BOARD OF SELECTMEN
SPECIAL MEETING                                                                                                                    APR. 9, 2007
TOWN OFFICE BUILDING                                                                                                              5:30 P.M.

First Selectman Eldredge called the meeting to order at 5:30 P.M. with the following in attendance:  Selectmen Patton and Lewis and Town Attorney D. Forsyth.

FIRST SELECTMAN ELDREDGE MOVED TO GO INTO EXECUTIVE SESSION, AT 5:33 P.M. TO DISCUSS LEGAL MATTERS AND INVITED ATTORNEY FORSYTH
Selectman Patton seconded the motion.
Selectman Patton commented Mike are you going to recuse yourself?  First Selectman Eldredge replied no, I am not recusing myself.  Selectman Patton commented we are discussion an unfair labor practice of which your son-in-law is a part of and you don’t feel the need to recuse yourself?  First Selectman Eldredge commented no, we are talking about several things, if it becomes appropriate for me to recuse myself I will, I will leave the meeting.  Selectman Patton commented I had 2 items; one was some grievances, which involve your son-in-law and unfair labor practices, which involve your son-in-law so, which other things are we discussing?  Attorney Forsyth commented I don’t know if the second one involves his son-in-law or not.  It was brought by the union as opposed to individuals.  Selectman Patton commented which is Public Works, lets get realistic.  First Selectman Eldredge commented I think there are other things we are going to discuss too.  Attorney Forsyth commented there may be; if I think it is inappropriate for the conversation to include Mike at any time, at least with regard to the labor practices I will certainly say so.  I agree with you with regard to the grievances that were filed by Jeff that it would not be appropriate for Mike to take part in the discussion.  With regard to the unfair labor practice at least I can advise you of the conversation I had with the representative with regard to that and then at any point in time that we think he should leave we will go from there.  First Selectman Eldredge commented and I will go by what Attorney Forsyth advises me.  Selectman Patton commented I am telling you from my conversation with him asking about that letter from the State Labor Dept. I asked him what it was about and he explained it to me; I don’t know how it can’t.  Attorney Forsyth commented I don’t know if it can or it can’t all I can tell you is what was reported to me by the representative.  Selectman Patton commented I’m perplexed, what was reported to you.  Attorney Forsyth commented why don’t we talk about that in executive session.  Selectman Patton commented I will go in there and you can explain it to me, you have to do an awful good job of convincing me because I am getting a little tired of the let me inject myself where I shouldn’t from our First Selectman.  First Selectman Eldredge commented we will go into that and I will take Attorney Forsyth’s advice if I should leave.  Selectman Patton commented I will be as opened minded as I can and if I think we shouldn’t be there you can stay and talk and I’ll leave because I am not going to be a part of that.    
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

SELECTMAN PATTON MOVED TO COME OUT OF EXECUTIVE SESSION AT 7:12 P.M.
Selectman Lewis seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

SELECTMAN PATTON MOVED TO ADJOURN THE MEETING AT 7:13 P.M.
Selectman Lewis seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO
