MINUTES OF THE PUBLIC HEARING AND MEETING OF
OCTOBER 18, 2005

Chairman Ralph Tulis called the hearing to order at 7:30 p.m.

Public Hearing
· File #2005-17 – Application for a Special Permit for a rear lot on property at 212 River Road (Map 19, Lot 25 & 25A) Owner/Applicant: Lynn Mackovich; Engineer: Gardner & Peterson Assoc. (Received 6/7/2005; site walk 7/16/05 at immediately following site walk for PZC 2005-16, rain date 7/17/05; Public Hearing 8/16/05; 10 day extension submitted and approved; Continued to 9/20/05; 30 day extension submitted and approved; Continued to 10/18/05; Decision by 12/6/05)
M. Peterson representing the applicant submitted revised plans addressing PZC’s consulting engineer’s report dated 10-1`8-05. Mr. Peterson said although the regulations do not allow 3 common driveways in a row, they had received a variance.
P. Tulis and A St. Louis expressed concern regarding ZBA issuing a variance. Mr. Peterson was asked what the hardship was. Mr. Peterson said he could not recall.
R. Tulis expressed concern over the shape of the lot.
Correspondence from Attorney Branse dated 9-27-05 regarding gerry meandering was submitted. A discussion regarding gerry meandering of lots ensued.
A review of the alternate plans submitted to PZC and to IWWC was reviewed.
A. St. Louis made a motion to close the hearing. P. Nevers seconded. Unanimous. Motion carried.

· File 2005-31 – Application for a Special Permit for a Mortgage Services Office in a Designed Commercial Zone on property at 8 Tolland Turnpike (Map 30, Lot 11, DC Zone) Owner: Warren & Carol Ledger; Applicant: Vector Mortgage Services, Inc. (Received 9/20/05; Public Hearing on 10/18/05; Decision by 12/6/05)
The Commission reviewed the application. A discussion regarding the lack of a proper site plan for the proposed external improvements, including parking ensued. The Commission expressed a desire to see a landscape buffer in the area where the removal of the garage would be in the future.
St. Louis mad a motion to close the hearing. P. Nevers seconded. Unanimous. Motion carried
St. Louis made a motion to add File 2005-31 to the agenda under old business. Norm Gray seconded. Unanimous. Motion carried.
Regular Meeting:
A. Call to Order
Chairman Tulis called the Regular Meeting of the Willington Planning and Zoning Commission to order at 8:31pm.

D. New Business
· File #2005-33 – Request for approval of a sign at 511 River Road, River Road Athletic Complex (Map 39, Lot 6, 6A) Owner/Applicant: Town of Willington (Received 10/18/05, Decision by 12/6/05)
John Sahi of the Recreation Department presented a proposed sign. A discussion regarding which side of the drive the sign should be located on.
Phil Nevers motioned to approve the sign and location to the south or north of the access (setback to be as depicted on the plan. Sign to be included on the as built. Al St. Louis seconded. Unanimous
Motion carried.
· File #2005-32 - Application for Logging Permit on property at 96 Spak Rd (M 46, L 1A; M 47, L 26A; M52, L 29A) Owner/Applicant: James & AnneMarie Poole. (Received 10/18/05, Decision by 12/6/05)
Ralph Tulis recused himself from the application and left the table. Mr. Latincsics chaired the meeting. Mr. Grange and Mr. Strickland appeared before the Commission to comment on the application. Discussion held regarding comments being made. Norm Gray motioned to hold a public hearing on the application on 11/15/05. Phil Nevers seconded. Unanimous. Motion carries. Mr. Latincsics said abutters would be notified and a sign posted.
E. Old Business
· Plan of Conservation and Development – Public Hearing held on 10/4/05.
Discussion was held and the majority of the Commission felt that: the 2005 school enrollment figures should be included, the percentage of open space recommended for the town to ultimately obtain be raised as well as the percentage held, the verbiage regarding open space revised accordingly to reflect current acquisition, the maps to be revised and updated.
· File #2005-20 – Request of a 90 day extension to file subdivision plans for property at Daleville & Marco Roads (Map 7, Lot 5-A3) Applicants: Robert & Patricia Elliott
R. Tulis made a motion to approve t the request for an extension Phil Nevers seconded. Unanimous. Motion Carried

Latincsics made a motion to approve the plan showing the lot with the stubby tail configuration (not the pencil point) with the following condition: A DOT Permit is submitted to the Land Use office with the application for a certificate of zoning compliance. Norm Gray seconded. Unanimous. Motion Carried.

Phil Nevers made a motion to approve the use (Mortgage Services) with the following conditions: All proposed exterior changes and/or site improvements be depicted on a site plan and submitted to the Commission with an application for review and approval. Peter Latincsics seconded. Unanimous. Motion Carried.
· File #2005-28 – Application for a 5 lot subdivision on property at Mihaliak Rd. (Map 50, Lot 3) Owners/Applicants: Mary C. Litwinczyk & Litwinczyk Children, LLC – c/o Ralph Phillips, CPA; Engineer: Datum Engr. (Received 9/6/05; Public Hearing closed on 9/20/05; Decision by 11/15/05)
Consensus of the majority of the Commission was that the open space offered was not in compliance with the regulations or the current or draft plan of conservation and development. Attorney to draft a motion.

G. Minutes
P. Nevers made a motion to approve the minutes with the following modifications.

H. Staff Report and Discussion
The Commission requested that the attorney comment in writing regarding variances issued on items PZC acts on.
