25/05, Decision by 9/26/05)
After discussion of the lack of information supplied, the need to have a wetlands review, and - as sensitive ecological receptors could be damaged - that this could have a significant on wetlands and could merit a public hearing. It was decided; however, that Ms. Yorgensen contact the applicants and request complete information, as the application remains incomplete. Tabled
W 2005-27 Application to conduct a Forestry Wildlife Habitat Improvement Program at Spak Road Owner/Applicant: David Poole ; (Received 9/12/05, Decision by 11/4/05)
Mr. Poole described Phase 1 of his 10-year plan for a Forestry Wildlife Habitat Improvement Program on his property. There were no wetlands issues and no inland wetlands crossings. The area covered will be 19 acres. There will be a 3 acre meadow, a 5 acre clear cut for early habitat building and cut timber will be sold. It will be about 120 cords of wood, 31 truckloads total.
The driveway and a cart path will be the ways to get in and out of the property. The path will be the primary area to remove logs. To get to the path, you go off the driveway, around the barn and then onto the path. Mr. Poole anticipated 4-6 harvests over the 10 year period anticipated. A temporary bridge will be put in for the 2-week job; the area is already flagged. Once the trees have been removed, Mr. Poole will need to prepare the land, reseed and then grade it.
Rare species, such as wild grouse and woodcock would benefit from the early habitat part of this plan, which will be paid for by a USDA grant. The trees will be stumped and grubbed. This lets wildlife browse, and birds can live at higher and lower elevations. Mr. Poole’s goal is to have all of his interior land improved while maintaining a 100 foot distance from adjacent properties. The USDA is suggesting a wildflower mix for this land.
Vice Chairman Schreiber commented that unless there was impact on wetlands, that the commission really had no say in this plan. Mr. Poole asked the commission members to look over the soil/sediment control plan in the proposal/application he handed out to members.
After some discussion, it was decided that a site walk would be scheduled for this application. Vice Chairman Schreiber and the Commission complimented Mr. Poole on his excellent presentation. Tabled.
W 2005-29 Application to expand Willington Senior Housing (Owner: Town of Willington, 160 Old Farms Road, Received 9/12/05)
Staff and commission members discussed the problems with the existing Senior Housing water system. The town engineer needs to take a site walk, and septic must be part of this phase. The original calculations made for the center did not take into account the amount of water going to the reservoir. It needs to be replaced. Drainage and erosion need to be remedied in an application as well. The Notice of Violation conditions have still not been remedied. It has not been lifted. Vice Chairman Schreiber said that the applicants would be asked to bring in a more comprehensive plan to address these deficiencies. Tabled.
W2005-30 Wilderness Lake Subdivision
Received, but clarifications on water needed before it can be considered. Tabled.

W2004-04, Clover Springs Subdivision of Battye Road, Applicant: Joseph Voboril
All of the drainage information is in as of today to the town engineer, per Ms. Yorgensen. Ray will pave to 1700 feet by the end of the week. On 1500 feet of road, there are 6 catch basins. This area is scheduled to be paved. All will be done the week of October 10th, and the town engineer has no other recommendations. The erosion control is fine. There will be a walk through on September 25th at 9:30am.
