1. File #W2005-15 – 156 River Road (Map 15, Lot 27-A)
Metzler said the applicant is asking for a ruling of no-jurisdiction. He is leasing space for mechanical components. Metzler requested that Mr. Peterson come in and give details. Application was tabled.
2. File #W2005-06 – Application for 14-Lot Subdivision on property at 22 Kuchko Road
(Map 42, Lot 8-1). Owners: R. F. Crossen & Joan Aitchison; Applicant: R. F.
Crossen Contractors, LLC. (Received 3/14/05, Decision by 5/17/05.)
Metzler said that the engineer asked that we table this application until June 13, due to a revision being made to the plans.
3. #W2005-08 – Application for 15-Lot Subdivision – Lechowicz Estates – Section II,
on property on Mihaliak Road Ext. (Map 50, Lot 3). Owners/Applicant: Mary C.

4. #W2005-09 – Application for a 6-Lot Subdivision – Lechowicz Estates – Section I, on
property on Mihaliak Road (Map 50, Lot 3). Owner/Applicants: Mary C. Litwinczyk &
Litwinczyk Children, LLC. (Received 3/28/05, Decision by 5/23/05.)
Ed Pelletier of DATUM Engineering said that Section I consists of 5 lots along the frontage, all around 80,000 sq. ft. There is no activity within the wetlands but there is activity within the 250 ft. regulated area due to steep slopes. Existing drainage will be utilized. A swale will be created mid-point on Lot 3.
Mr. Pelletier said he has addressed all of Karl Acimovic’s concerns. He said that plans were revised May 2. Karl Acimovic wanted to see check dams. There could be a fair amount of sediment during construction regardless of level spreaders. There are only a few places where the road could be located, said Mr. Pelletier, who then explained the alternatives. In response to a question from Schreiber, Mr. Pelletier said there would be nothing stopping people from removing the level spreaders or check dams.
Soil scientist John Ianni gave details on the soil types.
Concerning driveways, Mr. Pelletier said that Lots 2-5 will have unpaved driveways, and Lot 1 will have an unpaved driveway.
Metzler asked for Section II alternatives. Mr. Pelletier explained the proposed road location, and spoke of the alternatives. He described how the final layout was determined.
The Commission reviewed the revisions as they applied to the Town Engineers comments.
Mr. Pelletier said that the elevation was corrected on the new plans.
Metzler said silt fences need to be shown for Lot 4 (now revised to be Lot 3).
MOTION: To approve #W2005-08 and -09 with the addition of the check dams for the swale
that runs across Lot 4 and a small portion of Lot 5, and with S&E controls for
both.

Discussion. Metzler said that staff suggested the purchaser or developer of Lot #4 post a bond for S&E, and said that he thought this was well-advised. This could be a condition for construction. Schreiber amended his motion.
AMENDED MOTION: To approve #W2005-08 and -09 with the addition of the check dams
for the swale that runs across Lot 4 and a small portion of Lot 5, and with S&E controls for both; also, that a bond be posted for S&E controls for Lot #4.

Yorgensen said that Karl Acimovic could suggest a bond amount.
Mr. Pelletier said that Mr. Acimovic had not had a chance to look at Part II as of yet. He said there are 65.4 acres of land, on which they are proposing 14 lots. The proposed road is 1,600 ft. long. He said they did have a meeting with staff regarding some issues, and the revised plan is here tonight. He describes the changes to lots numbers. There is no extra land left over. They did change the drainage basins based on conversations with Mr. Acimovic. There are small drainage changes. A conservation easement was added in back of Lot 12 and an easement added for snow storage in back of the cul-de-sac.
Dave Batista spoke, saying he helped Mr. Pelletier set up drainage for the project. He gave out 4 copies and requested that Mr. Acimovic get one. Mr. Pelletier took one to give to Mr. Acimovic, along with the revised plans. Storm drains for the northern half discharge into Basin #2 and the storm drainage from the south half of the road and Lots 1 and 2 and part of 3 ends up in Basin #1. More details of drainage were given. Mr. Batista addressed Mr. Acimovic’s concerns.
Mr. Ianni said he had visited the site recently for a biological evaluation. He pointed out several corrections regarding the numbering of lots in his evaluation. He said that Lots 11 and 12 have classic vernal pools that are very productive. They were viable as of May 16. Lots 17 and 18 have another isolated wetland, which was dry as of May 18. He said he found a small isolated wetland on Lot 16. There is a large dam and pond just off the property and along the road.
Mr. Pelletier gave a letter to staff that requested an extension to the June 27 meeting.
4. File #W2005-13 – Application for a 7-Lot Subdivision on property at 150 Clint Eldredge Road
(Map 12, Lot 20, 19.096 +/- acres). Owner/Applicant: CE Road, LLC (Contact: James

6. Cease and Desist Order issued to Joseph Voboril
re: Clover Springs Subdivision, Wetlands Permit #W2004-04 off Battye Road
Mr. Vobril said that Dave Askew and Karl Acimovic had visited the site. Metzler said he would like to see S&E controls put up ASAP prior to the meeting, and also that the berm be stabilized.
Henry Becker, the contractor, was present.
Yorgensen said that Mr. Acimovic’s schedule is flexible with enough notice. Metzler requested a meeting for a couple of hours on-site with Henry Becker, Joseph Voboril, Karl Acimovic, and himself present. He said he would like to discuss with Mr. Acimovic those areas with temporary basins. They agreed to meeting Wednesday, June 1, “rain or shine” at 6:00 p.m. Dirrigl said he would be there as well.
Metzler said he would like to see road completion and stabilization; other items such as the cart path are of secondary importance. He said they could start putting in erosion control tomorrow. Yorgensen read out loud a letter dated April 18, 2005 from her to Joseph Voboril. She commented that maybe we should start using a certified S&E control person.
