1. File #W2004-14 – Application for selective harvest of timber on property at Mihaliak
Rd. and Mihaliak Rd. Ext. (Map 50, Lot 3). Owner: Mary & Walter Litcinczyk;
Applicant: Grossi Forest Products. (Received 6/14/04; Hearing/Decision 7/26/04.)
Yorgensen passed out copies of the logging plan and suggested that the Commission schedule a site walk before the next meeting. She said Assistant Agent Jones has looked at the property across the street and thinks there’s a lot of water where the loggers want to go in and out. She said she will ask the applicant to flag the landing and skid trail. The site walk was set for 7:00 p.m. on Monday, June 28, just prior to the meeting. POST CARDS TO BE SENT.

1. File #W2003-44 Notice of Violation – Filling of a wetlands and grading and filling
activity within the upland review area without permits on property located at 315
Daleville Rd. (Map 7, Lot 10B). Owner: Harold W. III & Rene Bruce; Contractor:
All-Phase Enterprises, Inc.
Schreiber said he noticed the top soil has been spread. Yorgensen said that Jones has been in touch and they’re not quite finished.
2. File #W2003-49 Notice of Violation – TravelCenters of America (the Lessee) and
George Giguere of Royce Properties (the Owner) of property located at 327 Ruby
Road.
This matter was tabled.
3. File #W2004-11 Notice of Violation – Maintaining a stump pile, stockpile of potential
topsoil, and compacted brush storage pile within a wetland and upland review area on
Clover Springs Farms Subdivision Phase II property located off Battye Rd. (Map 9,
Lot 7). Owner: Joseph Voboril.
This matter was tabled.

G. Staff Report/Discussion
1. Letter dated 5/24/04 from Robert S. Hockla to Chairman of IWC
re: 31 Daleville Road
Yorgensen said that Mr. Hockla received a permit to drain his pond. Nichols said he is asking for the Town to stop the water coming down from the beaver pond. Public Works supervisor, Lynn Nichols, wanted to know if she could do that, and the Commission said “no.” Yorgensen said that normally when someone does draining they provide a de-watering plan.
Nichols said that so far she has worked with Mr. Smith to try to lower his pond, but then it rains and the level increases again. She said Mr. Hockla took out a dump truck of debris recently from his pond. She said she is trying to save Hockla Farms Road from being washed out.
Schreiber said that Mr. Hockla is supposed to be addressing what he will do so that dredging doesn’t have to be done again. Ms. Nichols said she is trying to work with him.
Schreiber said we didn’t approve trying to stop the water. There was discussion about beavers. Schreiber asked how many gallons per minute are flowing, and Ms. Nichols replied that she didn’t know. She said that she was relieving the pressure, but one day she didn’t go down and the beaver dam broke. She said she is trying to keep a nice even flow. She said the pond is down 6-8” right now. She said that water is coming into the pond constantly.
Ms. Nichols said that water is coming down from other places other than the beaver dam.
Yorgensen asked Dirrigl to get information concerning beavers.
Yorgensen said that Tess Gutowski from Pinney Hill complained that silt was all over the roads and now silt is building up in the wetlands. Schrieber and Pacholski said it’s happening everywhere in town.
Schreiber said that catch basins on Clint Eldridge Road are supposed to be pumped four times a year.
Schreiber suggested that Yorgensen write a letter to the Board of Selectmen and Board of Finance asking for a maintenance schedule and to say there’s a lot of siltation going on. He said we have given permits requiring a certain amount of maintenance and it’s not happening. He said that Miller Farms Road had a maintenance schedule attached to the permit that indicated the catch basins were to be cleaned at least three times a year and sweeping done in the spring.
Schreiber said we are mandated by the state to protect the inland wetlands and watercourses of Willington; we could sent a Notice of Violation to the town if necessary.
Yorgensen said she would draft a letter and e-mail it to members for their comments.
2. Letter and attachments dated 5/27/04 from Robert Hisey, 67 Timber Lane, to Land
Use Department and Board of Selectmen
re: Complaint Concerning a Dock at 162 River Road
There was discussion about who owns the pond and dam. Yorgensen said the complaint is that we gave permits to put in docks but they were not put in the right spot. She said she went there and saw a catamaran with boards on it.
It was the Commission’s opinion being that whether or not Mr. Hisey’s complaint is valid, Inland Wetlands has no jurisdiction unless the wetlands are endangered. The dispute is between homeowners.
3. Letter dated June 8, 2004 from the Fenton Woodlands Association to IWC
re: File #W2004-09 – Dwelling on property adjacent to Bissonette Pond
Yorgensen said that the Association is concerned about the possible impact on water quality and erosion by the construction of a single family home at 92 Balazs Road. She said that non-point pollution could come from any lot that touches the pond. She said we are concerned about erosion and non-point pollution, and hoped the Fenton Woodlands Association would work with us.
MicroScience – Yorgensen said the permit has not been “reiceved” yet, although the application has been submitted. She said the Commission previeously approved a 5,000 sq. ft. building, they ended up building a 4,000 sq. ft. building, and now they want add on 1, 000 square feet. She said they’re asking for a modification of their permit and an extension as well – a modification because the plan is not exactly what the Commission was shown, and an extension because they need the 10 years. She said the building will be within the original footprints.
