A. Marco called the public hearing to order and requested a 15-minute recess as the Chairman was running late.
Public Hearing
M. Ellis called the public hearing to order at 7:55. J. Poole was seated for E. Standish.
PZC2011-37 Application for 2 Lot Subdivision at 19 Adamec Road (Map 24 Lot 33 Zone R80) Owner/Applicant: Robert & Mary Wiecenski (Received July 19, 2011 Public Hearing by September 20, 2011 Decision within 65 days after close of P.H.)
Stephen Filip, of Filip Associates, presented plans. The proposal is to subdivide an existing parcel into two lots; one new building lot and a corner lot which has an existing house and garage. Mr. Filip referenced a memo from Jody Schmidt, of Eastern Highlands Health District, requiring down grading and a reserve area in which they will comply.
Mr. Filip said, in the application, they are requesting a waiver of 4.02.02 of the Subdivision Regulations regarding the establishment of horizontal datum and did not feel this was a problem because it is a corner lot. A discussion was held on the horizontal datum required in the new regulations. J. Poole said they are trying to get the subdivision and mapping on GIS as accurate as they can be. Mr. Filip said they are requesting the waiver because it is a small site and on the corner.
Mr. Filip said Karl Acimovic, the town engineer, is concerned about a drainage pipe. When the garage was built, they extended the pipe and it touched into the wetlands. In Mr. Acimovic’s memo, he recommends the property lines be adjusted to maintain the proposed drainage easement on a single parcel and the town be granted the right to enter for maintenance and repair in the future. This was also stated in the memo from Jacobson & Associates and Mr. Filip said they would add it to the plans.
Mr. Filip said the lots do meet all requirements of the zoning regulations and his certification of buildable areas is notated on the plans. He said the site lines are shown for the new driveway and there will be minimal brush removal. S. Yorgensen said the fire department will check it after it is built to see if the ambulance can turn around.
Mr. Filip submitted a Design Statement with the application. He said the hydrology will go in a westerly direction from the driveway, over the field and down to a stone wall. Mr. Filip also referenced various points that were also submitted in the Design Statement.
J. Poole asked if they were asking for a waiver for the entire section of 4.02.02 because that is how the application reads. Mr. Filip said just the horizontal and vertical datum and they will make the amendment.
S. Yorgensen said there is an issue regarding the property line and easement but all other information has been received.
T. Murphy motioned to close the Public Hearing. W. Parsell seconded the motion. All others in favor.
PZC2011-39 Application for Special Permit for Commercial Kennel at 451 River Road (Map 34 Lot 6 Zone DC) Owner/Applicant: TJE LLC (Received July 29, 2011 P.H. August 16, 2011 Decision within 65 days after close of P.H.)
Jeff Love was present and said they would like to board dogs that do not have a medical necessity. He said this was based on client’s request. Clients that have been there for medical boarding requested general boarding because they were not happy with the conditions of other kennels. Mr. Love said they have 12 runs and could board from 12 to 20 dogs.
J. Poole motioned to close the Public Hearing. T. Murphy seconded the motion. All in favor.
Regular Meeting
M. Ellis called the regular meeting to order at 8:23. J. Poole was seated for E. Standish.

S. Yorgensen said the application is to cut off 3 lots of the parcel.
M. Ellis motioned to hold a Public Hearing on 9/20/2011 at 7:30. A site walk will be held prior to the Public Hearing at 6:00 on 9/20/2011. W. Parsell seconded the motion. All in favor. Motion carried.
PZC2011-40 Application for Special Permit for entertainment services including ~Disk Jockey and Karaoke Services at 15 River Road (Map 5 Lot 3 Zone DC) Owner: A.M.P.M. Properties LLC Applicant: Al & Danielle Smith ~(Received August 16, 2011 Public Hearing by October 18, 2011 Decision within 65 days after close of P.H.)
S. Yorgensen said the application is to rent out entertainment services; D J and karaoke services and wedding planning and the like, not to have entertainment in the space.
M. Ellis motioned to hold the Public Hearing on 9/20/2011. W. Parsell seconded the motion. All in favor.

M. Ellis motioned to hold the Public Hearing on 9/20/2011. T. Murphy seconded the motion. All in favor.

M. Ellis motioned to approve file PZC2011-28 Application for Special Permit Home Occupation showroom for kitchen cabinets at 18 Cemetery Road Owner/Applicant: Bruce & Laura Gottier with the following conditions:
- An A-2 survey showing the proposed and completed building is submitted prior to zoning approvals being issued.
- Applicant shall obtain all required state and local permits.
- Signage shall conform to the regulations and shall be submitted to the Commission for review and approval.
- Home Occupation Special Permit shall be annually renewable (beginning September 1, 2012).

PZC2001-26 Application for Special Permit to open Tattoo Studio at 94 Cemetery Road (Map 52 Lot 27 Zone R80) Owner/Applicant: Les Doty (Received May 17, 2011 Public Hearing July 19, 2011 Decision within 65 days after close of P.H.)
M. Ellis motioned to approve file PZC2001-26 Application for Special Permit to open Tattoo Studio at 94 Cemetery Road, Owner/Applicant: Les Doty with the following conditions:
- As represented by the applicant there shall be no signage.
- Documentation regarding how biohazard removal will be handled shall be submitted to the Commission.
- Applicant shall obtain all required approvals from State and Local Agencies including getting a physicians approval and approval from the Health District.
- Home Occupation Special Permit shall be annually renewable (beginning September 1, 2012).
- Parking is restricted to one client at a time.

M. Ellis motioned to approve file PZC2011-30 Application for Special Permit to open Smoke Shop at 15 River Road, Owner: A.M.P.M. Properties LLC Applicant: Farhad Iftikhar with the following conditions:
- Hours of operation shall be between 10:00 AM and 10:00 PM.
- Signage shall conform to the regulations and shall be reviewed and approved by the Commission.
- Applicant shall obtain any State or Local permits required. Special Permit shall be annually renewable (beginning September 1, 2012).
- No outside product or services advertising signs.
W. Parsell seconded the motion. A. Marco abstained. All others in favor. Motion carried.

The Commission discussed conditions and would like all comments incorporated on the plans with the lot lines moved. A discussion was held on the waiver requested for the datum. The application was tabled until the next meeting.
PZC2011-39 Application for Special Permit for Commercial Kennel at 451 River Road (Map 34 Lot 6 Zone DC) Owner/Applicant: TJE LLC (Received July 29, 2011 P.H. August 16, 2011 Decision within 65 days after close of P.H.)
The commission discussed conditions of this application; annually renewable, approval from the Health Department and all state, local permits and licenses required.
A discussion was held on the decision-making process and circumstances on the timing in which a decision might be made. A discussion was held on a previous meeting that was cancelled due to not having a quorum.
W. Parsell motioned to approve file PZC2011-39 Application for Special Permit for Commercial Kennel at 451 River Road, Owner/Applicant: TJE LLC, with the following conditions:
- Applicant must obtain approval from the health department.
- Applicant shall obtain any state or local permits required
- Special Permit is annually renewable beginning September 1, 2012

Minutes
M. Ellis motioned to approve the minutes of July 19, 2011. J. Poole seconded the motion. All in favor.
Correspondence
1. Notice of Certain Planning Matters for the Town of Coventry.
2. State of Connecticut Siting Council letter to the Planning and Zoning Commission regarding the New Cingular Wireless tower.
3. State of Connecticut Siting Council letter regarding the cancelled public hearing on July 12, 2011.
Discussion and Staff Report
A discussion was held on the upcoming tax sale.
A discussion was held on the buildings in the process of being removed on Route 74. S. Yorgensen said the Building Inspector has issued a Stop Work Order because they have not obtain a permit.
A discussion was held on Staff enforcement of Notice of Violations and Cease and Desist orders. The staff and the commission agreed to close the office to the public on Thursdays at 11:00 beginning September 1, 2011.
J. Poole said TA is dispensing DEF but not out of the 2000-gallon tanks. They are selling 5-gallon cans. He questioned the amount they are storing on site, if they have notified the fire department and how they can dispense it without a permit. A discussion was held. S. Yorgensen said she would talk to the Fire Marshal and the Health District. Meeting Adjourned at 8:57.
