SPECIAL MEETING                                                                                                                    JAN 25, 2007
TOWN OFFICE BUILDING                                                                                                              5:30 P.M.

First Selectman Eldredge called the meeting to order at 5:30 P.M. with the following in attendance:  Selectmen Patton and Lewis, L. Nicholls and residents.

PUBLIC WORKS
The Board signed bills.  The drain spout on the side of the building is draining water to close to the well and new gutters have to direct the water 25’ from the well.  Discussion on this followed.  This will be taken care of.  Lynn commented you all should have gotten an e-mail from Val that we only have to report our stuff at the Transfer Station to the state.  Discussion on this followed.  Lynn reported that she has 3 quotes for the chemical shed at Public Works:  Dawg - $14,937, International Building System - $16,196 and U.S. Chemical - $16,264.  First Selectman Eldredge asked is this under the reserve fund in CIP?  This will be checked.  Lynn commented she met with a CL&P representative to discuss the spraying they are having done.  He is going to get her the name of what they use, it is approved by DEP.  Lynn commented she is talking to PZC and SWAC regarding light bulb recycling and a container for it.  SWAC is looking into light bulb recycling companies.  Karl must do a modification to the site plan.  Selectman Patton asked how are the compactors coming?  Lynn commented DeVivo call her about this, he is working on getting prices together for a compactor, installation and running it off the other one we have.  Selectman Patton asked should we have Karl draw that on the modified site plan?  Lynn commented she already asked him.  Selectman Patton asked who will take the old shed away?  Lynn commented she does not know yet.  First Selectman Eldredge asked is the fiberglass tank there?  Lynn replied yes.  First Selectman Eldredge commented you will need it for a holding tank.  Selectman Patton asked how big is it?  Lynn commented 500 gallons; Karl thought it was already in the ground.

EXECUTIVE SESSION – PERSONNEL ISSUES
FIRST SELECTMAN ELDREDGE MOVED TO GO INTO EXECUTIVE SESSION FOR PERSONNEL ISSUES AND INVITE LYNN NICHOLLS AT 6:03 P.M.
Selectman Patton seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

SELECTMAN LEWIS MOVED TO COME OUT OF EXECUTIVE SESSION AT 6:06 P.M.
First Selectman Eldredge seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO

SELECTMAN LEWIS MOVED THAT WE REMOVE THE GARBAGE THAT IS IN LYNN NICHOLLS’ FILE EXCEPT FOR THE LAST LETTER.

Selectman Patton commented to First Selectman Eldredge we agreed to remove the one letter and you did not.  First Selectman Eldredge commented that’s right.  Selectman Lewis commented the attorney was there, he agreed and you agreed.  Selectman Patton commented 6 months after the date you were going to remove it.  First Selectman Eldredge commented if nothing further happened.  Selectman Patton commented what you are telling me is the reason you didn’t do it is because she exercised her statutory rights before CHRO.  First Selectman Eldredge commented yes, she re-filed but that is the one letter we are talking about.  Selectman Patton commented you know what that is called – abusive use of authority.  First Selectman Eldredge commented no it is not.  Selectman Lewis asked how public do we want to go?  Newspapers?  First Selectman Eldredge commented feel free, whatever you guys do; but that is the one letter we are talking about.  Is that

correct?  Selectman Patton commented that’s what we agreed to.  First Selectman Eldredge commented so that’s the motion you are making – to remove that letter.  Lynn commented there should be nothing in my file.  Selectman Lewis asked what are the rules about anything in her file?  Isn’t she supposed to me notified of it?  Selectman Patton commented things go into a file, you usually say I am putting this in your file acknowledge that you see it; you don’t have to agree that this happened.  Selectman Lewis commented that’s why I am saying stuff should come out of there because it wasn’t put in there properly.  First Selectman Eldredge commented she has seen everything that went in her file and you guys have too.  Selectman Patton commented we did a while ago, Lynn gave permission for us to get copies.  Selectman Patton commented the one thing we agree to, there are 2 separate issues, was that the letter of reprimand was going to come out 6 months after the incident.  Selectman Lewis commented right but it didn’t.  First Selectman Eldredge asked and now will you amend the motion?
SELECTMAN LEWIS MOVED THAT THE LETTER OF REPRIMAND FOR AN INCIDENT IN THE FALL OF 2005 BE REMOVED FROM LYNN NICHOLLS’ PERSONNEL FILE.
Selectman Patton seconded the motion.
VOTE:  2 YES (PATTON & LEWIS)    1 NO (ELDREDGE
Lynn asked how do I get the rest of the stuff out of my file?  First Selectman Eldredge commented it stays in.  Selectman Lewis commented it needs to have gone in properly.  First Selectman Eldredge commented you people have all seen it and so has she.  You are welcome to take a look at it again.  Selectman Lewis commented I honestly believe she should put a harassment suit against you.  First Selectman Eldredge commented we already spent $8,000 on that.  

SELECTMAN PATTON MOVED TO ADJOURN THE MEETING AT 6:12 P.M.
Selectman Lewis seconded the motion.
VOTE:  3 YES (ELDREDGE, PATTON & LEWIS)    0  NO
