1. File #W2004-21 – Application to construct a deck within a regulated area on
property at 88 Luchon Rd. (Map 18, Lot 34) Owner/Applicant: Michael Findlay (Received 7/26/04; Decision by 9/27/04)
The property at 88 Luchon Rd. was built in a wetland-filled area and sold. It is also
in a flood zone. ZBA originally gave the builders a variance with conditions including that no exterior building would be constructed such as; decks, sheds, garages, etc.
The house, however, was built with a sliding glass door on the second level. A deck was never built because of the variance and the house was sold as is. The new owners wish to put a deck outside of the sliding doors that lead to nowhere.
The agent pointed out that the wetlands surrounding the house have been already disturbed by the construction of the house and the sewers and septic tank that exist behind the house. Therefore, the construction of the deck would not infringe on the already disturbed wetlands.
With the agreement of no further exterior improvements be made to this property, the file will be remanded to the Planning and Zoning Commission.

2. File #W2004-24 – Application to put dry hydrants in four proposed places. Applicants: Willington Fire Department.
Application was not received tonight and this was strictly informational at this point.
Stewart Cobb from the Willington Fire Department says that it has been two years since any dry hydrants have been put in. He explained that the purpose of the hydrants is to be able to access water in all seasons from stagnant bodies of water.
The proposed locations of the hydrants are as follows: 12 Loche Rd., Halls Pond Beach Area, Nichols Pond on Rt. 320, and the Willimantic River. The fire department is expecting a grant from the DEP Forestry Department. This discussion was strictly informational and intended to inform the Wetlands Commission of the fire department’s intentions of putting in new dry hydrants.
E. Applications Received After Post Agenda
1. File #W2004-23- Application for resubdivision of land at 75 Ruby Rd. (Map 28, Lot 15) Owner: Andrew Szewczuk; Applicant: David Smith (Received 7/26/04; Decision by 9/27/04)
The purpose of this application was to get permission for one building lot to be resurrected into a two-lot subdivision. No wetlands exist in the area.
Schreiber said if no wetlands exist then it was out of the Wetland Commission’s jurisdiction.

F. Old Business
1. File #W2004-19- Application to construct single family home with driveway and wetland crossing within a regulated area on Mason Road (Map 6, Lot 14)
Owner/Applicants: Eugene & Stephen Wasynczuk. (Received 7/12/04; Decision by 9/13/04)
This ten-acre lot existed in 1978 before the existence of the wetlands. The plans for the house have been constructed but the proposed driveway exists over wetland flow. The driveway will be 14 feet wide.
Schreiber was concerned about the water flowing and sitting in one spot. The builder assured him that it would be built to allow the water flow to spread out. Schreiber was also concerned that if the driveway were to be built, it should be done during the dry season. Therefore, a decision should be made soon.
The commission agreed that before any permit is issued the plan must be approved by Karl Acimovic.
MOTION: Approved with the condition that Karl Acimovic’s approval and any changes he suggests must be incorporated.

2. File #W2003-44 Notice of Violation – Filling of a wetlands and grading and filling activity within the upland review area without permits on property located at 315 Daleville Rd. (Map 7, Lot 10B) Owner: Harold W. III & Rene Bruce; Contractor: All-Phase Enterprises, Inc.
This file was addressed. It was determined that the concrete had not been removed yet and should be by August of this year. The commission decided that Gary would contact the property owners and notify them to remove the concrete by a certain date.
3. File#W2003-49 – Notice of Violation: TravelCenters of America (the Lessee) and George Giguere of Royce Properties (the owner) of the property located at 327 Ruby Road.

4. File #W2004-11 – Notice of Violation – Maintaining a stump pile, stockpile of potential topsoil, and compacted brush storage pile within a wetland and upland review area on Clover Springs Farm Subdivision Phase II property located off Battye Rd. (Map 9, Lot 7) Owner: Joseph Voboril
It was determined that the concrete had not been removed yet and should be by August of this year. The commission decided that staff would contact the property owner and notify them to remove the concrete by a certain date or they will receive a court order.

H. Approval of Minutes
On page #3, under Old Business, file #W2004-18 in the forth paragraph, the commission will change ‘doesn’t like to see septic systems inside the setbacks’ to ‘doesn’t like to see septic tanks and buildings inside the setback.
