REGULAR MEETING                                                                                                           FEB. 7, 2005
TOWN OFFICE BUILDING                                                                                                  6:30 P. M.

First Selectman Eldredge called the meeting to order at 6:30 P.M. with the following in attendance:  Selectmen Blessington & Patton, L. Nicholls, S. & J. Lewis, T. Millix, R. Shabot and K. Wintzel, reporter from the Chronicle. First Selectman Eldredge led the Pledge of Allegiance.

APPROVAL OF MINUTES
SELECTMAN BLESSINGTON MOVED TO APPROVE THE MINUTES OF 1/18/05.
Selectman Patton seconded the motion.
VOTE:  3 YES (ELDREDGE, BLESSINGTON & PATTON)    0  NO

PRESENT TO SPEAK – No one.

CORRESPONDENCE
A list of correspondence was available at the meeting and in the Selectman’s office.

PUBLIC WORKS
Lynn Nicholls commented that besides working on snowstorms, they are doing repairs to vehicles, working on ice jams and patching potholes.  Finally the weekend of Jan. 29th we had our first weekend off in 9 weeks.  They were out this Sat. because of the black ice.  First Selectman Eldredge asked if the potholes on Turnpike Road were taken care of.  Lynn commented that they had fixed them before the last storm and did them again today.  There are potholes and catch basins to take care of, they are getting the sweeper ready and they are getting ready for the next snowstorm.

ROUTE 32 STATE LAND
First Selectman Eldredge commented that the State has responded to our letter asking if any environmental problems exist on the 13.50 acres on Route 32 across from the Knights.  They have no knowledge of any contamination and are willing to convey the property to the Town, in as-is condition for public purposes at no cost.  If the Town wants we can do our own environmental assessment of the property.  Selectman Patton asked what would we do with it?  First Selectman Eldredge commented that the Conservation Commission might want it.  Selectman Patton commented that he would rather see the State sell it and put something on it.  First Selectman Eldredge commented that we could let the Conservation Commission look at it and see what their feelings are.  Selectman Patton commented that if we do have a plan for it, he has no problem, if we don’t have a plan he would rather see the State sell it and something be built on it.  First Selectman Eldredge commented that if the State gives it to us it must be conserved.  Selectman Patton commented that for public purposes could be a municipal building, a school, a firehouse, a library, etc.

Selectman Blessington commented that the land could be polluted and the Town could catch the bill for the clean up.  Selectman Patton commented that it could be costly; phase I of an environmental assessment would say it is contaminated, and then we would want to do phase II.  First Selectman Eldredge commented that if the Conservation Commission decides they want it we would have to get a legal document that we are not responsible for contamination.  Selectman Patton commented give it to the Conservation Commission but there should be some good justification to take it.  We should not just own land for the sake of owning land.

SELECTMAN BLESSINGTON MOVED TO ADD CONSERVATION COMMISSION TO APPOINTMENTS.
First Selectman Eldredge seconded the motion.

SELECTMAN PATTON MOVED TO ADD EXECUTIVE SESSION TO DISCUSS PERSONNEL ISSUES AS ITEM C.
Selectman Blessington seconded the motion.
VOTE:  2 YES (BLESSINGTON & PATTON)  1 NO (ELDREDGE)
APPOINTMENTS
FIRST SELECTMAN ELDREDGE MOVED TO APPOINT CHRISTOPHER DESKUS AS AN ALTERNATE MEMBER OF THE ZONING BOARD OF APPEALS, TERM IMMEDIATE TO 12/31/05 AND TO APPOINT JOHN PRUSAK AS A REGULAR MEMBER OF THE ZONING BOARD OF APPEALS, TERM IMMEDIATE TO 12/31/05.
Selectman Patton seconded the motion.
VOTE:  3 YES (ELDREDGE, BLESSINGTON & PATTON)    0  NO

FIRST SELECTMAN ELDREDGE MOVED TO APPOINT FRANCIS RAIOLA AS DEPUTY FIRE MARSHAL, EFFECTIVE IMMEDIATELY.
Selectman Blessington seconded the motion.
VOTE:  3 YES (ELDREDGE, BLESSINGTON & PATTON)    0  NO

FIRST SELECTMAN ELDREDGE MOVED TO APPOINT ROBERT SHABOT AS AN ALTERNATE MEMBER OF THE CONSERVATION COMMISSION, EFFECTIVE IMMEDIATELY TO 12/1/06.
Selectman Patton seconded the motion.
VOTE:  3 YES (ELDREDGE, BLESSINGTON & PATTON)    0  NO

TAX REFUNDS
FIRST SELECTMAN ELDREDGE MOVED TO REFUND $41.37 TO JEROME OR MARGARET MAAS.
Selectman Blessington seconded the motion.
VOTE:  3 YES (ELDREDGE, BLESSINGTON & PATTON)    0  NO

FIRST SELECTMAN ELDREDGE MOVED TO GO INTO EXECUTIVE SESSION TO DISCUSS PERSONNEL ISSUES AT 6:50 PM.
