Regular Meeting

Chairman Marco called the Public Hearing to order at 7:35.

Review a request for renewal of Home Occupation/Special Permit original approved on August 3, 1993 to be renew on September 1, 2014 115 Eldredge Road (Map 7 Lot 1 Zone R800 Owner/Applicant: Alfred Sadow

Chairman Marco recused himself as the applicant is a relative. S. Yorgensen said they received a complaint regarding the home occupation and snow being trucked in and dumped on the site.  Mr. Sadow was present and said he was not aware that this was not allowed.  He said he has no prior violations and submitted a letter stating he will no longer do this.

A discussion was held on the Special Permit.  Ralph Tulis questioned whether the occupation was home or commercial as it has grown and asked the Commission to carefully consider the renewal.

E. Standish motioned to approve the renewal.  J. Sullivan seconded the motion. D. Roberts and A. Marco abstained.  All others in favor.   

PZC2014-24 Application for a Special Permit for Beading Studio including classes and occasional retail (room in barn) at 34 Old Farms Road (Map 22 Lot 51 Zone R80) Owner: Makuch & Co James Makuch Applicant: Marylin Makuch (Received September 2, 2014 Public Hearing September 16, 2014) (Decision within 65 days after close of P.H).

The Public Hearing is set for September 16, 2014.

PZC2014-25 Application to Amend Special Permit and final site development plan for an addition of 882 square feet (clean room 684 sq. ft. additional storage space 198 sq. ft.) at 25 Village Hill Road (Map 39 Lot 12 Zone DNC) Owner/Applicant: Robert Whalen (Received September 2, 2014 Public Hearing September 16, 2014.) (Decision within 65 days after close of P.H.)
The Public Hearing is set for September 16, 2014.



PZC2014-26 Application for Special Permit for retail sales and showroom of pets supplies, accessories and treats (including occasional baking of pet treats) for pet supplies at 331 River Road (Map 30 Lot 16 Zone DC) Owner: David Stuart Applicant: Donna Hart (Received September 2, 2014 Public Hearing September 16, 2014 (Decision within 65 days after close of P.H.)

The Public Hearing is set for September 16, 2014.

PZC2014-28 Request for review and approval pursuant to CGS 8-24 for possible land purchase -33 Hancock Road

Selectman Christina Mailhos was present.  She said the land is next to the Public Works garage and presented plans.  She said Margaret Harrison is willing to sell it to the town for $20,000.  Selectman Mailhos said there will be no use of the property except to change the buffer line; this will allow them to put the salt shed on the parcel instead of across the street behind the bus stop.  S. Yorgensen said the Special Permit, which is R80, will also allow the change.  

Selectman Mailhos said the process will be a little different; at this time they do not have a site plan and are currently not be doing anything with the property.  She said they may propose a conservation easement and added that they do have approval from Board of Finance and the Conservation Commission; the next step will be to go to Town Meeting.  

J. Sullivan asked the assessment of the property and Selectman Mailhos said $68,000.  She said Ms. Harrison was asking $35,000 and they negotiated down to $20,000.

The Commission will draft a letter in favor of the land purchase at 33 Hancock Road.  

PZC2014-27 Application to Amend Special Permit to add a proposed 18’ X 36’-4”addition to restaurant & bar and a 20’ X 35’ patio expansion at 39 Adamec Road (Map 24 Lot 40 Zone DC) Owner/Applicant: Arben Tena (Received September 2, 2014 Public Hearing by October 21, 2014) (Decision within 65 days after close of P.H.

The Commission looked at the modified site plan and a discussion was held on the expansion.  The applicant was present and said they would like to expand the bar 15’ x 34’ onto the existing deck and expand the deck out 750 feet.  J. Sullivan asked if they are replacing the wood deck with a concrete slab and Mr. Tena said yes.  S. Yorgensen said they will do a partial expansion with a basement but cannot do a full basement.  

Mr. Tena said they would like to enclose part of the deck to increase the bar area but will reduce the patio area.  He said they are not increasing seating, just moving it around.  Mr. Tena said with the increased area in the bar, they can close the dining room during the day; this would save on scheduling servers as well electricity, heating and air conditioning.  

A discussion was held and the Commission agreed this was a minor modification as the patio is already there.  S. Yorgensen agreed it was a minor modification.  

Selectman Mailhos said she believes the amendment is minor in execution but major in impact.  Kim Kowalyshyn spoke on behalf of the Economic Development Commission and said they are in support of the modification.  

Chairman Marco motioned the approve PZC2014-27 Application to Amend Special Permit to enclose the existing deck to expand the bar and expand the deck 750 feet with the following conditions:

  • All original conditions apply
  • Approval  must be obtained from the Fire Marshal, Building Inspector and Health Department
E. Standish seconded the motion.  All in favor.  Motion carried.

E. Standish motioned to approve the minutes of July 15, 2014. K. Golden seconded the motion. All in favor.  Motion carried.

Staff Report and Discussion

S. Yorgensen provided the Commission several samples of Sexually Oriented Business Ordinances and a discussion was held.  She asked the Commission to read through the information provided.  She explained that currently the regulations do not allow any type of live entertainment since we are without this type of ordinance.  A discussion was held on implementing an Ordinance and Attorney Mark Branse’s recommendations.  Selectman Mailhos will draft an ordinance for the Commission’s review.  

Selectman Kowalyshyn reminded the Commission of a joint meeting scheduled September 24th at 7:00 for EDC, PZC and the Board of Selectmen.
