1. File #W2003-34 – Application to construct an addition to existing house on property
at 49 Tinkerville Road (Map 36, Lot 11A, Zone R80). Owner/Applicant: Richard
B. Lavigueur. (Received 9/8/03; No decision before 9/22/03; Decision by 10/27/03.)
Metzler arrived at 7:39 p.m.
Mr. Lavigueur said there is an existing footing drain. In answer to a question by Blessing, he said that that the garage door does not give driveway access. He said the concrete walkway goes around to the front. Blessing asked if the crossing wall would cut into the footing drain, and Mr. Lavigueur replied hopefully not. Blessing asked about the material taken out, and the applicant replied that hopefully there will not be much material, but that he may have to get rid of it in the wooded part of his property.
The application was remanded to staff
2. File #W2003-36 – Application for a Single Family Dwelling in an upland area on
property located at 46 Village Hill Road (Map 38, Lot 14, 1.4 acres).
Owner/Applicant: Richard and Donna Napolitano. (Received 9/8/03; No Decision

No one was present, and no action took place on this application.

3. File #W2003-33, Application to construct a gazebo on property at 20 Nipmuck Road
(Map 2, Lot 18-4, 4.29 acres). Owner/Applicant: Roxie and Loretta Allison.

Yorgensen said the gazebo is to be located on the top of the property, near the house.
Mrs. Allison said that crushed stone will be used; they may have to use blocks or something else to make the gazebo level. She said the gazebo is 14 ft. in diameter.
The application was remanded to staff.

1. File #W2003-28 – Application for a Single Family Dwelling in an upland area on
property located at 31 Potter School Road (Map 49, Lot 2-21, 2.86 acres). Owner/

Commission members were referred to a recent letter from Yorgensen to Karl Acimovic asking him to review this application, as well as a letter from Mr. Acimovic to Yorgensen dated September 1, 2003.
Mr. Stewart said that Crossen Builders will be used for construction. He said a seeding blanket would be used to help with grass seed germination.
Blessing talked about different kinds of seed as well as expressing his opinion that a 2:1 slope will be extremely difficult to mow. Csiki said that birds-foot and crown vetch, both good for slope stabilization, need legume innoculant.
The applicant said that the 3:1 slope goes right to the edge of the wetlands and over the septic system. He said he thought that a 2:1 slope with natural vegetation was better than grass, and also spoke of retaining walls.
Blessing asked if there was any way to leave the slope undisturbed. He said it was almost better to have a steeper driveway and a less steep slope. He said the proposed driveway would drop 2 ft. in 20 ft., and Yorgensen said that a driveway can’t have a slope over 12%, adding that it doesn’t have to be paved if it’s 10%.
The applicant went through his engineer’s comments.
Regarding runoff, Blessing said we are looking for pre-development and post-development from the 9.5 acres.
The applicant said that grading a 3:1 slope would go into the conservation easement area.
Blessing said he had questions on the increase in runoff and its impact, and asked if there was a way to mitigate the increased amount of runoff. He said that in the area of temporary ditches on Lot 20-22, an “energy dissipater” is needed. He said a long, couple of feet wide swale, or “energy dissipater,” is needed.
The applicant said the Fenton River did get labeled on the map legend. He said that the Willimantic Water Works has been notified. He said that the 100 ft. regulated area has been eliminated because 250 ft. applies.
Csiki noted that it would be good for the applicant to have his engineer here at the next meeting.
Metzler said a construction bond should be required. He said he would like to see more details on the proposed construction sequence.
Blessing said that materials classification for the fill is needed also.
The applicant requested a 65 day extension.
3. File #W2003-22 – Application for a driveway crossing in the wetland area on property
located on the easterly side of Mason Road (Map 6, Lot 14, 10.06 acres). Owner/
Applicant: Eugene & Stephen Wasynczuk. (Received 5/12/03; 65-day extension
requested and approved; Decision by 9/8/03.)
Mr. Wasynczuk withdrew his application stating that he would reapply at a later date and asked that his fee be waived for the next application. The Commission will consider a reduced fee.
4. Violation: TruckCenters of America (the Lessee) and George Giguere of Royce
Properties (the Owner) of property located at 327 Ruby Road.
The Commission asked what staff had received from DEP regarding this. Yorgensen said that in spite of her efforts to get copies of other information, all the paperwork she has on the oil spill incident is an “Incidence Investigation Report.” Schreiber suggested the matter be turned over to our attorney.
Kouyoumjian left the meeting at 9:03 p.m.
F. Correspondence
1. CT Statewide Draft of the Forest Resource Plan
Correspondence was reviewed.
G. Minutes
MOTION: To approve minutes of July 28, 2003.

Result: Motion passes 3-0-1 (Dirrigl abstained).
H. Staff Report and Discussion
Dirrigl noted that there has been another accident in George’s Brook, saying there should be something in place. He said that no one ever goes back to determine if there is any debris.
Dirrigl said the debris from the last accident is still there.
