MINUTES OF MARCH 25, 2002 REGULAR MEETING
A. Call to Order
Metzler called the meeting to order at 7:30 p.m.

D. New Business
1. File #2002-17 – Application for activity within the Regulated Area for an above-ground pool located at 135 River Road (Map 15, Lot 17A). Sabrina Pools applicant, Jacques Ouimette owner. (Received on 03/25/02, No Decision before 04/08/02, Hearing or Decision by 05/13/02.)
Ron Nado from the Sabrina Pool Company asked if the commission members had been at the site, and Gutowski replied that they had. She said there are no real wetlands there. She asked if the water would be lowered in the winter, and the applicant replied that it could be left full. Mr. Nado said the pool will be filled with 17,000 gallons from the well. Jones noted that if the water were let out of the pool, the water would come forward away from the wetlands. Mr. Nado said the chlorination of the water would be no stronger than that of city water. He said the pool has a 25-year warranty. Jones said that both he and Sue Yorgensen have visited the site.
MOTION: For the agents to have responsibility for approval of File #2002-17.

Kouyoumjian asked Jones how far the site was from the river, and Jones replied 1/8 mile. Metzler informed the applicant that Jones and Yorgensen would be meeting with him.
E. Old Business
1. File #W2002-16 – Application for a Wetlands Permit for activity within the Regulated area including culvert crossing and driveway construction for a Single Family Home located off of Clint Eldredge Road (Map 17, Lot 44B, 5.546 acres). Jessie Dubois/applicant, Richard & Carol Evans owners. (Received on 03/11/02, No Decision before 03/25/02, Hearing or Decision by 05/13/02.)
Jones noted the applicant was not present. He said the engineer is still reviewing the culvert. Gutowski recommended that commission members walk the site, noting that property lines were difficult to find.
2. File #2002-14 – Application for an activity within the Regulated Area for a single family home including grading located off Liska Road (Map 32, Lot 7-7, 2.37 acres). Estate of Joseph Mihaliak owner/applicant. (Received on 02/25/02, No Decision before 03/11/02, Hearing or Decision by 04/22/02.)
Mark Petersen represented Gardner, Petersen & Associates. He said that at the last meeting there was one outstanding issue, a concern about storm water runoff down the proposed driveway onto Liska Road. He said he has worked with the town engineer to come up with a solution to minimize the impact. He said he will “tweak” some of the grade along the easterly edge of the driveway. He said there is a slight cross-slope on the driveway also, and a series of berms will reduce the flow. He said a one-foot-tall grass berm along the property line would cause the flow to drain to the east. The town engineer said this was acceptable in his memo. We are not considering a level spreader because of aesthetics and maintenance.
Gutowski asked if Mr. Pelletier he had talked to Karl Acimovic about his preference, and he replied that he hadn’t today. Gutowski said she had not been to the site. Mr. Pelletier said he had talked about a catch basin the last time, but feels this is a better solution. He said he had addressed some of the staff’s concerns. Metzler said he would prefer to wait to make a decision until Blessing was present due to his expertise, and informed the applicant that the application would be carried over until the next meeting. Gutowski asked Metzler to send Blessing some information.
3. File #W2002-13 – Application for a Wetlands Permit for activity within the Regulated Area for a Single Family Home at 61 Turnpike Road (Map 45, Lot 6). Richard Dezso applicant, Mary R. Drew owner. (Received on 02/11/02, No Decision before 02/25/02, Hearing or Decision by 04/08/02.)
Mr. Dezso said the application had to be continued from the last meeting because of the need for a site plan showing an alternate house plan. He said he had prepared something per Sue Yorgensen’s suggestion. He said the proposed site was chosen to minimize the noise from nearby I-84, and also because he wanted a walkout basement.
Gutowski asked if the septic was in the same area, and the applicant replied yes. Mr. Dezso said he still had to cross Wood Road, an abandoned road that is significantly lower than the surrounding property. Gutowski asked if he had shown a 100 ft. setback, and the applicant replied yes, he had showed the primary and reserve setback. Gutowski asked if the house site could be changed to be 5 ft. higher so that the impact would be lessened, and the applicant replied that that would impact his walk-out basement. He said that because the garage is a significant distance from the house, he would use the walk-out basement to store his lawnmower and other garden tools in. Gutowski noted that there may be problems with future plans for a garage since regulations don’t permit a garage in front of
a house. Jones noted that it would permissible if it was attached to the house. Gutowski reiterated her wish to have the house pushed back a little to minimize wetland encroachment. Metzler said he didn’t think it made much difference.

4. File #W2002-12 – Application for an activity within the Regulated Area for a driveway for a single family home located off Latham Road (Map 9, Lot 32, 7.93 acres). Michael Nogas owner/applicant. (Received on 02/11/02, No Decision before 02/25/02, Hearing or Decision by 04/08/02.)
Ed Pelletier represented Michael Nogas. Gutowski noted that all three commission members present had walked the property. She asked the width and length of the driveway, and Mr. Pelletier replied 12 ft. and 850 ft. He said is was fairly level. He said a gravel driveway was planned. He said the lot was flat and the groundwater is high. Gutowski asked Jones if pull-offs were required, and Jones answered yes, and that he has suggested several sites to the applicant. Metzler noted there was a previous application (July 14, 1997) submitted as an alternative to the proposal before us and that the Commission denied it. He said he wanted to defer the application to April 8 since Blessing was not present. Gutowski asked Jones to send Dirrigl a note to say the vote has
been deferred, and Jones replied that he would do so.

Metzler said he has received a report on Roger Schofield’s water company on Rt. 32. He said they have put in a tank but are not extracting water from the site. He said it will be close to base line. Metzler said we are looking at several areas based on changes in the vegetation. He said information goes back to 1999.
G. Approval of Minutes
Metzler requested the following change to the March 11, 2002 minutes: on page 4, the third paragraph should read as follows: “Mr. Pelletier offered an application in 1997 as an alternative to this one, and it was denied. He said the site is flagged.”

There was no quorum to vote on the February 25, 2002 minutes, so a vote was deferred until the next meeting.
H. Staff Report and Discussion
Jones said he had nothing to report except that he and Yorgensen had checked out the pool site, and that they have been very busy.
