Public Hearing

Chairman Marco called the hearing to order at 7:30.

PZC2015-46 Application for a one lot subdivision to build single family dwelling at 65 Kucko Road (Map 42 Lot 40 Zone R80) Owner/Applicant: Vilma Kucko c/o Linda Wagner-daughter (Received November 17, 2015 Public Hearing on January 19, 2106 decision within 65 days after close of P.H.)

The applicants were present and submitted new plans with the revisions recommended by the Commissions engineer.  The commission looked at the plans.

Ralph Tulis said he fully supports one of the heirs building a house.  He said it is a residential area and he does not see any harm.  

Jeff Benoit, an abutting neighbor, asked to look at the plans in reference to the septic system distances.

No further questions from the commission or the public.

E. Standish motioned to close the public hearing.  D. Roberts seconded the motion.  All in favor.  Motion carried.  

PZC2015-49 Application for a Special Permit for Antique Storage and Distribution Center
at 672 River Road (Map 47 Lot 1 Zone DI) Owner: Round Road LLC Applicant: Ann & John Zevetchin (Received November 17, 2015 Public Hearing on January 19, 2016 decision within 65 days after close of P.H.)

The applicants were present.  Mr. Zevetchin said they have been in Tolland for 20 years and they are now looking to purchase a larger facility as they need more storage.  He said the facility will be for storage and distribution.  He said they will only be open on Saturday for pick up and retail.  Mr. Zevetchin said they will clean up the property but structurally, there will be no changes.  

S. Yorgensen questioned the retail portion and a discussion was held.  A. Marco said, in a Designed Industrial Zone, retail to the general public is not a permitted use.  A discussion was held on keeping the public hearing open and retail sales.  

Kim Kowalyshyn of the EDC said they have been talking to John and he would be a welcome addition.  

P. Nevers asked if they would have outside trailers and the applicant said no, there would be no outside storage, which is why they need a larger facility.  

E. Standish motioned to close the public hearing.  W. Parsell seconded the motion.  All in favor.  Motion carried.

PZC2015-47 Application for a Special Permit to construct a 100’X80’ indoor horse riding arena at 1 Potter School Road (Map 49 Lot 002-0A Zone R80) Owner/Applicant: Earl & Michelle Bancroft (Received November 17, 2015 Public Hearing on January 19, 2016 decision within 65 days after close of P.H.)

The applicants were present.  Mr. Bancroft said the application includes a site plan and he submitted a second site plan with an alternate location, attaching the proposed building to the existing plan which results in a slightly smaller footprint.

Chairman Marco read a letter from Mr. and Mrs. Debski; they are not in favor of the application as they feel it would negatively affect the appearance of the neighborhood and the value of their home.   

A discussion was held on the number of horses.  Mr. Bancroft said they currently have 4 horses but they are not all on the property at one time.  He said, if the commission grandfathers him in, he would like them to grandfather him at 5 horses.  

W. Parsell asked the reason for the 2 proposals and Mr. Bancroft said their neighbors were looking at the size of the building and they are looking to minimize and achieve their goal.  He said by going to the second proposal, it allows them to retain the original size of the barn, add some storage and stalls and shrink the roof cover. P. Nevers asked if they were getting rid of the outdoor riding rink and Mr. Bancroft said he had a discussion with Mr. Tanguay about the riding rink and it is close to their property line; as a neighborly gesture, he agreed to take the riding rink down.  D. Roberts asked if the height of the 6000 structure would be lower than the height of the 8000 structure.  Mr. Bancroft said the height would remain the same and a discussion was held.

Janet Tanguay, of 7 Potter School Road, said her husband spoke to Earl about taking down the existing riding rink if the barn is built and he was very accommodating and said that he would.

Noah Passardi said he supports the plan.  

Dorota Debski, of 12 Fenton Road, said the building is big and an eyesore and will decrease the value of the residential properties in the area.

Richard Passardi, of 76 Potter School Road, said he has no objections.

E. Standish said there are concerns about rural character and a discussion was held.  A discussion was held on the type of architecture in this rural area and keeping the public hearing open.  

Discussion was held on possibly taking the building down if the property was sold.  A. Marco said, if they sold the property for the same use, they wouldn’t have to change anything.  Mr. Bancroft said the “what if” kept coming up previously and he stated that he would be happy to take the building down when he was done with it.  He said, in the instance of the second plan, he would like to clarify he would only be happy taking down the addition they are proposing to the existing barn to allow the connection of the 2 structures and not the original structure.

Sue Manaski said it seems to her there are concerns on elevation and discussion was held.  

Ralph Tulis said submitting final details after the public hearing works for some applications but he does not believe in this case as there are concerns on the impact to the neighborhood.  E. Standish said his concerns are on the character of the building and fitting in with the surrounding area.  Mr. Bancroft said it will be a country farm barn structure and will be a Morton Building with a wood framed structure.  He submitted various pictures of Morton Buildings for the application. He said his proposed building would be similar to those designs.   

A discussion was held on a site walk.  Mrs. Debski asked the commission to take a tour of the neighborhood and get a visual.  A. Marco said they have been advised by their attorney not to do a site walk after the public hearing has been opened.  

The commission looked at the plans.  A. Marco said Plan A is 8,000 square feet and Plan B is 6,000 square feet.

E. Standish clarified that they received dimensions that the outside wall will be 14 feet high and the eve will be 26 feet high; a little under 1 ½ stories.

E. Standish motioned to close the public hearing.  P. Nevers seconded the motion.  All in favor.  Motion carried.  

Regular Meeting

A. Marco called the regular meeting to order at 8:48. Seated as above.

PZC2015-51 Application for Amend Special Permit & approved Site Plan for landscaping only at 327 Ruby Road (Map 42 Lot 45 Zone DC) Owner/Applicant: Royce Properties, LLC c/o George Giguere(Received January 6, 2016 Public Hearing by March 1, 2016 decision within 65 days after close of P.H.)

A discussion was held on a site walk and public hearing. E. Standish said they should consider a litter control plan.  The commission would like the public hearing set for March 1st and a site walk prior.  They would also like the area to be flagged around 84 at the top of the slopes and both sides of the signs.

Old Business

PZC2015-52 ~Application for Special Permit for Retail store selling clothing, jewelry, furniture, home accessories, consignment, and soap at 11 Phelps Way (Map 30 Lot 14 Zone DC) Owner C & S Willington CT Partnership LLC Applicant: Jane F. Copeland (Received January 19, 2016 Public Hearing by March 15, 2016 Decision within 65 days after close of P.H.)

The public hearing has been set for February 2nd.

S. Yorgensen said IWWC and PZC have looked at the application and it meets the regulations.

W. Parsell motioned to approve PZC2015-46.  E. Standish seconded the motion.  All in favor.  Motion carried.

E. Standish said he would like a motion drafted.  A. Marco suggested adding landscaping, possibly a row of pines.  A discussion was held on the neighbors’ concerns.  A discussion was held on the proposed barns.  A. Marco, W. Parsell and E. Standish said they preferred Plan B.  A. Marco said he would like a wood framed structure, not a steel frame.  The application was tabled to February 2nd.

A discussion was held on retail sales.  The commission would like a motion drafted. Application was tabled to February 2nd.

P. Nevers motioned to approve the minutes of November 17, 2015.  D. Roberts seconded the motion.  All in favor.  Motion carried.

  • 2015-2016 Budget Detail
Staff Report

A discussion regarding budgeting for the assistant position. The consensus of the Commission was that they would like the position included in the budget.

A discussion was held on building code and awnings.  A. Marco said he would like to include the addition of the awning now required with the new building code when they do the motion and approval.   

A. Marco motioned to remand to S. Yorgensen the authority to make the minor deviation from the original approval for the House of Worship on Cisar Road.  W. Parsell seconded the motion.  All in favor.  Motion carried.

S. Yorgensen reported that she may have found someone to draft the sign regulations. She said she also has heard from Loves and they are hopeful they can start construction in the spring.  She added that there is a microbrewery looking at the gun shop.  

A discussion was held on tiny houses.  A. Marco asked if other places in Connecticut allow it.

A. Marco asked to have the PoCD on the upcoming agenda.
