1. File #W2003-40 – Application for a 12’ x 16’ porch and l2’ x l2’ deck in an upland
area on property located at 54 Daleville Road (Map 17, Lot 25, 2.5 acres). Owner/
Applicant: Nora Claus. (Received 10/27/03; No Decision before 11/24/03; Public
Hearing or Decision by 12/8/03.)
Schreiber said the proposed deck is 65 ft. from the man-made pond. Jones said he looked at the site, and recommended agent approval.
MOTION: To remand #W2003-40 to Staff.

2. File #W2003-41 – Application to dredge pond and install retention pond on property
at 31 Daleville Road (Map 22, Lot 25, 64 acres). Owner/Applicant: Robert S.
Hockla. (Received 10/27/03; No Decision before 11/24/03; Public Hearing or
Decision by 12/8/03.)
Jones recommended that the applicant flag the areas he wants to dredge and that a site walk be taken. Mr. Hockla said he would like to spread the material from dredging in a field and then seed the area. He said the silt came from several nearby roads. He showed pictures which indicated the delta is growing. Schreiber said a site walk will be set later in the meeting and then the applicant will be contacted to see if the time is mutually agreeable. The applicant gave the green card from Willimantic Water Works to Jones.
3. File #W2003-42 – Application for selective timber harvest adjacent to wetlands with
stream crossing on property at 169 Lohse Road (Map 52, Lot 28, 17+/- acres).
Owner: Richard Jenkins, III; Applicant: Ted Willis. (Received 10/27/03; No
Decision before 11/24/03; Public Hearing or Decision by 12/8/03.)
No one was present to speak concerning this application. Schreiber said the Commission could look at this site when doing the other site walk. He said a corduroy-type log crossing will be used.
E. Old Business
1. File #W2003-38 – Application for a single Family Dwelling with a driveway crossing
the wetlands on property located at 222 Moose Meadow Road. (Map 36, Lot 6, 4.91
acres). Owner: Richard Shaw; applicant: Steve & Barbara King. (Received 9/22/03;
No Decision before 10/6/03; Public Hearing or Decision by 11/24/03.)
Joseph Boucher of Towne Engineering gave out copies of a memo received from Karl Acimovic asking for one minor change which they incorporated into their plans, which is to increase the size of the rip rap on the outlet to intermediate to handle a 100-year flow velocity in the pipe. He indicated a note from Willimantic Water Works saying that they’re okay with the plans. Mr. Boucher gave out copies of a letter sent to Yorgensen. He said both requested changes (which were minor) were made on the plans. He said that the soil types, including wetlands, have been added as well as the dug well across the street. He said that instead of using a silt fence, stone check dams will be used. He said the buildable area has been increased. Mr. Boucher said he has asked to upgrade to a 5-
bedroom septic system because of the extra room, and now a modified approval will be needed from the Health Department. He showed photos of the property. He said that about 35 ft. was in wetlands. He said the proposed driveway is where the town left an apron.
Schreiber asked if the pipe was 60 ft. long, 18 inches in diameter, and dropped 4 ft. over its length, and Mr. Boucher concurred. Mr. Boucher said the slope is 6 l/2%. He said the pipe is designed to run one-half full in a 100-year storm. He said he submitted the information to Karl Acimovic, who took no exception to anything except for the size of the rip rap at the outlet. He said construction will begin in March. He said that gravel will go under the pipes, which will be made of high-density plastic.

recommended.

Schreiber asked if there was a change in notes, saying that there are notes in the reserve area of both lots indicating they should be filled with select material before putting in common fill.
Mark Peterson of Gardner & Peterson replied that this was requested by the Eastern Highlands Health District. He said they were also asked for perc test clarification for Lot #1.
Schreiber referred to a letter dated October 27 from Karl Acimovic, and Mr. Peterson said that they have responded to 10 comments. For the first, drainage and methodology, they have looked at the watershed draining into the site, areas they were disturbing, flag numbers 13-31. He said that on this application they don’t have a point of discharge or origination, but do have a hillside that drains west to east. He said they have submitted calculations to Mr. Acimovic showing pre- and post-development rates of runoff. Mr. Peterson said the flows are very similar. He said there is an 8-acre watershed and an existing gravel driveway. He said the improvements will be two houses and driveways. He said the 515 ft. length is spread out before reaching the wetlands. Mr. Peterson
said they have provided an energy dissipater to offset increase.
Mr. Peterson said the memo also speaks of areas where we might have a slight concentration of flow, and that they’d be happy to eliminate any of these. He said there is ledge at the southerly end of the leach field on Lot #21. He said they’ll have to build up in fill. He said we could extend the contour lines out. He said they’re working within 200 ft. of the regulated area and want to minimize the disturbance. Mr. Peterson said the same situation exists at the southerly end of the leach field for the lower lot, and extending contour lines there would not be a problem. He said that concerning run off from the left side of the house on Lot 21, they don’t know how to avoid the concentrated flow there, but they do need to get the water away from the back of the
house and get it back to a sheet flow pattern. He said the contours will sheet the surface water in a lot of directions. He said that concerning the rear lot common driveway, any change would be difficult since there is only one place to adjust the lot line. Mr. Peterson said that on Lot 21, the driveway is as far west as possible because of the steep slopes, which continue along 250 ft. of the regulated area. He said they did move the house slightly to the south; they may have issues with Planning and Zoning, but they can’t move it up the hill. He said he tried to sketch up another options for both lots, trying to minimize the disturbance. He said he tried to pull the house closer but wasn’t able to make it happen. He showed a map of this alternative.
Schreiber asked if a smaller house could be built, and Mr. Peterson replied that it’s not big now, the footprint being 62 ft. x 24 ft. He said the perc rate is 10 on both lots. In the last paragraph of #1, reports were requested.
On #2, Mr. Peterson had no comment. On #3, Mr. Peterson said he would be happy to modify some of the contours. On #4-9, Mr. Peterson said he had no comment. On #10, Mr. Peterson said Mr. Acimovic is asking for supervision to make sure all is being built according to plan.
Mr. Peterson said he disagreed with a few things on Janet McAllister’s memo. He said they had original conditional approval and sent some additional plans to her, requesting feedback. He said the area adjacent to the leach field is of concern to her. He said the dissipaters are stone berms one foot tall, with silt fence upgrade and downgrade of these. He said that on Lot 21, they do not have concentrated drainage, and the proposed grading will fan out the water flow.
Mr. Peterson said he has met with Bob Stewart about Commission concerns. One of the biggest concerns was the east side of the house on the lower lot. He said that now they will have a walkout basement along this east side instead of a concrete wall, which saves 6-7 feet of fill and creates less disturbance. He said the seeding schedules are now final, and the slope will not need to be mowed.
Jones asked if the slopes can be mulched for the winter, saying there’s a lot of open territory. He said they can come up with something later.
Csiki reminded that the use of innoculant for legumes is necessary, and Mr. Peterson made a note on the plans.
Mr. Peterson talked about an alternative for Lot #21 and #20-22.
Schreiber asked if P&Z had already approved the single driveway, and Mr. Stewart replied yes. He said construction would start in a few weeks if the application is approved, with both sites started at the same time. Schreiber said that oversight will be important. Mr. Stewart said that Mr. Acimovic has reviewed the updated plans.
MOTION: To approve #W2003-28 and #W2003-29 with the following conditions:
1. Extend the contours on both lots to minimize swale or point
discharge at the south end of leach fields.
2. Sedimentation and Erosion control bond for site 21, 20-22 for
whole project, start to finish, approved by staff.
3. Have engineer or rep to inspect weekly to see if controls are
working for whole site and submit a construction report to the
Agent.
4. Certify whole project is up to plan by engineer before C.O. or bond
release.
5. Any change in plans from Eastern Highlands must be considered
and returned to staff for approval.
6. Review a workable plan for erosion control for the winter duration
on the unstable slopes, and make it part of the bond.
7. Bond approved by staff.

H. Staff Report and Discussion
Jones said he will look at the state regulations concerning dredging. He said each member has a copy of the meeting schedule for 2004, with the next meeting December 8. The consensus was that a site walk for #W2003-41, Hockla, and then #W2003-42, Jenkins, will occur on Saturday, November 15 at 10:00 a.m., raindate November 22.
