REGULAR MEETING                                                                                                           SEPT. 17, 2007
TOWN OFFICE BUILDING                                                                                                  6:30 P. M.

First Selectman Eldredge called the meeting to order at 6:30 P.M. with the following in attendance:  Selectmen Patton & Lewis, L. Nicholls, R. Bozikowski, S. Levy and residents.  First Selectman Eldredge led the Pledge of Allegiance.

APPROVAL OF MINUTES
SELECTMAN LEWIS MOVED TO APPROVE THE MINUTES OF 9/4/07.  
Selectman Patton seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON& LEWIS)    0  NO

PRESENT TO SPEAK
Donna Hardie, Town Clerk, was present to request permission to retain her own attorney, rather than the Town Attorney to defend her in the lawsuit.  The Town Attorney recommends that the Board honor her request and the Town fund an attorney of her choice.  The Board agreed to this.
FIRST SELECTMAN ELDREDGE MOVED THAT WE AUTHORIZE THE EXPENDITURE OF FUNDS FOR THE ATTORNEY THE TOWN CLERK HIRES TO DEFEND HER AS TOWN CLERK.
Selectman Lewis seconded the motion.
Selectman Patton commented that attorney will defend you only and no one else.  Donna replied yes and First Selectman Eldredge commented that’s absolutely correct.  Selectman Patton commented so you will be the point of contact and there should not be any other officials discussing anything with him.  Donna replied yes.
VOTE:  2 YES (ELDREDGE & LEWIS)    0  NO
Selectman Patton recused himself.

Robert Bozikowski and Steven Levy of Atlantic States Rural Water & Wastewater Assoc. were present to discuss the Hall School water main.  A review of where we are with the water main followed.  We have a STEAP grant to extend the main to the school, we have the design approval from Public Health and permits for the construction bid have been approved by Public Health and DEP.  The advertisement for bids is in the papers today.  The Town will hire the contractor to install the water main and Lenard Engineering will inspect.  It will be installed to Dept. of Public Health requirements and we will turn over the pipe to CT Water (formerly Birmingham Utilities) to run, maintain and operate.  Selectman Patton asked is that in the grant as a State requirement?  First Selectman Eldredge commented yes. Mr. Levy commented they would research the terms of the grant.  Further discussion followed regarding a public water system, resale of water, licensed operator and whether the Town wants to be in the water business.  Discussion also followed on the cost of the pipe and who should pay for it and other people tapping into the main (the State allows this).  First Selectman Eldredge commented if the State mandates sprinklers in all schools we will be set up for it.  Selectman Patton asked

would the Fire Dept. be able to tap off the fire hydrants?  Chief Millix replied yes. First Selectman Eldredge asked Mr. Levy what do you think of the Senior Housing water system?  Mr. Levy commented we would love to help you if you decide to run it somewhere else.  First Selectman Eldredge commented it is designed to bring public water to the Town Office Building, the Fire Dept. and Center School.  Mr. Bozikowski commented we do a lot of training.  Further discussion followed about Village Springs.

CORRESPONDENCE
A list of correspondence was available at the meeting and in the Selectman’s office.  

PUBLIC WORKS
Lynn commented chip sealing started today, we are doing items on the GASB list.  Tinkerville Road is open to traffic, Lynn is happy with the project.  Selectman Patton commented someone stole a piece of riprap.  Lynn commented we used 700 tons of asphalt in the past weeks.  First Selectman Eldredge asked did we get a confirmation from New England Asphalt that they relinquish the award?  Lynn replied yes.  Lynn reported a truck is at Rose’s for repair, the estimate is $20,000.  The body is older than the truck.  Discussion followed on what is wrong with the truck and maintenance of it.  Pat Cassells had questions about the catch basin in her driveway.  Lynn and Karl will look into this.  
FIRST SELECTMAN ELDREDGE MOVED TO WITHDRAW THE 7/26/07 CHIP SEAL AWARD TO NEW ENGLAND ASPHALT.
Selectman Lewis seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

FIRST SELECTMAN ELDREDGE MOVED TO AWARD THE CHIP SEAL BID TO THE GORMAN GROUP, LLC FOR $1.68 PER GAL. FOR ASPHALT EMULSIONS CRS-2; FOR $.10 PER GAL. FOR CHIPPER SPREADER AND FOR $.10 PER GAL. FOR RUBBER TIRED ROLLER, AS PER THEIR BID.
Selectman Lewis seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

LATHAM ROAD DRAINAGE BIDS  
Four bid packages were picked up.  Two bids were received.
Knights Construction - $11,444.00 and Putnam Welding - $11,980.00.
FIRST SELECTMAN ELDREDGE MOVED TO AWARD THE LATHAM ROAD DRAINAGE CONTRACT TO KNIGHTS CONSTRUCTION CONTINGENT UPON THE FACT THAT THEY COMMENCE THE PROJECT ON OCTOBER 1, 2007 AND COMPLETE BY OCTOBER 31, 2007.
Selectman Patton seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

TAX REFUNDS
FIRST SELECTMAN ELDREDGE MOVED TO APPROVE A TAX REFUND OF $23.30 TO SCOTT BROWN.
Selectman Lewis seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

Selectman Lewis seconded the motion.

FIRST SELECTMAN ELDREDGE MOVED TO APPROVE A TAX REFUND OF $143.01 TO MICHAEL HOLEWA.
Selectman Lewis seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

FIRST SELECTMAN ELDREDGE MOVED TO APPROVE A TAX REFUND OF $17.23 TO RICHARD WILSON.

GOOD & WELFARE  
Selectman Lewis commented we need an alternate on the Safety Committee for Fire Dept. #1.  Stuart Cobb commented he would look into this.  Bob Wiecenski asked if a POW/MIA flag could be flown at the Library and the Town Office Building.  The Board agreed and they will be ordered.  Selectman Lewis commented he wanted to thank Tyler Millix and Mark Morrison, Fire Dept. #1 for their rescue of a cat that had been stuck in a tree for a few days.
