PUBLIC HEARING FOR FILE # 2002-26 - Application for a Special Permits for two (2) Rear Lots located at 47 Eldredge Mills Road (Map 28, Lot 001, 9.60 acres). Elfriede Skorupski owner/Thomas Levitt applicant (Received on 6/4/02, Hearing continued 8/20/02, decision by 10/15/02). Hearing called to order at 7:40. Seated were Regular Members: P. Nevers, N. Gray, T. Radell, S. Trueb, R. Tulis and A. St. Louis.
Attorney David Marter and Ralph Mazarelli were present to support the application. Attorney Marter explains that his client is agreeable to the changes recommended by the Town’s Engineer. R. Tulis is concerned that the SNET pole at the proposed turnaround needs to be moved or the turnaround itself to allow vehicles (buses) space to turn around without danger of hitting the pole. One of the abutters was present to voice concern that if this application is approved, it might create a precedent and then all of his neighbors would be applying for back lot permits.
R. TULIS MOVED TO CLOSE THE HEARING FOR FILE #2002-26. SECONDED BY S. TRUEB. ALL IN FAVOR, MOTION CARRIES. HEARING CLOSED AT 7:50 P.M.
PUBLIC HEARING FOR FILE # 2002-32 - Application for a one (1) lot re-subdivision of a portion of the property of John Blessington located on east side of Mason Road and south side of Cowles Road (Map 10, Lot 60, 68.5 acres). John Blessington, Owner/Applicant (Received on 7/16/02, Hearing continued 8/20/02, decision by 10/15/02). Called to order at 7:52. Seated were Regular Members: P. Nevers, N. Gray, T. Radell, S. Trueb, R. Tulis and A. St. Louis.
P. Nevers recused himself as he is an abutter to this property.
Hank Torcellini from Gardner & Peterson was there to support the application. He explained that the soil has been tested, there are no wetlands involved and the site is code compliant. The house proposed for this lot is a 4 bedroom home. The land will be a gift to a family member. There were no public comments.

NEW BUSINESS:
Motion by S. Trueb to add the following items to the agenda; 8-24 application for Mirtl Road, Special Permit for home occupation/small engine repair, Mr. Norman on Battye Road, Subdivision application for Mr. Nogas on Latham Road and Village Hill logging application. Seconded by P. Nevers. All in favor, motion passes.
1. 8-24 Application from the Town for improvement and expansion of Mirtl Road including adding a turnaround.
J. Patton was there to explain the application. The Town would like to accept a piece of land being offered to the Town and put in a hammerhead turnaround for the school busses.
Motion by Scott Trueb to approve application 8-24 for the Town to acquire property for expanding Mirtl Road at the end in order to construct a turn around. Seconded by R. Tulis. All in favor, motion passes.
2. File #2002-38-Special permit application for home occupation, small engine repair, for Mr. Norman at 11 Battye Road.
R. Tulis would like a site walk before the Public Hearing date. The site walk will be September 14, 2002 at 9:00 a.m.
R. TULIS MOVED TO HOLD A PUBLIC HEARING ON SEPTEMBER 17, 2002 ON THIS APPLICATION. SECONDED BY S. TRUEB. ALL IN FAVOR, MOTION PASSES.
3. File #2002-34-Application for a 2 lot subdivision on Latham Road for Nogas Estates.
A site walk will be necessary before the public hearing date. The site walk date will be set at the next meeting.

4. Application for a Commercial Logging Permit between Village Hill, Spak and Kucko Roads with access through Joe Halcheck’s property on Village Hill.
S. Yorgensen stated that Wetlands has already approved it. It would be a selective timber harvest. The application fee and PZC application have not been filed so this matter can not be acted upon at this time.

DISCUSSION:
Chris Demers was present to get the Commissions’ input regarding a Scenic Road Ordinance for the Town of Willington. This would allow the residents of particular streets to have them declared as Scenic Roads to limit future alterations and improvements. Chris Demers passed out a sample ordinance which he and committee compiled. This ordinance would be regulated by the Planning & Zoning Commission. The PZC would like to invite the Selectmen to the next meeting to discuss the possible implementation of such an ordinance. The commission feels that such an ordinance could be good for the Town but that the sample handed out needs some improvement. S. Yorgensen will make some recommendations and forward it to Attorney Branse to review for legality and the possibility of putting it
into PZC regulations.
MINUTES:
The minutes of the July 16, 2002 meeting contained a typo in the spelling of the First Selectman’s last name. It should read Patton.
R. TULIS MOVED TO APPROVE THE MINUTES OF JULY 16, 2002 AS CORRECTED. SECONDED BY P. NEVERS. UNANIMOUSLY APPROVED.

STAFF REPORT:
S. Yorgensen handed out staff report and told the Commission that the lawsuit vs. McKinnon was withdrawn.
