Meeting Minutes of March 21, 2006
Public Hearings called to order at 7:45 PM by Chairman Latincsics.

1. File #2006-02 – Application for a 14-Lot Re-Subdivision of Lot 1 on property on Mihaliak Rd. (Map 50, Lot 3) Owner/Applicant: Mary C. Litwinczyk & Litwinczyk Children, LLC. (Received 1/17/06; Public Hearing 3/21/06, Decision by 5/16/06)
David Battista and Edward Pelletier the engineers for the property were present, Mr. Pelletier stated that he submitted the approval letter from Eastern Highlands Health District on 3/16/06 which stated the property meet all health codes. Mr. Pelletier presented the commission with receipts from his mailing to notify pertinent parties of the public hearing.
A. Marco asked if all of the town engineer’s concerns had been fixed. Answer- yes, K. Acimovic had been over all of the changes done to the property and approved them.
M. Ellis asked who will be responsible for cleaning the drainage basins. Answer- The town will become responsible due to the basins being on town property.
L. Kenderdine was present to speak on behalf of her mother M. Harrison who resides next to the proposed sub division. Ms. Kenderdine stated that her mother is in favor of the project but asked if the col-de-sac could be extended to the property line so if her mother chose to sub-divide her property in the future there would be access to the road.
Answer- Mr. Pelletier stated that they had looked into it but due to a wetlands area as well as slope restrictions they did not think the road could be extended.
M. Ellis asked if there had been any changes to the original application. Answer- Mr. Pelletier said that the only changes were to the catch basins and the additional open space due to K. Acimovic’s request.
T. Murphy made a motion to close the Public Hearing on File #2006-02, seconded by A. Marco, Unanimously approved.
2. File #2006-06 – Application for a Special Permit for Day Care at 330 River Road (Map 30, Lot 31-A, Zone DNC) Owner/Applicant: Daniel R. Cote. (Received 1/17/06, Public Hearing 2/21/06, continued to 3/7/06, continued to 3/21/06, Decision by 5/2/06)
Daniel Cote and David Palmberg, the applicants engineer, were present and stated that they have received conditional approval from Eastern Highlands Health District pending approval from the Planning and Zoning Commission.
Mr. Plamberg discussed K. Acimovics concerns regarding the property. They are as follows:
1. The catch basin location on the proposed application does not match with the water shed map.
2. There is a concentrated run off of water that goes across the septic system
3. There is a lighting gap at the entrance of the building.
Mr. Palmberg stated that all of these issues have been or are in the process of being addressed.
M. Ellis asked if the center will be for 44 or 50 children. Answer- Mr. Palmberg said they will have 44 slots due to the square footage and day care regulations.
A. Marco asked what the hours of operation will be. Answer- 7:00am to 6:00pm
M. Ellis asked if they plan on widening the drop off area. A discussion regarding the parking area took place. Various ways to make the parking area more suitable during pick up and drop off times were discussed.
M. Ellis asked about fixing the entrance lighting at the center. Mr. Palmberg said that they are having someone look into various types of lighting and will report back to them the photo metrics for each type of lighting. A discussion regarding the lighting took place.
A. Marco made a motion to close the Public Hearing on File #2006-06, seconded by T. Murphy, Unanimously approved.

Regular Meeting was called to order by Chairman Latincsics.

C. New Business
1. Review and renewal consideration of the Wilderness Lake Campground special permit located at 150 Village Hill Road. (Map 43, Lot 124) Owner: KMC, LLC. Site Walk 3/18/06 at 9 am.
P. Latincsics stated that he receive correspondence from Wilderness Lake Campground requesting to wait to receive their health inspection until they are open for the season. P. Latincsics said he did not see a problem with that.
J. Pool said he had concerns regarding the campground adhering to the pre set conditions from the February meeting which stated the camp ground would install a screen around the dumpster, post signs stating no tree cutting, have only 57 camp sites occupied at a time, have the front gate closed and locked on Tuesday, Wednesday, and Thursday during the off season, and have a list of all vehicles registered at the camp ground on record at the town hall. A discussion regarding the camp ground meeting these conditions was held.
M. Ellis made a motion to approve renewal of the special permit for Wilderness Lake Campground pursuant of the issues in the original application for a special permit, the dumpster screen and the no wood cutting signs at the properties boundaries, to be done before the special permit is issues and satisfactory inspection from the health department is received. A. Marco second. All in favor, unanimously approved
2. File #2006-11 – Application for a Special Permit to operate an adult retail store on property at 15 River Rd (Map 5, Lot 3, Zone DC) Owner: Amy Moore; Applicant: Christopher Ferrone. (Received 2/7/06; Public Hearing on 4/4/06; Decision by 6/6/06)
Public Hearing already scheduled for 4/4/06. Application was tabled
3. File #2006-17 – Application for 3-Lot Subdivision at 69 Clint Eldredge Rd. (Map 17, Lot 47) Owner/Applicant: Earl Eldredge (Received 3/21/06, Public Hearing by 4/18/06, Decision by 6/20/06
Public hearing set for 4/18/06
4. File #2006-19 – Application to Modify Condition #5 of File PZC#2006-08, approval of waste disposal prior to building permit at 60 Old Farms Road (Map 17, Lot 1, Zone DER). Owner/Applicant: Town of Willington (Received 3/21/06, Public Hearing by 4/18/06, Decision by 6/20/06).
S. Yorgensen stated the DEP had given approval of the preliminary design
P. Latincsics asked if K. Acimovic and staff had input regarding the issue. Answer yes and they only feel that there have been no significant changes.
M. Ellis asked if the application needs to go back to public hearing. Answer- no unless significant changes are made.
M. Ellis made a motion to modify condition #5 of 2006-08 approval of the waste disposal plan be submitted prior to receiving the building permit verses filing mylar. A. Marco second. All in favor.

1. File #2006-12 – Application for Modification of Special Permit to modify floor plan at 479 Tolland Tpke. (Map 21, Lot 20-1, Zone DC) Owner/Applicant: John Schneider (Received 2/21/06, Decision by 4/18/06)
This application was tabled as the commission needs more information. They would like to have a current up to date floor plan for the building as well as what he had vs what he wants (old and new).
2. File #2006-06 – Application for a Special Permit for Day Care at 330 River Road (Map 30, Lot 31-A, Zone DNC) Owner/Applicant: Daniel R. Cote. (Received 1/17/06, Public Hearing 2/21/06, Decision by 4/18/06)

The commission stated that they need to put together their thoughts and concerns regarding the property as they had talked about las meeting and submit them to S. Yorgensen before the next meeting.
F. Public Comment
C. Demers asked the commission if they will be printing the Plan of Conservation and Development or acting on the plan. P. Latincsics said that they hope to begin modifying the regulations together with the conservation commission. C. Demers asked if there will be a facilitator to help them with the process. M. Ellis stated that there is not enough money to hire someone.
J. Pool presented an article from the Hartford Current that stated that the median price for a home in Willington is $220,000.
G. Minutes
M. Ellis made a motion to approve the minutes of 3/7/06, seconded by A. Marco, unanimously approved.
H. Correspondence
Members reviewed the following correspondence:
1. Spill report from DEP for 327 Ruby Road.
2. Spill report from DEP on 84 East at Exit 70 rest area
3. Letter from D. Sawicki to Public Works approving plans for sidewalk repair plan at Hall School dated Feb. 23, 2006.
I. Staff Report and Discussion
S. Yorgensen stated that the parties interested in a large sub division on Ruby Rd are meeting with her on 3/29/06 at 2:00pm. S. Yorgensen also stated that she is meeting with FEMA on 3/30/06.
T. Murphy asked if he could come in after 2:00 pm to look at the maps for upcoming meetings. Answer- yes, as long as someone is able to unlock the office or on Monday nights when the town hall is open until 7:30pm but if you want plans they can always be sent to you.
J. Adjournment
T. Murphy made a motion to adjourn at 9:27 PM, seconded by A. Marco, unanimously approved.
