BOARD OF SELECTMEN



REGULAR MEETING                                                                                                           NOV. 18, 2002
TOWN OFFICE BUILDING                                                                                                  6:30 P. M.

First Selectman Patton called the meeting to order at 6:30 P.M. with the following in attendance:  Selectmen Eldredge & Lewis, D. Bilodeau, R. Hisey, L. Karpuska, K. & J. Kowalyshyn and P. Latincsics.  First Selectman Patton led the Pledge of Allegiance.

APPROVAL OF MINUTES
SELECTMAN LEWIS MOVED TO APPROVE THE MINUTES OF 11/4/02.
Selectman Eldredge seconded the motion.
VOTE:  3 YES (PATTON, ELDREDGE & LEWIS)    0  NO

PRESENT TO SPEAK
Lowell Karpuska, Fire Dept. #1, asked if the letter requesting the Fire Departments to attend quarterly meetings had been drafted or sent yet.  First Selectman Patton commented that it has been drafted.

Kim Kowalyshyn was present to discuss the vote on the Solid Waste Advisory Commission and wanted to know what this commission is.  First Selectman Patton commented that they monitor the Transfer Station, make recommendations to the Board of Selectmen regarding operations, they plan communications, investigate and implement new ways and items, they are in charge of the hours, and bidding.  Ms. Kowalyshyn asked Selectman Eldredge if it wasn’t a conflict of interest for him to vote on appointments to this Commission.  Selectman Eldredge commented that he is not part of the Commission and does not vote on it but you have a point, technically I should have refrained from voting on the appointments.  Selectman Eldredge apologized.
First Selectman Patton commented that he should have noticed it also.  Selectman Lewis asked if they should redo that vote.  First Selectman Patton said yes and told Ms. Kowalyshyn that sometimes we get very comfortable here.

Darlene Bilodeau was present to discuss the status of Mirtl Road.  The unimproved end of that road has been closed to vehicle traffic because the residents asked for that due to the rowdy use of vehicles day and night.  Mrs. Bilodeau asked if a closed road was the same as abandoned?  Someone has put sticks that point out between the rocks; they are dangerous and could hurt someone.  It used to be pass at your own risk, they have horses and motorcycles and did use that area now they cannot, and you can only walk there.  First Selectman Patton commented that the road is closed to vehicle traffic, that is not the same as abandoned.  Mrs. Bilodeau asked if they have the right to access that part legally? Is it still pass at your own risk?  They would like to see the rocks moved.  First Selectman Patton commented that it is closed to vehicle traffic, you can walk there and if you can get a horse there that is okay.  Mrs. Bilodeau commented that you can’t through there with a horse.

She understands the problem but is not sure that this is the right solution, isn’t it the responsibility of the State Police.  Mrs. Bilodeau commented that there are motorcycles all over town, why are we closing this one?
Selectman Lewis commented that there is dangerous ledge there.  First Selectman Patton commented that it is not safe and we had the right to close the road.  First Selectman Patton commented that he would look at the sticks.  We put a sign there that it is closed and the rocks but not the sticks.  Mrs. Bilodeau asked if Public Works could remove the sticks or could they remove them?  First Selectman Patton commented that we did not put the sticks there he doesn’t mind if someone removes them.  Selectman Eldredge commented that we do not want to block horses or walkers.

Robert Hisey was present to discuss the article in the Chronicle regarding the Zoning Board of Appeals refusal to grant a permit to a new tenant at the Mill when Mr. Buccino would not allow the ZBA in for a second inspection.  Peter Latincsics was present for the same reason.  Selectman Lewis commented that this is an improper discussion for the Board; it is not Board of Selectmen business.  Mr. Latincsics commented that he wanted to know if remarks made by John Patton were by the First Selectman or a private person.  First Selectman Patton commented to Mr. Latincsics that you mischaracterize anything I say, you can make what you want with my silence.

CORRESPONDENCE
A list of correspondence was available at the meeting and in the Selectman’s office.

VILLAGE HILL ROAD BRIDGE
First Selectman Patton commented that they poured the slab on one approach.  Selectman Lewis asked if they will pave the dirt part?.  First Selectman Patton commented that he wants something on that before winter.  If the winter cooperates and the plants stay open they can finish the approaches.  If things go well we can hopefully open before the new year.  There is a job meeting tomorrow with the contractor and engineers.  Selectman Eldredge asked if the deck was poured?  First Selectman Patton replied yes and the sidewalk curb will be done tomorrow, they finished the 3-sided culvert.  When they finish the approaches they need to cut the grade from Route 32.  There have not been many change orders.

FIRST SELECTMAN PATTON MOVED TO RE-APPOINT THE FOLLOWING TO THE SOLID WASTE ADVISORY COMMISSION:  MICHAEL PINATTI & EDWARD TAIMEN AS REGULAR MEMBERS, TERM EFFECTIVE NOVEMBER 7, 2002 TO NOVEMBER 7, 2004 AND PETER THOMSEN AS AN ALTERNATE MEMBER, TERM EFFECTIVE NOVEMBER 7, 2002 TO NOVEMBER 7, 2004.
Selectman Lewis seconded the motion.
VOTE:  2 YES (PATTON & LEWIS) 1 ABSTAIN (ELDREDGE)    0  NO

FIRST SELECTMAN PATTON MOVED TO APPOINT JOHN R. LEWIS TO THE EASTERN CONNECTICUT HEALTH NETWORK AS THE TOWN OF WILLINGTON’S REPRESENTATIVE, EFFECTIVE IMMEDIATELY.
Selectman Eldredge seconded the motion.
VOTE:  3 YES (PATTON, ELDREDGE & LEWIS)    0  NO

FIRST SELECTMAN PATTON MOVED TO RE-APPOINT GEORGIANA BOOTH AS THE TOWN OF WILLINGTON’S AGENT ON AGING, EFFECTIVE 12/7/02 TO 12/7/04.
Selectman Lewis seconded the motion.

FIRST SELECTMAN PATTON MOVED TO RE-APPOINT ROBERT MANASKIE AS A REGULAR MEMBER OF THE ZONING BOARD OF APPEALS, EFFECTIVE 12/31/02 TO 12/31/07.
Selectman Eldredge seconded the motion.
VOTE:  3 YES (PATTON, ELDREDGE & LEWIS)    0  NO

PUBLIC WORKS
First Selectman Patton commented that they went out early this morning.  We escaped the worst of the storm.  Selectman Lewis commented that radar has not been up on Schofield Road and more people are traveling on Schofield due to the work on Village Hill Road.  There is heavy traffic and they are really flying.  First Selectman Patton commented that he would call the State Police.  First Selectman Patton reported that the Solid Waste Advisory Commission talked about putting in a waste oil furnace at Public Works.  He will ask the Finance Dept. for fuel costs from there.  He thinks it will be $9,000/10,000 to do.  It works well.  Selectman Lewis asked if we have enough waste oil to do this and was told yes.  Selectman Eldredge commented that we have been collecting it for 7 years without having anything rejected.  First Selectman Patton commented that we need to set it up and put in a reserve tank, he will check the payback to see if it is worth it.  First Selectman Patton commented that Tobacco Valley wants to know what we are doing for the Transfer Station for Christmas and New Year.  We could have it done on Thursday.  Selectman Eldredge commented that he would think about it.  Selectman Eldredge commented that reading the Planning & Zoning minutes, he saw there are new lots on Eldredge Mills Road.  Will we have to do something for that?  The Transfer Station deed seems to indicate that the road was abandoned.  First Selectman Patton commented that it may be, we just found a list.  Without doing a title search he does not know.  Selectman Eldredge commented that if it is abandoned from the tar part on, than we are not responsible for improving.  First Selectman Patton commented that you cannot leave a property land locked, you can have a right of way to road.

TAX REFUNDS
FIRST SELECTMAN PATTON MOVED TO APPROVE A TAX REFUND OF $10.08 TO MICHAEL MITCHELL.
Selectman Lewis seconded the motion.

GOOD & WELFARE
First Selectman Patton commented that he received a request to set up a Neighborhood Watch Program on Daleville School Road.  He talked to the State Police and they are excited about it.  They are sending someone to set up a meeting and start it up.  It is a good idea and maybe other watches will start up.

Selectman Lewis commented that it makes people aware.  First Selectman Patton commented that it makes an area a neighborhood.  First Selectman Patton commented that Chris Demers said if we pre-paid the Reminder for 8 articles we could save $100 per article.  The Board agreed to do that.  First Selectman Patton commented that there were a couple of deaths in Town, Harold Weigold and May Usher.  First Selectman Patton reported that he talked to the First Selectmen of Ashford and Stafford about the casinos, they signed the amicus brief and passed a resolution and that is all they are doing.  They do not think it a good idea, but they are not doing anything else.  Selectman Lewis commented that we should get it on our agenda.  Lowell Karpuska commented that it can bring revenue but also crime and undesirables.  Selectman Lewis commented that we need to do something about the sound for the Town Hall.
