K. METZLER CALLED A REGULARLY SCHEDULED MEETING OF THE INLAND WETLANDS AND WATERCOURSES COMMISSION TO ORDER MAY 14, 2001 AT 7:34 P.M. AT THE TOWN OFFICE BUILDING, 40 OLD FARMS ROAD, WILLINGTON.

NEW BUSINESS:

1.     File # W2001-35-Application for a dry hydrant located at 72 Eldredge Road (Map 13, Lot 59). Nicholas Marco, owner/Willington Hill Fire Department, applicant. (Received on 05/14/01, no decision before 05/28/01, hearing or decision by 07/09/01).

Jim Harvey of the Willington Hill Fire Department spoke on behalf of the applicants.

J. Harvey said they picked a location that is closest to the most houses. It is near Red Oak Hill, there will be an 18" trench off the road, and they will use a 4” plastic pipe.

The commission discussed the pond flow from the Marco property.

J. Harvey said Wes and Mr. Marco are deciding the final location. They will be staying away from the in-pipe. This will be a typical dry hydrant, about 3½ - 4 feet below grade so it will not freeze in the winter. It will give quick access to the water in case of a fire. The pond is about 12 feet deep, and it does lose some during the summer.

K. Metzler asked about the depth of the trench.

J. Harvey said it is about 4 feet, but they can go deeper. They will dig it out, put the pipe in, and then restore the surface.

G. BLESSING MOVED TO REMAND TO STAFF FOR DECISION (AND GIVE STAFF DISCRETION ON THE EXACT LOCATION) FILE #W2001-35-APPLICATION FOR A DRY HYDRANT LOCATED AT 72 ELDREDGE ROAD (MAP 13, LOT 59). S. Yorgensen said when the final location is determined (K. Metzler said the area should be staked); staff can then review it for approval.


2.     File #W2001-36-Application for a 2-lot subdivision located off of Potter School Road (Map 49, Lot 1A, 31.52 acres). Leo A. Passardi Jr. & Roberta S. Passardi owners/Jeffrey R. Passardi, applicant.

No one was present to speak on this file.

The commission reviewed the plans.

Chairman Metzler asked if the engineer or staff had done a review. S. Yorgensen said not yet.

G. Blessing said he did speak with the applicant, and the pond will be split between a brother and sister. The primary on Lot 1 is fairly close.

The commission reviewed the buffers.

S. Yorgensen said the driveway on Lot 1 is crossing the spillway. The driveway on Lot 2 is not crossing wetlands.

D. Schreiber asked how the water gets into the pond. It is not shown on the map.

G. Blessing said there is a little corner of the Fenton in the corner of the property.

The commission tabled further discussion until staff review has been done.


3.    File # W2001-29-Application for a wetlands permit for the construction of a single-family home including driveway, septic and grading within the regulated area located off Blair Road (Map 53, Lot 020-27). Richard Pisciotta, owner/applicant. (Received on 04/23/01, no decision before 05/07/01, hearing or decision by 06/26/01).

Russell Heintz spoke on behalf of the applicants.

R. Heintz said this is an existing lot that was approved in 1979. There are no wetlands on the lot. The septic was in the front and the house in the back. The wetlands were delineated after the lot was approved. He showed the wetlands as they are today and noted they have now built on lot 13 and a swale was constructed. The plan is for the septic in back and the house up front. Karl has asked to reduce the grading next to the house, which they will do. They will also comply with the requests of the Eastern Highlands Health District. A sitewalk was done tonight.

S. Yorgensen asked if the maps have been revised since Karl’s memo.

R. Heintz said No; he wanted to get input from everyone before making the revisions.

The commission reviewed the plans.

G. Blessing said there is no assurance of the vertical topography.

R. Heintz said this was done from the existing subdivision.

G. Blessing said there could be a little more leeway because it is a pump system.

R. Heintz said he has taken the existing contours on the plan, referenced the map and designed the house based on that. He noted they took no exception to any comments from Karl or the health district.

G. Blessing asked where the well was on Lot 15.

R. Heintz said these are not as-builts. They are putting the tank 25 feet from the rear of the house and doing a side-by-side layout as requested. He assumes a plan should be on file to determine the location of the well on Lot 15. Johnny Ianni is going to certify the soils.

G. BLESSING MOVED TO APPROVE FILE #W2001-29-APPLICATION FOR A WETLANDS PERMIT FOR THE CONSTRUCTION OF A SINGLE-FAMILY HOME INCLUDING DRIVEWAY, SEPTIC AND GRADING WITHIN THE REGULATED AREA LOCATED OFF BLAIR ROAD (MAP 53, LOT 020-27). RICHARD PISCIOTTA, OWNER/APPLICANT. (RECEIVED ON 04/23/01, NO DECISION BEFORE 05/07/01, HEARING OR DECISION BY 06/26/01), WITH THE FOLLOWING CONDITIONS:

1) the well on Lot 15 is to be located and put on the plan, and evaluated for compliance with health code requirements
2) the applicant shall comply with the requirements of the Eastern Highlands Health District to revise the pump and septic tank location
3) the applicant is to comply with Karl Acimovic’s revisions as requested in his 4/25/01 review
4) final plans must be stamped with soil scientist and PE certifications

Seconded by D. Schreiber.  Unanimously approved.


4.     File #W2001-30-Application for a wetlands permit for a single-family home with driveway within the regulated area located off Jared Sparks Road (Map 32, Lot 10). Steve Amedy, applicant/Basil & Sandra Bocynesky, owners. (Received on 04/23/01, no decision before 05/07/01, hearing or decision by 06/26/01).

K. Metzler noted the commission conducted a sitewalk on this property.

The commission reviewed the plans.

K. Metzler said the application is complicated since the driveway is not on the property.

G. Blessing said it means additional impact.

D. Schreiber said the driveway would need to be dug deep enough because there is no place to put the water. It must be surface level so the water will sheet flow. It can’t be dumped on the neighbor’s property.

Stephen Amedy said the driveway is set to town regulations for grade. Because they only have 25 feet, there are not a whole lot of options of what they can do. They are looking at about 1-2 feet of cut or fill. It does not look too severe. It looks like the cut will be on one side and fill on the other.

The commission reviewed the plans.

D. Schreiber said his major concern was the water flow over the whole length of the driveway. He described how it should run.

The commission discussed the current runoff.

G. Blessing said it was probably cut in before the subdivision and they tried to match the driveway.

K. Metzler said they missed.

G. Blessing asked who owned the other property.

The commission discussed the history of the property.

S. Amedy reviewed the acreage and said the deed says they need permission from Mike Hirsch to approve the plan. He read the deed restrictions and said a letter was sent to Harry Hirsch, Mike’s son, who is a lawyer. He assumes from the paperwork that this entire plan is OK.

J. Csiki asked when it was surveyed.

S. Yorgensen said Richard Meehok did it in 1987.

J. Csiki asked if Mr. Meehok set the pins.

S. Yorgensen said yes and reviewed the plans with the commission. There does not appear to be a lot of choice with the driveway.

K. Metzler said they could purchase more property to help solve it.

D. Schreiber said that may landlock the other parcel.

The commission reviewed the original subdivision plans.

D. Schreiber said it is a landlocked piece of property because there is a wetland in the way.

The commission noted discrepancies in the plan vs. the deed.

S. Amedy said the plan may have been done this way to preserve the access, which brings him back to square one with not a lot of options.

The commission discussed other possible accesses and options.

S. Amedy said this is a lot of record and the septic has been approved.

S. Yorgensen said she doesn’t know what else they can do there.

J. Csiki asked how they would control the runoff.

S. Amedy said it looks like the bulk will run off before it gets to the corners and will migrate down to the wetlands.

J. Csiki asked if it would be a gravel drive.

S. Yorgensen said it does not look like they plan on paving it.

G. Blessing said the existing grades were there before the driveway was constructed and what’s graded now may not be buildable in the field.

The commission discussed options.

K. Metzler said the right of way should be flagged on both sides.

G. Blessing said Karl should look at the slopes. They need the correct topography. It is important to have both sides staked.

S. Amedy suggested staking it, having Karl approve it and then remanding it to staff for approval. He does not think having the other side staked will make a difference.

J. Csiki said it would give a better idea of the amount of cut and fill. They should stake 25 feet and put a grade on it.

G. Blessing said he agreed the existing grade should be accurately depicted on the map.

S. Amedy said he was concerned about trespassing on the neighbor’s property to get all this done.

S. Yorgensen said at some point they will need an A2 anyway.

S. Amedy said the as-builts would be certified A2.

S. Yorgensen said the regulations require the A2 before the building permit is issued.

G. Blessing said they should get the other side of the driveway staked and also have Karl look at it.

K. Metzler said depending on the recommendations; it might then be remanded to staff.


5.     File # W2001-25-Application for a wetlands permit for a single-family dwelling, including driveway and septic within the regulated area located off Turnpike Road (Map 40, Lot 19E, 8.484 acres). Dorothy Wittenzellner, owner/Wayne D. McKee, applicant. (Received on 03/26/01, no decision before 04/09/01, hearing or decision by 05/14/01).

Steve Klimkoski of Filip Associates spoke on behalf of the applicant. He said they have been working with Karl to get the plan they now have. He reviewed the plans as revised per Karl’s requests.

The commission reviewed the drainage flow.

S. Klimkoski showed the 12-foot turnaround, which is increased in size. He reviewed the stockpiles and storage.

G. Blessing said this is the largest footprint possible there.

S. Klimkoski showed the emergency vehicle pull-off. There is also a proposed 8x20 shed in the back.

G. Blessing asked if it would be on concrete.

S. Klimkoski said it would be pylons or piers.

G. Blessing asked if it was wooden floor.

S. Klimkoski said yes. He asked if the commission had any concerns now in the event they decide to ask for a paving waiver.

G. Blessing said they would probably get more silt into the basin if it is unpaved, but it should not be a major concern. Gravel may cause more problems in the future as opposed to paving due to siltation.

G. BLESSING MOVED TO APPROVE FILE #W2001-25-APPLICATION FOR A WETLANDS PERMIT FOR A SINGLE-FAMILY DWELLING, INCLUDING DRIVEWAY AND SEPTIC WITHIN THE REGULATED AREA LOCATED OFF TURNPIKE ROAD (MAP 40, LOT 19E, 8.484 ACRES). DOROTHY WITTENZELLNER, OWNER/WAYNE D. MCKEE, APPLICANT. (RECEIVED ON 03/26/01, NO DECISION BEFORE 04/09/01, HEARING OR DECISION BY 05/14/01), WITH THE FOLLOWING CONDITION:

1) the lower eastern level spreader shall be connected via pipe to the lower western level spreader pursuant to Karl Acimovic’s comments dated 04/11/01

STAFF REPORT & DISCUSSION:

S. Yorgensen said a young man in town is doing a senior project regarding beaver ponds and the new method to remedy problems with dams. He wants to implement that plan on the pond on Old Farms Road. The consensus of the Commission was that it should be done.

The commission discussed concerns of an “agricultural project” that is including building a stump wall along the edge of a stream.
