PZC2010-2 Application for Special Permit for Light Repair on Fed Ex Trucks at 672 River Road (Map Lot 1 Zone DI) Owner: Russ Boehle Applicant: Dennis M Lavaller (Received March 2, 2010 Public Hearing April 6, 2010 Decision by June 1, 2010.)
M. Ellis motioned to approve a WORKSHOP with the following conditions:
1. Workshop is approved to work on vehicle wholly owned and registered by the applicant and, in no case, for the public or for profit.
2. All vehicles shall be registered.
3. All waste shall be disposed of in accordance with all State and Federal laws.
4. A waste management and spill containment plan to be submitted in writing within 30 days, to be review and approved by the Commission or their agent.
5. Permit shall be renewed annually beginning May 1, 2011.
6. Annual site walk to be conducted by the Commission prior to renewal.
T. Murphy said he would like to have yearly inspections. W. Parsell said they could do a site walk with the annual renewal. A discussion was held on the role of DEP. E.Standish asked about including the quads for the race team in the motion and said he does not believe the lift is capable of lifting a Fed Ex truck. M. Ellis said he could use the lift for his personal vehicles. A discussion was held on waste water and the applicant being restricted from washing the trucks per the DEP Guidance document. J. Poole asked who was going to administer this. T. Murphy asked about floor drains. J. Poole said, if the applicant moves out and someone else moves in, the permit transfers. J. Poole asked who controls the disposal of wastes listed in Ross Bunnell’s email (Bureau of Materials Management and Compliance
Assurance). A. Marco said the town has other businesses in town that perform this type of function and have not had any problems that we are aware of. T. Murphy said he would like to see an annual site walk added into the motion.
All in Favor. Motion carried.
PZC2010-3 ~Application for Modification to Special Permit ~Final Site Development Plan to add ~in the future a 25’X35” 3 sided pole building at 49 Hancock Road (Map 38 Lot 20 Zone R80)Owner/Applicant: Town of Willington (Received March 16, 2010 Decision by ~May 18, 2010)
Selectman Christina Mailhos said she sent a letter to DEP but has not yet heard back.
8-24 Review Capital Improvement Program for Fiscal Year 2011-2012, 2011-2015
J. Patton was present. He said the only difference in the CIP, from the original plan, is the purchase of fire trucks. He said this was a big issue so the Willington Fire Department will only purchase one truck this year. Mr. Patton explained the trucks to be moved and replaced. He said one truck will be moved to the South Station. Mr. Patton explained various problems they have had with the trucks breaking down. He said they may replace a second truck in a couple years.
J. Poole said the Commission received input from Atty. Branse and some towns do the 8-24 Review and some do not. He said he thought it would be better if P & Z was involved earlier on. Mr. Patton said it would be a good idea to have a P & Z member on the CIP Commission. He said they could give the P & Z Commission drafts early on but they could change up until the Board of Finance approves it. E. Standish said that would give them a better idea of what is going on. J. Poole said the existing Plan of Conservation & Development states the future fire services in town should be consolidated to a single fire department. He said this is what they have to look at with the 8-24 Review and questioned what should be done with the POCD in the future as it is due to be updated in a couple years.
J. Poole motioned to approve the Capital Improvement Program for 2010 – 2011; out years to be considered in the context of the POCD. E. Standish seconded the motion. All in favor.
PZC2010-7 Sign Application 33 Ruby Road Willington Baptist Church
M. Ellis said the applicant removed the lighting and the sign is within the regulated square footed. He said the changes requested were done.
E. Standish motioned to approve the Sign Application for the Willington Baptist Church at 33 Ruby Road. W. Parsell seconded the motion. All in favor.
New Business
- PZC2010-13 Request for review and approval pursuant to CGS 8-24 for a water main extension along Old Farms Road from 60 Old Farms Road & Center School to 12 Old Farms Road Owner/Applicant: Town of Willington (Report by May 18, 2010 or assumption of approval)
Mark Zessin of Anchor Engineering Services was present for the applicant. He said his company designed the water line which goes cross country through the woods and down Old Farms Rd. J. Poole said there wasn’t date on the document and asked if it was the final plan. Mr. Zessin said yes and they dated the plans as of 4/20/2010. J. Poole asked why the Commission was getting this application when it was still under IWWC approval. Mr. Zessin said per the 8-24 Review. M. Ellis said he would like them to come back after receiving the IWWC report. J. Poole said they do have questions and would like the IWWC report.
Mr. Zessin said the test holes were done that day, April 20th, and they did not find bedrock or have any problems. He said within one area, they are within 100 feet of the wetlands and showed this on the plans. He said they are basically going around the wetlands. A discussion was held on the plans and the path of the water main extension. W. Parsell asked the inches of the main and Mr. Zessin said 4 inches. J. Poole said the document says 8 inches and Mr. Zessin said that was the original concept but the new documents says 4 inches.
The matter was tabled until the next meeting. The Commission will review the documents and discuss at the May 4th meeting.
- PZC2010-14 Request for review and approval pursuant to CGS 8-24 for construction of new water service from the water main on Old Farms Road to Center School building (12 Old Farms Road) Owner/Applicant: Town of Willington (Report by May 18, 2010 or assumption of approval)
This matter was tabled for this meeting.
PZC2010-15 Application for Modification of Special Permit & Final Site Development Plan with the addition of a recreational storage shed at 60 Old Farms Road (Map 17 Lot 1 Zone R-DER) Owner: Town of Willington Applicant: Matthew Rains (Received April 20, 2010 Public Hearing by June 15, 2010, Decision within 65 days after close of P.H.)
Matt Rains was present for the applicant. He said the application is for a storage shed at the Senior Center to hold games and miscellaneous storage. The storage shed will be 8 feet by 8 feet. Mr. Rains said the shed will be on crushed stone skids. J. Poole asked about the completed work at the Senior Center including the planters. Lynn Nicholls, of the Public Works Dept., said all that was needed were 2 planters and 2 planter beds. She said the horseshoe pits, picnic tables and benches were completed and that was what they needed to get their CO. A discussion was held on the future playscape.
M. Ellis asked the Commission if they felt this was a major modification and they replied, no. T. Murphy said they would need the latest updated prints. The Commission tabled this application until the next meeting and asked Staff to prepare a draft motion.
Minutes
M. Ellis motioned to approve the minutes of April 6, 2010 with the following correction. M. Ellis was present, not excused. T. Murphy seconded the motion. A. Marco abstained. All others in favor.
Subdivision Regulations
M. Ellis said he talked to Teri Haun on what they would like her to do and pricing. He said he also talked to another engineer and the price was much higher. The next workshop is scheduled for 7:00 on April 27th at the Library.
Correspondence
1. Letter for Branse, Willis & Knapp, on the General Zoning File Public Act 98-228 and Conn. Gen. Statute 23-65k.

Public Comment
Selectman Mailhos said they are working to put together a formal plan to submit to P & Z regarding the proposed Reserved Land Use site. She said she told the road crew to stop sweeping because there is no place to put the sand. She said they are looking at 3 options. First option was to put it at public works but the only place they have to store it is in the location of the brush pile. The second option would be to bring it to the Manchester land fill but they would need a permit at $130 per truck and Manchester will charge $70 a ton. The cost would be well into the thousands of dollars. 3rd option is to have town residences receive the sand and she said they do have a few volunteers. Selectman Mailhos said they are in the process of drafting a document that will hold the town harmless and
explained all the stipulations. She said she talked to S. Yorgensen about doing a pre-approval on what the homeowners are using the sand for.
J. Poole said he was concerned about the storage and containment. Selectman Mailhos said this process could take a couple weeks but does not help them tomorrow. They have no where to bring the sand so they cannot sweep although, the town residences want them to sweep. A. Marco asked if there was another property they could put the sand on and Selectman Mailhos said the gravel pit in question is in a residential zone and storage is not an accessory use.
A discussion was held on whether or not Planning and Zoning wanted to instruct staff to inspect these properties and the agreement the Selectman are working on. J. Poole said he has an issue with dumping the sand on properties and the possibility of it running into the wetlands. E. Standish said he sees it differently; anyone can buy material and have it dumped. Staff does not go out and pre-check. J. Poole said this instance is a municipality and they are responsible. A discussion was held. A. Marco said it is not clean sand.
A discussion was held on the DEP Guidelines. Selectman Mailhos said the Guidelines are recommendations and are clearly marked as Guidelines. She said, ideally, their ultimate goal with the Reserved Land Zone is to have a pit to store these types of things and instead of paying for it; they would have it on hand which is recycling at its best and saving the taxpayers money. J. Poole said the DEP document does tell them what to do and they are doing things that are not recommended such as sweeping and collecting matter.
A discussion was held on testing and screening and options of what to do in the meantime. A discussion was held on the current gravel pit and the area of the brush pile at Public Works. J. Poole suggested the Board of Selectman check the map and contact DEP. A discussion was held on the wetlands. A. Marco said if the town stops sweeping, all the sand runs into the aquifers. Karl Acimovic said if there are contaminants in the sand, they are going to be diluted and wash into the streams. He said, if you store them, it will not happen right away.
A discussion was held on recycling the sand. A discussion was held on various options and Planning and Zoning’s role in this. A discussion was held on sand and gravel operations in town and possibly paying for storage. Selectman Mailhos said the commission gave her a few good ideas. K. Acimovic said, if the town puts material on their own property, they at least have control over it.
