PUBLIC HEARINGS
1. File #2005-04 – Application for a 14-Lot Subdivision on property at Lohse and
Spak Roads (Map 46, Lot 1). Owners: Carol Lynch, Robert Haney and MaryAnn
McLees; Applicant: D. W. Fish Builders, LLC. (Received 2/1/05, Site Walk 4/4/05; Public
Hearing 4/5/05, 5/3/05, Continued to 6/7/05; Decision by 7/19/05.)
Eric Peterson of Gardner & Peterson represented the applicant. He said that at the May 3 public hearing, comments were made by the Commission, the public, and the Conservation Commission about this application. There are two major concerns – the proposed intersection with Lohse Road and the open space dedication. On June 6 with met with Karl Acimovic, Sue Yorgensen, and Lynn from Public Works to discuss the existing intersection and the possibility of moving it to Spak Road. He said an open space was added. Most of the field is located on the corner of Lohse & Spak Roads, and the town would appreciate it as open space. The subdivision has been redesigned to accommodate this. The field consists of 3.9 acres. The total open space is 11.7 acres, 20% of the entire
parcel. The minimum requirement is 15% by regulation. This calculation does not include the conservation easement for the wetlands.
Mr. Peterson discussed drainage. Water goes into the detention basin located in the same area as in the original design. Approximately 450 ft. of road discharges into the rear of Lot #1. Rip rap and a level spreader is utilized. Mr. Peterson said there were questions regarding the wetlands permit. He said Yorgensen advised him to submit this plan and if the application is approved, it will go back to IWC to modify their permit. Mr. Peterson said the plan has been submitted to the town engineer, and some discussions have taken place.
Mr. Peterson gave a letter to Ellis, addressed to Chairman Tulis, requesting a 15-day extension to the public hearing.
Peter Anderson of the Conservation Commission thanked Gardner & Peterson for their efforts regarding the open space. He gave positives and negatives of accepting the proposed open space areas. He said we shouldn’t accept the protected open space as part of the developer’s open space.
Jim Poole, of 96 Spak Road, thanked Gardner & Peterson for taking some concern away about the site lines. He inquired about the status of a petition, and Yorgensen replied that the Selectman’s office deals with road matters. Any petitions that come into the Land Use Dept. get routed to the right department.
Mr. Peterson requested direction from the Commission. Ellis said he liked this open space option much better, although he did not know if the 3.9 acres would suffice for either a school or a baseball field.
Gray said he felt that concerns were being addressed.
St. Louis asked about the existing well. Mr. Peterson replied that the old, hand-dug well has been abandoned and will be filled in. St. Louis said that moving the entrance of the road over to Spak eliminates the safety issue.
Cape Cod curbing was discussed. Karl Acimovic’s comments will be procured before the next meeting. Mr. Peterson said that catch basins and curbs get damaged by the plows, and are therefore not the better alternatives.

2. File #2005-12 – Application for a 4-Lot Subdivision on property at 120 Willington Hill Road
(Vonasek Estates). Owner/Applicant: Irma Vonasek. (Received 4/5/05, Public Hearing on
May 17, 2005, Continued to 6/7/05; Decision by 7/19/05.)
Matt Ellis recused himself from this application.
Ed Pelletier from DATUM Engineering and Surveying said that there were several open items to be discussed tonight. He said that Karl Acimovic e-mailed him a letter concerning his review of the road situation. He states that there are three trees that should be removed, only two of which are in the frontage of the parcel. They are shown on Sheet 4 of the plans dated 6/7/05. Mr. Pelletier said another item would be the open space dedication of 2.58 acres.
Matt Ellis, applicant, addressed the Commission regarding “fee in lieu of,” saying the cost is rather high. He said he would be happy to put a conservation easement on the small section of stone wall.
Yorgensen said the “fee in lieu of” could be 10% of the value of the land before subdivision approval. Mr. Dinallo asked if the conservation easement could be split between Lots 1 and 2, with the state maintaining the dam, and Mr. Pelletier replied that was correct. Yorgensen asked about changes, and Mr. Pelletier said that two trees are to be removed. Yorgensen read from Mr. Acimovic’s latest memo, dated March 14, 2005, which indicated approval of plans.
Bob Shabot of 17 Jared Sparks Road asked about setback requirements from the wetlands. Mr. Pelletier said the regulations have 100 ft. wetland setbacks and 250 ft. steep slopes setbacks. Mr. Shabot asked how many feet the proposed drive will be away from the edge of the pond, and Mr. Pelletier said about 35 ft. He gave the details of drainage recommended by the town engineer and involving plunge pools.
The status of the pond was discussed.

3). Owners/Applicant: Mary C. Litwinczyk & Litwinczyk Children, LLC – c/o Ralph Phillips,
CPA (Received 6/7/05, Public Hearing/Decision by 7/19/05).
No one was present.
MOTION: To set the Public Hearing for File #2005-16, Application for a 5-lot subdivision on
property at Mihaliak Road, for July 19, 2005, and the site walk for Saturday, July
16 at 8:30 a.m. (rain date Sunday, July 17).

H. Old Business
Yorgensen said the landscaping and lighting for the library be approved. We have received comments from John Patton regarding the lighting at the meeting today.
MOTION: To approve the lighting plan with modifications 1. Additional fixture (bollard) be added above the north west corner of the pervious parking area and adjacent walkway. 2. that a house shield be added to the bollard [SC (BDAR5)] at the north corner of the entrance drive .3 that the flat lens be substituted for the curved polycarb lens on the wall fixtures [SB (SBH140].
Page L.1 plan details should indicate the detail page for all fixtures.
Electrical lines should be added to the site utility plan.

K. Staff Report and Discussion
Several items were discussed, including underground storage tanks for fire protection, and a proposed day care center on Rt. 32 (which would require a change in regulations and therefore a public hearing). Ellis asked about the status of the special permit for the campground, and Yorgensen replied that the campground has approval for opening, with conditions. She believes the water tests have been done. Status of the “quick claim” is unknown at this time; the town clerk would know about it.
