PZC2013-4 Application for Special Permit for motor vehicle fuel sales, tire repair and replacement, retail trade and two restaurants (Travel Stop) at 00 Polster Road & 3 Polster Road (Map 46 Lots 16 & 17) Owner: Joseph & Frank Malack Applicant: Love’s Travel Stops & Country Stores (Received February 19, 2013 Public Hearing April 16, 2013 Decision within 65 days after close of P.H.)

PZC2012-45 Application for 3 lot Re-Subdivision at 476 Tolland Turnpike and Meadow Lane (Map 16 & 21 Lot 22 Zone R80) Owner/Applicant: Ridgeview-Willington, LLC (Received November 20, 2012 Public Hearing January 15, 2013 continued to February 19, 2013 Decision within 65 days after close of P.H.)
Attorney Samuel Schrager was present for the applicant. The Commission looked at the plans submitted. A discussion was held on the recommendation by the Willington Conservation Commission. A. Marco said one of the goals is to keep in line with the POCD and keep the open space parcels contiguous.
D. Roberts motioned to approve PZC2012-45 Application for 3 lot Re-Subdivision Plan for Land Owned by Ridgeview-Willington, LLC, at 476 Tolland Turnpike and Meadow Lane (Map 16 & 21 Lot 22 Zone R80) based on plans revised to February 4, 2013 with the following conditions:
1. Given that the recommendations of the Willington Conservation Commission (letter dated 2-19-13) are in agreement with the Willington Plan of Conservation and Development, the final plans shall be revised to reflect open space designation per those recommendations, as follows:
- An Additional 8 acre shall be added abutting the proposed Lot 22-4, which in turn abuts the 6.3 acre Town-owned open space (Parcel #16-035-00), making a total addition to Town property of approximately 10 acres. The 8 acre parcel shall be conveyed with permanent access from the Meadow Lane cul-de-sac. The 8 acre parcel and proposed Lot 22-4 shall be transferred to the Town in fee simple.
- An additional 1.5 acres shall be added to the eastern edge of Conservation Easement “A” making the easement a total of 19,986 acres.
- Proposed Conservation Easement area B shall be eliminated.
2. Digital plans shall be submitted pursuant to Section 4.02 2).
3. Driveways shall be constructed as required and approved by Willington Fire Department.
4. Since the Commission cannot approve the creation of a lot where a structure would violate zoning, the concrete pad straddling the proposed property lines between proposed lot 11 and 22-2 shall be (1) removed to make compliant with applicable zoning regulations, to the satisfaction of the Willington Town planner/zeo, or (2) said removal shall be bonded prior to filing the mylars.
P. Nevers seconded the motion.
A vote was held and unanimously approved. Motion carried.
PZC2013-1 Application for Special Permit for Use of existing home bakery kitchen at 327 Daleville Road (Map 2 Lot 3 Zone R80 Owner: Linda Lee Hill Applicant: Christine M McVey (Received January 15, 2013 Public Hearing by February 19, 2013 Decision within 65 days after close of P.H.)
Chairman Marco said in July 2012 the State of Connecticut has passed new regulations stating anyone purchasing produce from an outside source and then processing would have to seek zoning compliance locally before a state license is issued.
P. Nevers motioned to approve PZC application 2013-1 for a home occupation by special permit for making pickles (cold processing), mustards and the like in an existing approved home bakery kitchen at 327 Daleville Road, R-80 Zone, according to the application submitted January 15, 2013, Christine M. McVey, applicant/Kenneth and Linda Lee Hill, owners. T. Murphy seconded the motion. All in favor. Motion carried.
Minutes
P. Nevers motioned to approve the minutes of February 19, 2013. T. Murphy seconded the motion. All in favor. Motion carried.
Correspondence
No correspondence at this time.
Public Comment
Aaron Krieger was present and said he would like to put an addition on his house and asked for information on the variance process. M. Fraenkel said he can apply directly to the Zoning Board of Appeals. She will assist him with the application.
Staff Report and Discussion
M. Fraenkel said she is working on a complaint on Village Hill Road and will update the Commission when she has more information.
The Commission thanked the Conservation Commission for their help on application PZC2012-45. Bob Shabot was present and said the Commission was pleased to assist. M. Fraenkel commended the Conservation Commission on the document they submitted with their recommendations. Chairman Marco said that at their last seminar at Central Connecticut, the Willington Conservation Commission was recognized as one of the premier Conservation Commissions in the State.
A discussion was held on the regulations and the restrictions placed on the owners of farmland. A further discussion was held on encouraging low impact forestry.
The meeting was adjourned at approximately 8:30pm.
