Meeting Minutes
April 10, 2013
The meeting was called to order at 7:08 p.m. by Christina Mailhos at the Town Office Building, Selectman’s conference room.

Approval of Minutes: There were no corrections to the minutes of
March 13, 2013.
New Business: Mrs. Mailhos notified Commission members that Peter Thomsen resigned on March 13, 2013. Mr. Thomsen was a long-standing member of the Commission and he will be missed. There is now one vacancy of a regular member on the Commission.
The Commission reviewed and suggested changes for the following sections in the Town’s Transfer Station Ordinance:
Section 1, Definitions, subsection (c), strike the words “…said term to include any commercial hauler or operator of any commercial facility or other outlet of any kind of nature.” In subsection (d), correct typo and strike “MSW.” In subsection (f), spell out “MSW” and in subsection (g), strike “…referred to herein as (TSOMP).”
Section 2, Transfer Station Use, correct typo.
Section 3, Prohibited Refuse, spell out “TSOMP.”
Section 12, Fees and Section 13, Fees and Payment, will be combined and renamed Section 12, Fees and Payments. The current Section 12, Fees, will be deleted and replaced with: “The Board of Selectmen of the Town of Willington shall institute a permit system and fee schedule requiring all persons who dispose of refuse at the Transfer Station to obtain a permit for each motor vehicle utilized by any such person in the hauling or disposing of refuse at the Transfer Station.
All permits requiring the payment of fees shall be obtained at the Town of Willington’s Board of Selectmen’s office during the day time working hours. All commercial contractor permits must be obtained from the Building Official of the Town of Willington; while other permits requiring the payment of fees must be obtained from the First Selectman’s office. All permits which do not require the payment of fees shall be obtained at the Transfer Station.”
Section 14, Separation of Refuse, spell out “MSW” and “TSOMP.” Strike subsection (b).
Section 15, Hours of Operation, strike the word “may” in the first sentence. The last sentence will be reworded to, “The hours of operation and public access shall be posted at the Transfer Station and available through the Town of Willington’s office building”
Section 16, Scavenging Prohibited, the words “…with the exception of items in the Swap Shed” will be added.
Section 17, Trespassing, will remain as is.
Section 18, Item and Load Fees, will be reworded to, “The Board of Selectmen shall have the authority to set and change fees as it deems appropriate, but only after a duly warned public hearing is held thereon.”
Section 19, Civil Penalties, subsection (a), will be reworded to, “Any person who violates any provision of this ordinance or any provision of any regulation duly adopted by the Board of Selectmen pursuant to the authority granted by this ordinance shall pay a civil penalty designated by the Board of Selectmen to the Town of Willington for each such violation. Commercial haulers shall pay a civil penalty up to the maximum legal limits to the Town for each such violation. Each deposit or dumping of a load of refuse in violation of this ordinance or of any regulation adopted pursuant to this ordinance shall be considered a separate violation and shall be subject to a separate civil penalty for each violation. Each item specified in the item fees schedule that is deposited without payment of the
appropriate fee shall also be considered a separate violation. Non-payment of civil penalty is grounds for revocation of a permit.” All but the last sentence in subsection (b) will be deleted; “Environmental Protection” will be updated with current department name. In subsection (c), the first “Board of Selectmen” will be changed to “First Selectman.” In the first sentence of subsection (d), “The Board of Selectmen” will be changed to “First Selectman”; “his/her” will replace “its.” In the third sentence, “with the Board of Selectmen” will be added after “…written notice….”
Section 20, Invalidity, will remain as is.
Ms. Psathas said that she will check with Mrs. Hardie, Town Clerk, on the required wording for Section 21, Effective Date.
The next meeting date is Wednesday, May 8 at 7 p.m.
