1. File #W2003-44 Notice of Violation – Filling of a wetlands and grading and
filling activity within the upland review area without permits on property located
at 315 Daleville Rd. (Map 7, Lot 10B). Owner: Harold W. III & Rene Bruce;
Contractor: All-Phase Enterprises, Inc.
Metzler said he had visited the site, and there is a lot of fill there, at least 20 loads that needs to be spread. He said the slope is pretty steep. At the bottom of the gully is a wetland draining into the other wetland. He said that substantial erosion is occurring.
Dirrigl asked about the composition of the fill, and Mr. Bruce replied mostly gravel, from UCONN property.
Metzler said he was disappointed the contractor was not present. He suggested that Blessing and Dirrigl look at the site, which needs to be graded back. He said it would be difficult if not impossible to stabilize it. He said it drains into the wooded swamp. He said there is material in both the upland areas and wetlands. He said a silt fence is 10-12 ft. away from the basin, and Mr. Bruce would have to secure bales of hay closer to the top.
It was decided to send a letter to the contractor, as he is responsible. Yorgensen said it should be turned into an order as to what should be done. The contractor should be working from the top and has to remove all material from the wetland.
Metzler said a site walk should occur with the contractor, Mr. Bruce, and Commission members. There was discussion on exactly what needs to be done. Dirrigl said a construction/restoration plan needs to be submitted.
The site walk was set for 9:00 a.m. Saturday, December 20. A letter will be written to both Mr. Bruce and the contractor after the site walk and holidays. The next IWC meeting is January 12.
Metzler said that double-sticked bales of hay should be placed the length of the site fence and 10 ft. up the slope.
2. File #W2003-41 – Application to dredge pond and install retention pond on property
at 31 Daleville Rd. (Map 22, Lot 25, 64 acres). Owner/Applicant: Robert S. Hockla.

rain date 11/22/03, 10:00 a.m.; Public Hearing or Decision by 12/8/03.)
Mr. Hockla said he had talked to the DEP and they had sent him an application. Metzler said he spoke with the DEP and suggested that the applicant dig a “forward basin” in the pond to capture sediment. Then he would not have to apply for a diversion permit or get involved in the Army Corps of Engineers. Metzler said that Mr. Hockla will have to clean out the silt basin. Yorgensen said the problem has existing for many years. She said that Karl Acimovic is now designing plans to improve the road up through the next road. Metzler asked Mr. Hockla if a lot of sediment was coming from Hockla Farms Road, and Mr. Hockla replied that he thought it came mostly from Dalesville and Old Farms Road. Metzler and Yorgensen suggested that the applicant speak with the First Selectman’s office since they may then redesign the road with the applicant’s interests in mind.
Mr. Hockla asked for an extension to the decision date.
3. Violation: TruckCenters of America (the Lessee) and George Giguere of Royce
Properties (the Owner) of property located at 327 Ruby Road.
No action was taken on this violation.
4. & 5. Wilderness Park Campground, Request for preliminary site development
plan approval, and Application for regulated activity.
Mark Peterson of Gardner & Peterson Associates said that a three-bedroom caretaker house is being proposed, along with a well and leach field greater than 150 ft. away from Rainbow Lake. He said the General Store will also be more than 150 ft. away. He said there is no water service, so no septic will be required. He said they would like to add bathrooms to the Rec Hall, so they are proposing a leach field on the north side of the Rec Hall, and a permit is needed. This proposed leach field will be 90 ft. from Rainbow Lake. He said more detailed plans have been submitted to the Health Department.
Metzler said they are looking for a permit for activity within the regulated area.
Mr. Peterson said that they drain to Roaring Brook. He gave out plans for the leach field. He said that some fill in this area will be stripped out.
Blessing asked if a laundry facility will be proposed, and Mr. Peterson replied he didn’t think so. Blessing asked if the existing bath house uses the existing leach field, and Mr. Peterson replied yes.
The consensus was that we agree that the concept is viable and we understand that any activity will require further review and in some cases a permit.

Correspondence was reviewed.
G. Staff Report and Discussion
Yorgensen showed members the revised plan for a cellular phone tower. She said that DEP gave testimony that there is a watercourse, with the proposed site right on top of a wetlands drain. We have until December 18 to comment. Metzler said a letter should be written saying that we concur that there is a watercourse and the tower should not be located in that area.
There was discussion about the Clover Springs subdivision. There was consensus that since 10 years have gone by, no more activity can take place after December 15. A new permit would have to be applied for and new fees paid. Yorgensen said she would write a letter to that effect.
