D. New Business
1. File #W2004-01 – Application to construct a single family home, barn, driveway, and
upgrade existing driveway and replace existing 12” metal culvert on proposed lot split
on property at 54 Trask Road (street #70) (Map 29, Lot 18-1, 6.86 acres). Owner:
Ralph R. & Carol A. Parizek; Applicant: Donald & Maureen Parizek. (Received
1/12/04; Public Hearing or Decision by 3/8/04.)
Donald Parizek, applicant, said they are working on a lawyer’s affidavit. This is a one-lot cut. He said the existing driveway, installed in the early 70s, will be used as the “official” driveway. He said the 12 in. culvert there has been crushed somewhat by trucks. He said they want to upgrade the width of the driveway to 10 ft. with 2 ft. shoulders on each side. The applicant said that the majority of activities other than the road are outside the 100 ft. buffer zone. He pointed out alternate sites on the map for the house but stated they weren’t suitable for on-site septic. He said he is asking for replacement of the culvert, replacement of fill to widen the driveway, and grading in a regulated area.
Jones said the setback is 250 ft. from the wetlands due to the steepness of the slopes.
Metzler asked if the site was currently forested, and Mr. Parizek replied that part is, and part isn’t.
Jones commented that the barn would have to be located 100 ft. from the property lines.
Mr. Parizek said the 12 in. culvert was adequate and had never overtopped, but he thought the proposed 15 in. culvert would promote more flow.
Jones suggested the applicant get EHHD approval. The applicant said the property is on a sandy till knoll and is very well-drained, with no water table anywhere near there. He asked if there was problem having the well within the 100 ft. buffer zone, and Blessing answered that it was not.
Blessing noted the entire parcel is within 250 ft. of the regulated area. He said he wanted to know what grading and access would be required for the barn.
Mr. Parizek said he flagged the wetlands. He said that Mihok and EHHD were there when the test pits were done. He said he could provide a narrative on the wetlands for the next meeting. He pointed out different soils on the soils map, and handed out copies of the legend. He said there is just a path to the barn.
Metzler said that .03 acres will have to be filled. Dirrigl said a narrative wouldn’t be needed. Metzler asked if the property was clearly marked for a walk, and the applicant replied that it was. Metzler said the Commission would set a date for the site walk and notify the applicant.
2. File #W2004-02 – Application for road improvements to 947 ft. of Hockla Farms
Road (Map 17, Lot 33B2). Owner/Applicant: Town of Willington. (Received
1/12/04; Public Hearing or Decision by 3/8/04.)
Carl Acimovic passed out plans and aerial photos. He pointed out the part of Hockla Farms Road that will be developed, and also pointed out the turnaround area. He said the reason the improvements will not be extended all the way is the cost. He said an agreement has been reached with the property owners. Mr. Acimovic said they will not be doing significant grading and are just going a little bit wider. He said they have 12 in. corrugated pipe now, and will have 15 in. ABS pipe. He said the culvert has a capacity of 17 CFS.
Mr. Acimovic said the proposed road surface will be recycled asphalt product, which will cut down on any erosion. He said there has been nothing done to the road for 10-15 years at least and it can be traveled by a 4-wheel drive vehicle. He said the road surface, the same as used on Daleville Road, is stable enough to be plowed. He said it will cut down on erosion, although the erosion has basically stabilized. Mr. Acimovic said they have had complaints of silt going down to the stream.
Metzler asked if there was a lot of gullying on shoulders. Mr. Acimovic replied that they were not getting a lot of water, and that if they could get a good, stable grass on the shoulders, they could go up to 5 FPS.
Metzler said he hoped the work will improve the sedimentation and erosion. Blessing asked if the shoulders would have grass swales, and Mr. Acimovic replied that they wouldn’t because of a lack of room.
There was discussion about how much sedimentation has come off Hockla Road and may be in the stream or pond.
Metzler requested sedimentation and erosion controls during the road work. A site walk will be done individually by members.
E. Old Business
1. File #W2003-44 Notice of Violation – Filling of a wetlands and grading and filling
activity within the upland review area without permits on property located at 315
Daleville Road (Map 7, Lot 10B). Owner: Harold W. III and Rene Bruce; Contractor:
All-Phase Enterprises, Inc.
GB said he never got out for a site walk. Kouyoumjian said he had seen the site.
Mr. Bruce said he ordered the required hay bales but they are not in place as of yet. Metzler commented that it will be hard to drive metal stakes when the ground is frozen. He said the hay bales are needed now, and that a course of action is required. He said he would like to see the slope moved back about 10 ft. He said a plan is needed to show how this will be done.
Mr. Bruce said the fill is mostly gravel with some concrete.
Metzler said there is no restoration plan, a necessary item. He said that sedimentation and erosion controls need to be in place.
Jones said this will be kept on the Agenda.
A representative from All-Phase Enterprises said the concrete will be removed.
Metzler requested that Blessing see the site, and Jones said he would go with Blessing.
Metzler asked Mr. Bruce to provide an A-2 survey and to flag the property line rods. He said the Commission needs to approve everything that is done.
Mr. Bruce said he would call when the hay was in place. Blessing said the site walk with Jones would be done after that.
Metzler said he wanted to have the restoration plan by the end of February.
2. File #W2003-41 – Application to dredge pond and install retention pond on property
at 31 Daleville Road. (Map 22, Lot 25, 64 acres). Owner/Applicant: Robert S.
Hockla. (Received 10/27/03; No Decision before 11/24/03; Site walk 11/15/03, 10
a.m.; rain date 11/22/03, 10 a.m.; Public Hearing or Decision by 12/8/03; extension
granted to 2/9/04.
Jones said the applicant has submitted new plans
Robert Hockla said he will try to dredge everything on the bottom of the 3-acre, spring-fed pond with a dozer in July. He said the pond has a clay bottom and he would like to put it back to the original depth. He said that sediment was removed back in 1964 or so.
Jones commented that it might be several years before conditions were right to dredge it. He said the applicant would need a silt fence and hay bales to stabilize the banks when the material was spread.
In answer to members’ questions, Mr. Hockla said that pond depth near the drain is about 9 ft, it will take about two weeks to drain the pond, and the water is fairly clear at present. He said that grass should grow on the dredged material.
Blessing asked if the applicant had enough acreage to spread and seed the material, and Mr. Hockla replied yes, he has about 2-2 l/2 acres. The applicant said he would use an excavator as well as a bulldozer.
Metzler said he was concerned with the quality and quantity of the water draining into the Fenton River. Jones said the drain can be closed if the density increases. He said the applicant needs to let Land Use know when the drain will be opened and also when dredging starts.
Mr. Hockla said the water from breaking beaver dams on the upper pond, which the town owns, creates a problem.
Jones said he could write to the town when the dates the work will be done are known.
Blessing said that more details, such as the amount of material to be taken out of the pond and the limit of excavation, are needed. Metzler said he wanted to see a narrative on the process.
A decision on this application was tabled.
3. File #W2003-47 – Application to install septic system, grading and soil stockpile in an
upland review area on property at 150 Village Hill Road (Map 43, Lot 24).
Owner/Applicant: KMC, LLC. (Received 12/8/03; Public Hearing or Decision by
2/9/04.)
Jones said that revised plans have been submitted, plans that have the septic moved back 100 ft. from the pond. He said he had a letter from the applicant stating that no wetlands are within 150 ft. of the proposed house. He said that calculations have been faxed over to the Land Use Department. Metzler asked Jones to have Carl Acimovic look over the calculations.
4. Violation: TruckCenters of America (the Lessee) and George Giguere of Royce
Properties (the Owner) of property located at 327 Ruby Road.
This violation was discussed briefly. Blessing asked Jones to ask Yorgensen about another, more recent, oil spill. Dirrigl stated he would like to see the date of the violation from almost a year ago placed on the Agenda. He borrowed the file to review it.

H. Staff Report and Discussion
There was no Staff Report.
The upcoming land use training session with Atty. Branse was discussed. Blessing suggested that the Commission get together some questions before then. Kouyoumjian suggested that the Truck Center of America violation be discussed at the training session.
Metzler said that Mr. Bruce (File #W2003-44) needs to get a soil scientist to locate where the wetlands are on his property.
Metzler said we need a revised plan from Parizek (File #W2004-01) before a site walk is scheduled.
