D. New Business
1. File #W2003-41 – Application to dredge pond and install retention pond on property
at 31 Daleville Rd. (Map 22, Lot 25, 64 acres). Owner/Applicant: Robert S. Hockla.
(Received 10/27/03; No Decision before 11/24/03; Site Walk 11/15/03, 10 a.m.; rain
date 11/22/03, 10 a.m.; Decision by 12/8/03; extension granted to 2/9/04.)
Mr. Hockla introduced new information. Metzler said he would prefer to have Blessing here for review of the new information since he is an engineer. Yorgensen said she would contact Blessing to make sure he’ll look this application over if he can’t be at the next meeting. The applicant showed various photos. Application was tabled until the next meeting.
2. File #W2003-47 – Application to install septic system, grading and soil stockpile
in an upland review area on property at 150 Village Hill Road (Map 43, Lot 24).
Owner/Applicant: KMC, LLC. (Received 12/8/03; Decision by 2/9/04.)
Mark Peterson of Gardner & Peterson said they were asking for a permit to work in the regulated area. He said they would like to build a general store outside of the regulated area with no septic system proposed. He said they are proposing an addition and bathrooms to the recreation hall. He said the leach field will be located 100 ft. from the lake. At the last meeting we had it at slightly less than that. He said the renovation calculations have been submitted to staff. He said the recreation hall will be the site of parties for the campsites. The parties will be limited to two events per week, and limited in the number of people attending based on fire codes.
Yorgensen said the applicant wants to use the facility as a banquet hall to rent out. She asked for the capacity, and Peterson replied it is 167.
Metzler said there was a memo in the file from Karl Acimovic. He has reviewed the renovation calculations and found that if the use changes, it will have to be revisited.
Metzler said the matter of the recreation hall is separate from that of the caretaker house.
Mr. Peterson talked of the additional structure they’d like to build, on the south side of the parcel, that of the 3-bedroom caretaker house.
Metzler asked about wetlands, and Mr. Peterson replied that Ed Pawlak of Connecticut EcoSystems, LLC has been hired, and has stated that there are no wetlands within 150 ft.
MOTION: To approve Application #W2003-47 as presented per the plans submitted (2 functions weekly).

3. File #W2004-01 – Application to construct a single family home, barn, driveway,
and upgrade existing driveway and replace existing 12” metal culvert on proposed
lot split on property at 54 Trask Road (Street #70) (Map 29, Lot 18-1, 6.86 acres).
Owner: Ralph R. & Carol A. Parizek; Applicant: Donald & Maureen Parizek.
(Received 1/12/04; Decision by 3/8/04.)
Mr. Mihok stated that they will be replacing the existing 12” culvert with a 15” culvert, which is in according to Willington requirements. They are also planning to widen the driveway. Donald Parizek said the driveway was originally put in as an access road. Mr. Mihok said the proposed location is really the only available area we have. He pointed out the drainage divides. He said it was better to use the existing driveway because of wetlands. He said the area is very conducive to on-site septic, although it has not as yet been approved by EHHD. He said the test pits were approved by Janet McAllister but the design hasn’t been approved yet. He said the culvert was just a balancing culvert, with no flow through it.
Dirrigl asked if the lot was subdivided yet, and Mr. Mihok replied that it was not an official lot as of yet; Mr. Parizek said his attorney is working on an affidavit to make sure it’s the first cut.
Metzler suggested that we wait until approval from EHHD for the septic in case the septic needs to be redesigned or moved. Mihok said he still has to submit a plan, and would do so later this week and have a report for the next meeting.
Metzler said the separating distance and crossing were two items of concern to the Commission. Mr. Parizek said the culvert has never been overtopped.
Mihok said the substrate on each side of the driveway was shallow peat. There was a brief discussion about the base.
Metzler said we have until the next meeting to make a decision. He said he would leave the option open for members to go on a site walk independently. When Mr. Parizek said he would like to have notice of this, Yorgensen said she could arrange an organized walk.
Our next meeting is February 9.
4. File #W2004-02 – Application for road improvements to 947 ft. of Hockla Farms
Road (Map 17, Lot 33B2). Owner/Applicant: Town of Willington. (Received
1/12/04; Site walk done independently by members before 3/8/04 meeting; Decision
by 3/8/04.)
The Towns consulting engineer, Karl Acimovic gave out drainage calculations asked for by Mr. Blessing. He pointed out the existing drainage. He said the sediment has several sources – from the gravel area and from the road. There was discussion about the gravel area.
Metzler asked if anything else could be done to keep the sediment from the stream, and Mr. Acimovic said one thing that could be done would be to start street sweeping earlier in the spring. A discussion ensued regarding the inability of town staff to keep on top of sweeping this year because they were short staffed. Metzler said this was a huge issue on Eldridge Road. Mr. Acimovic said that steep areas on gravel roads need to be paved or to have hardened material put down.
Mr. Acimovic said he wanted to see intermediate controls used for the proposed work. He said that stone check dams would be used. He said he had added a narrative on the plans for the construction sequence. He said they are stopping before the twin culverts. He said the check dams are temporary.
Dirrigl said he would visit the area.

5. File #W2003-44 Notice of Violation – Filling of wetlands and grading and filling
activity within the upland review area without permits on property located at 315
Daleville Road. (Map 7, Lot 10B). Owner: Harold W. II & Rene Bruce; Contractor:
All-Phase Enterprises, Inc.
No one was present for this application. Metzler said the contractor came in at the last meeting. He said this violation was previously discussed. He said the contractor did agree to come up with a re-grading plan to include where material to be removed will be placed. Action tabled until a plan is submitted.
6. Violation: TravelCenters of America (the Lessee) and George Giguere of Royce
Properties (the Owner) of property located at 327 Ruby Road.
Metzler said there has been an additional oil spill of about 100 gallons since the original violation, and that apparently the oil/water separators do not function. She suggested devoting a full meeting to review all the materials and where Blessing was present. She said she would ultimately like to tell them what the deficiencies still are and what they need to do about them.
