MINUTES OF MAY 13, 2002 REGULAR MEETING

D. New Business
1. File #W2002-20 – Application for a Wetlands Permit for logging located at 166 Village Hill Road (Map 47, Lot 36, 175 acres). Joseph Halchek owner/applicant. (Received on 05/13/02, No Decision before 05/27/02, Hearing or Decision by 07/08/02.)
Steve Acerbo gave details of the proposed logging operation. He said there are two sections of wetlands. He said the grade is less than 10% near the lake, and he will leave an extra 25 ft. buffer around the lake, which is double the required width. He said there are no streams or wetlands in the harvest area. He said there would be a main skid trail following proposed lot lines, and no gravel would be used.
Schreiber asked if the edges of the wetlands were flagged, and Mr. Acerbo replied that they were. He said there was plenty of area to absorb any runoff, the operations would be mechanized, and very little slash will be left.
Metzler asked if there would be selective cutting, and Mr. Acerbo said yes, that only high-grade trees would be taken in the 175-acre area. He said an average of 6-7 trees per acre would be taken over a period of 8-9 weeks.
Schreiber asked if Mr. Acerbo was a supervising forest products harvester, and Mr. Acerbo replied yes, that his license number was on the map.
Metzler asked how the intermittent stream would be crossed, and Mr. Acerbo replied that he would try not to cross it, but if he had to, he would put a bridge in. He said he had pre-built bridges he could use.
Yorgensen asked if the state requires a forester to do a management plan on this property, and Mr. Acerbo replied no. Yorgensen said she would need a written narrative on proposed activity.
Mr. Acerbo said that black and red oak would be harvested, along with a small amount of chestnut oak. Metzler asked if the harvesting would be done in phases or in one operation, and Mr. Acerbo replied that that would depend on the proposed sale.
Discussion followed concerning the intermittent stream. Metzler asked the applicant to write up a narrative and then we’ll look at the areas in question. Yorgensen said the next meeting will be on June 10.
2. File #W2002-22 – Application for a 3 Lot Subdivision located off Latham Road (Map 9, Lot 32, 24.60 acres. Michael Nogas, owner/applicant. (Received on 05/13/02, No Decision before 05/27/02, Hearing or Decision by 07/08/02.)
Ed Pelitier presented plans for a 3-lot subdivision. He said there will be no road within the wetlands. He said another report on vernal pools will be coming from George Knoecklein. He said the lots will have regular houses with two-car garages. He said the land has been perc-tested; the septic systems will use medium to coarse sand.
Blessing asked if the vernal pool on Lot 2 is the only one identified, and Mr. Pelitier replied yes, as of now. Blessing asked if Lot 3 had a pond or wetland area, and Mr. Pelitier replied that it is a dry area except for the ruts from 4-wheel drive vehicles.
Mr. Pelitier said that footing drains will be used on Lots 2 and 3.
Blessing asked if the driveways are pretty much on grade, and Mr. Pelitier replied yes, that one of the driveways needs to be leveled out less than two feet; Lot 3 will use the existing driveway.
Metzler asked if fill would be required, and if so, where would it come from. Mr. Pelitier replied that there will be some raised areas so fill would be required. He said on Lot 2 about 4 feet of fill would be needed around the house to sheet water and hide some concrete.
Schreiber asked if the septic systems will be engineered, and Mr. Pelitier said yes, about 12 inches of fill will be required.
Metzler asked what markings were present, and Mr. Pelitier replied that test holes and wetland flags were present; the site is easy to find.
After a brief discussion, a site walk was set for 6:30 p.m. on June 10.
3. File #W2002-23 – Application for a Wetlands Permit to extend existing lawn area in the Regulated Area located at 317 Tolland Tpk. (Map 22, Lot 9). Scott S. Hills owner/applicant. (Received on 05/13/02, No Decision before 05/27/02, Hearing or Decision by 07/08/02.)
Metzler said the applicant wants to extend his lawn down the brook. A brief discussion ensued concerning the identity of this brook. Metzler asked Yorgensen to send a note to the applicant to come to the next meeting. He said a site walk could be scheduled after the Commission meets with the applicant.
4. File #W2002-24 – Application for a 2-lot subdivision located off Kechkes Road (Moosemeadow Campground) (Map 27, Lots 13-A, 6, 13-2, 53.2 acres). George N. & Irene C. Haspes owner/applicants. (Received on 05/13/02, No Decision before 05/27/02, Hearing or Decision by 07/08/02.)
Ed Pelitier represented the applicants. He said the southern portion of the property would be divided into two parcels. He said there would be a town road and then an easement from there. He said one lot would be 22.9 acres and the other 30.3 acres. He said Lot 2 has an existing dwelling.
MOTION: That we have no jurisdiction.

Discussion followed. The consensus was that Inland Wetlands has no jurisdiction since there is no activity within a regulated area.
Result: Motion passes unanimously.
E. Old Business
1. Approval of revised plans: File #W2002-12 – Application for an activity within the Regulated Area for a driveway for a single family home located off Latham Road (Map 9, Lot 32, 7.93 acres). Michael Nogas owner/applicant.
Yorgensen questioned why this was on the agenda, saying that a permit wouldn’t be issued until all conditions are met.
Blessing said he would like to see sites 2 through 8 on the map since they were identified as breeding pools. There was discussion about how vernal pools could be measured and identified on a map. Dirrigl noted that George Knoeckline sketched in areas that could be pools. Yorgensen commented that Mr. Pelitier could put a caveat on the map. She said she thought the terms “potential breeding pools” or “possible vernal pools” would be better terms than “vernal pools.” She noted that these maps would be used in the future and said that the more information on the maps, the better.
Metzler said that Mr. Knoeckline should flag these areas and Mr. Pelitier put them on the map. He said they should be called whatever Mr. Knoeckline calls them.

G. Approval of Minutes
Dirrigl requested the following change to the April 22, 2002 minutes: on page 3, line 5, change “would not be impacted” to “would not impact dispersal.”

H. Staff Report and Discussion
Yorgensen brought Commission members up to date on several issues and lawsuits.
Dirrigl asked Yorgensen if she as IW&W agent would be notified if a car accident, for example, occurred in a wetland area. Yorgensen replied that she would not be notified; the driver’s or property owner’s insurance company would take care of it. She added that the state Department of Environmental Protection is supposed to know about any type of spill within 24 hours.
