Public Hearings:
Hearing to Consider Voiding of Clover Springs Subdivision, Phase II, Clover Springs Road in accordance with Subdivision Regulations Chapter XI, Section 3, and to call the bonds for Public Improvements (Public Hearing 4-3-07, Continued to 5/1/07 Continued to 5/15/07.

Attorney Schrager was present on behalf of his client Joe Voboril.  He stated that at the last meeting he requested a month to complete all curbing on the road.  He stated that it was completed by May 1, but the road had not been swept and the catch basins had not been cleaned out.  Mr. Schrager stated that since May 1 all of those things have been completed.   He stated that he is aware that the commission did request a receipt of cleaning but was unable to get it in time for the meeting.  Mr. Schrager said that he thought the town engineer had gone out to inspect the road but was not sure.  The commission said that they have not received any notification from him that he has inspected it.  
Mr. Schrager said that he is aware of the commissions concerns of stumps and farm equipment being left on lots but believes that the bond only covers the road.  He stated that he is requesting that the bond be reduced to an amount to cover whatever the removal of the debris will cost.  He stated that he is suggesting that the bond be reduced by half.   Mr. Schrager also asked to substitute the letters of credit bonds to cash bonds and would like to have the road accepted.  

M. Ellis said that the town attorney is fine with accepting cashier checks on the estimate from the town engineer as to how much the debris removal will cost.  

A. Marco asked how much the performance bond is currently.  M. Ellis said it is $90,000 and the maintenance bond is $80,000.  A. Marco read the regulation regarding debris left on a sub-division lot.

Attorney Schrager asked the commission if they are still planning to void the sub-division.  The commission members said that they were not sure.  

R. Tulis said that he drove down the road this afternoon and the road seemed to have less debris on the lots.
The commission stated that they only concerns that the town engineer still had was sweeping the road and cleaning the catch basins, so they need to wait for documentation that that has been done.  

R. Tulis and M. Ellis said that they do not have a problem reducing the performance bond.  R. Tulis said the commission cannot accept the road they can only recommend to the town that it be accepted.  

Attorney Schrager then asked for the bond to be reduced and the town can hold the bond until the road is acceptable.  G. Jones said that a cost estimate must be created for the removal of the debris.  Attorney Schrager said that is fine, he suggested reducing the bond by 50% or the price submitted, which ever is higher.  The attorney asked what the process for accepting the road would be.  R. Tulis said that he would like to see the engineer’s inspection first before the commission made a recommendation to the board of selectmen.  Mr. Schrager requested that if at the next meeting the town engineer says the batch basins have been pumped then he would request that the road be accepted.

P. Nevers made a motion to close the public hearing.  N. Gray seconded the motion.  

Regular Meeting:
Old Business

Voiding of Clover Springs Subdivision, Phase II, Clover Springs Road in accordance with Subdivision Regulations Chapter XI, Section 3, and to call the bonds for Public Improvements

1. ~Request for release of Performance Bond.

M. Ellis asked for a motion to reduce the performance bond to $45,000 or whatever the estimate from the town engineer will be to remove the debris, which ever is greater.  

P. Nevers made a motion to reduce the performance bond to $45,000 or to the estimate from the town engineer for the cost it will be to remove the debris, which ever is more.  R. Tulis seconded the motion.  All members voted in favor, thus the motion carries.

2. ~Request for road approval Clover Springs Subdivision

The commission requested to see the memo from the town engineer and will not accept the road until he says all matters are complete.


New Business
~
1. ~Proposed regulation changes:
a.      Subdivision regulations, Section III .3

R. Tulis said that he would like to discuss the spacing of the signs.  He stated that people do not read the legal notices in the newspaper and would like a sign posted stating that there is a land use permit being requested and to call the town office building for more information.  He stated that he would like to see these signs posted every 200 feet.  M. Ellis asked if they should require a deposit for the signs.  He said that the commission should ask the town attorney to see if that information would need to be included in the regulation.  

Jim Poole asked if they are requiring the signs for all land use permits.  The commission said that it will only be for those that need to go to public hearing.  

Annemarie Poole asked what the commission would like to see written on the sign.  The commission said that it would state that a permit has been requested, a notice of public hearing and to call the town office for more information.  Mrs. Poole said that the town office hours should be posted as well.  Mr. Poole stated that he is opposed to these signs as they become neglected and often the landowners do not bring the signs back to the town office building.  He stated that it is the property owner’s responsibility to read the legal notices and know what is happening in town.  Mr. Poole said that public works will become responsible for cleaning up signs that were not taken care of by the landowners.  Mrs. Poole stated that requiring a bond for the signs becomes a recording keeping issue for the town as well.

T. Murphy asked if the commission can place a time limit on how long a landowner can keep a sign.  The commission thought it might be possible.  

b. Zoning regulations, Section 12.03.03.01, 13.04.03.04, 13.04.03.06
The commission said that they would look over the information that they have and discuss it at the next meeting.

R. Tulis made a motion to accept the minutes as amended, N. Gray seconded the motion.  All in favor, T. Murphy abstained.

2. Notice of certain planning and zoning matters in neighboring municipalities from Tolland.

Sub-Committee Reports
M. Ellis said that the first selectman is meeting with WINCOG on Monday and he will attend the meeting.

Staff Report and Discussion
M. Ellis stated that the new daycare Kids Kingdom has still not put in there plantings.  G. Jones said he would look into it.  

Public Comment
Jim Poole stated that the commission currently has operating hours for logging but not for contractors.  He stated that contractors doing work near his home are working until late at night and on Sundays.  He suggested to the commission that they put operation hours into the new regulations.  

Adjournment
R. Tulis made a motion to adjourn at 8:14pm.  N. Gray seconded the motion.
