PUBLIC HEARING

File #W2004-45 – Application to construct Municipal Library and parking areas on
property at corner of Rt. 320 (Ruby Road) and Rt. 74 (Tolland Tpke.) (Map 23, Lot 7)
Owner:  Town of Willington.  (Received 12/13/04, Public Hearing/Decision by 2/14/05.)

Dale Cutler, Architect, said the site, located at the intersection of Rts. 74 and 320, consists of 4.2 heavily wooded acres with ledge outcroppings.  The land slopes fairly dramatically.  The wetlands are on the west property line.  On December 30, 2003 Ed Poluch of CT Ecosystems flagged the wetlands.  Other wetlands were found almost dead center of the property, in the middle of the slope.  On April 4, 2004 Mr. Poluch visited the site to determine if this area was a vernal wetland.  He determined that it was not a vernal pool, just an area of groundwater discharge.

Mr. Cutler said they had looked at a number of site development alternatives and found some limitations.  The final approach to design was to utilize relatively level areas to provide parking areas and place the building parallel to the slope area.  On the original plans, the building was 13,000 sq. ft., but that size presented some problems.  Instead, they came up with a two-story building design that had a footprint of approximately 9,000 sq. ft.   Only 4,000 sq. ft. will be developed on the lower level at this time, with 5,000 sq. ft. left for future expansion.  Access will be on Rt. 320, which is much safer than access through Rt. 74.

Mr. Cutler discussed parking areas and how the present location was selected.  The library is a special exception within the R80 zone, so a maximum of 15% impervious surface is allowed.  He said they have paved parking for 23 cars and unpaved for an additional 39 cars; this number of parking spots, adequate for the entire 18,000 sq. ft. building, was requested by P&Z.  

Mr. Cutler said that on July 8, 2004, 12 test pits were dug to find a location for the septic.  The best and only place for the septic is in the front of the lot.  It was approved on November 30, 2004.  

Kevin Clark of Clark Engineering said the storm water drainage comes off Rt. 74 and discharges right at the highway line.  The water tends to follow a flow that comes down to the beginning of the wetland.  A watercourse forms in the western corner downgrade, where the old mill pond is located.  A discharge pipe couldn’t be found.  Mr. Clark said that a designed storm water management system will be used so there will be no increase in the flow for 2, 10, or 100 year storms.

Mr. Clark gave details of the storm water management system.  He explained about drainage off the roof.  The footing drain and roof water will be served by separate pipes.

Schreiber questioned if sand will be trapped in the drains for the underground collection system for the driveway and parking areas, and Mr. Clark said yes.  He said there will be clean-outs in the detention system.  Metzler asked if there was a narrative on the maintenance schedule, and Mr. Clark replied no.  He said he could prepare an O&M manual for the entire system.  Metzler asked if there was vehicular access to discharge points for vehicular maintenance, and Mr. Clark said no but they could probably get a vehicle through one spot if a couple of trees were removed.  Metzler said he wanted to make sure that the system is maintained and if there is a failure, can be corrected.  Mr. Clark said that access can either be provided, or they can mark out a route.  Mr. Cutler said that the outlet is above the parking lot.  Mr. Clark said that not too much maintenance will be required on those parts of the system downhill.  He described the system.

Yorgensen said that catch basins with sump pumps are all over town most of which end up with silt getting past the sumps. She said she thought at some point there will be a ton of sand and/or silt at the discharge point.   She said she didn’t see any sence in building a system if there wasn’t access to maintain it. Mr. Clark said the system will have 840 ft. of pipe, and that some sediment will get through, but not much.  He said that the system could be designed so that the last catch basin would trap the majority of the sand.  Schreiber agreed that would be good.  Metzler asked how the filtration system would be protected during construction, and Mr. Clark said the builder will have to take care of it, perhaps putting in temporary diversions as well as silt fencing.  He said the contractor will have to clean it out before finishing the project.  A note could be added onto the design plans.

In answer to a question by Metzler, Mr. Clark said that they have worked with this kind of drainage system a number of times, in a number of locations.

Schreiber asked that a note be made to get bigger trees, and Mr. Cutler agreed.  Mr. Cutler went over concerns found in the 1/10/05 memo from Yorgensen to IWC and his response.

Metzler noted that the revised plans are Exhibit 3, and the summary report from Ed Pawlak dated January 7 is Exhibit 4.

Mr. Cutler commented on the paragraphs on page 2, under “Regulated Activities” and talked about erosion and sedimentation control.  He continued to address Yorgensen’s comments in her 1/10/05 memo.  He also referred to Karl Acimovic’s letter dated 1/10/05 and addressed Mr. Acimovic’s concerns.

Metzler noted that only some of Mr. Acimovic’s concerns about grading have been addressed; therefore, he recommended keeping the public hearing open.
              
D.    New Business

1.  File #2005-01 – Application to install a dry hydrant at 90 Krivanec Road (Map 22, Lot 11a).
    Owner:  Michael Walker; Applicant:  Willington Hill Fire Dept.  (Received  1/10/05, Decision
    by 3/1/405.)

Jim Harvey said the fire department tries to put the dry hydrants where there are a number of houses and a pond.  In answer to a question by Schreiber, he said the pipe will be about 12 ft. from the edge of the road.  Metzler commented that the fire department’s “track record” has been good.  Mr. Harvey said that although they had contracted out the installations in the past, for the last two years they have been doing the highway department have been doing the installations.  Metzler asked if there was an adjacent pull-offs, and Mr. Harvey said no.  Metzler asked about S&E controls, saying he would like to see mulching over the excavated area.  Yorgensen said the applicant will be notified of any decision, and the applicant should then notify the highway department of this requirement if they are the contractors.

G.    Old Business

1.  File #W2004-30 – Application for a single family home on property at 190 Ruby Road (Map 38, Lot 29).  Owner/Applicant:  David Lytwyn.  (Received 11/8/04; Decision by 1/10/05.)

Dave Lytwyn went over all the things that the Commission had asked him to do at the last meeting, showing how he had complied.  He said he had no alternatives.  The new house will be designed for four bedrooms.  Yorgensen said the sanitarian may allow Mr. Lytwyn to use the same septic system; it will be considered a “rebuild.” , but he had not received formal approval. He daid  Dave Lytwyn said the south side of the property will be used for the reserve. She told Mr. Lytwyn he probably needs to apply for B100A, he was not aware that he needed to.

MOTION:  To approve File #W2004-30, application for a single family home at 190 Ruby
                    Road, on the condition that the applicant gets appropriate septic approval.

2.  File #2004-38 – Application for a 14-Lot Subdivision on property at Lohse and Spak Roads

    D. W. Fish Builders, LLC.  (Received 11/8/04; Decision by 1/10/05.)

Mark Peterson of Gardner and Peterson gave out revised drawings and went over changes.  He said he had had discussions with Karl Acimovic and agreed that an area should be deeded over to the town.  There are conservation easements surrounded by wetlands in three areas.  Mr. Peterson went over two alternatives and gave the pros and cons of each.

Yorgensen said that Karl Acimovic submitted a letter dated 1/09/05, in which he said that Mr. Peterson had dealt with all concerns except one.  Mr. Peterson said the plans that were sent to Mr. Acimovic were dated January 4, 2005, so his comments were not based on the latest plans that are being shown tonight.

Metzler asked if the issue of an area being land-locked had been resolved, and Mr. Peterson said no, not as of yet.  An easement may have to be granted.  Yorgensen said that the land use attorney has not yet responded to this concern.    She said the note that Mr. Acimovic had requested on comment #6, excavation, needs to be added.

Yorgensen asked about stone walls, and Mr. Peterson said there are some along the street line of Lohse and Spak.  They will have to break through at one point.  Yorgensen said she will include a remark in her review for Planning and Zoning about stone walls.

MOTION:  To approve plans dated 1/10/05, including sheet 4 of 8 (Alternative #1), with clarification of Karl Acimovic’s comment #6 and a request to leave as many stone walls as
possible.

There was a brief discussion about the filling and grading of the driveway.

3.  File #2003-49 – Notice of Violation:  TravelCenters of America (the Lessee) and George
    Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

This was briefly discussed.

4.  File #W2004-11 – Notice of Violation – Maintaining a stump pile, stockpile of
    potential topsoil, and compacted brush storage pile within a wetland and upland
    review area on Clover Springs Farm Subdivision Phase II property located off Battyle
     Rd.  (Map 9, Lot 7).  Owner:  Joseph Voboril.

Tabled.

Yorgensen brought up the March 5, 2005 CBA Education & Training.  Pacholski and Kouyoumjian indicated they would like to attend.
