Public Hearing:
The commission seated S. Trueb for R. Tulis, D. Lytwynn for A. St. Louis, and W. Goodale for B. Begansky.
1. File #2001-11-Application for a two-lot subdivision located off Tinkerville Road (Map 36, Lot 8, 90 + acres). Amelia Drobney owner/applicant. (Received on 02/06/01, hearing on 03/20/01, decision by 05/15/01).
Richard Meehok, civil engineer, spoke on behalf of the applicant.
R. Meehok said Ms. Drobney owns about 88 acres on Tinkerville Road, and has owned it since 1948. She wishes to create two lots on about 8 or 9 of the acres and will sell the rest of the parcel to the town of Willington. Soil testing has been done and IWWC approval received. They have also gotten sanitarian approval on the leeching field. Lot 1 will be about 2 acres and will be given to a family member, and the other parcel, which is about 7 acres, will likely be sold.
R. Meehok said the neighbors have been notified and a certified letter was sent to the Windham Water Works. They were notified that it is created in the Fenton River watershed area. An archeologist from UCONN also reviewed the site and noted there were no archeological concerns of note. The sitelines are good in both directions. He showed the area to be disturbed on the maps and said most of this is remaining undisturbed. There is a conservation easement in addition to the 100-foot setback to cover the Fenton watershed area. It is basically a simple subdivision.
R. Meehok noted a waiver has been requested for the hydraulic study, as much of the lot is staying in its natural state, and no water will dissipate onto Tinkerville Road.
E. Kalbac asked where the Fenton River was located on the plan.
R. Meehok reviewed the map. He said there is a steep bank coming down, and because of the bank, you can’t really see the edge of the river on the topographical map.
E. Kalbac asked if the other acreage was abutting the Ruby property.
R. Meehok said yes.
W. Goodale asked about Parcel A.
R. Meehok said that was the first free cut, and it went to the King family.
L. Dion said that the file contains the green card receipts. Also, the soils report says testing results were within compliance of the public health code. The letter from the archeologist is also available. He asked if Gary had any questions.
G. Jones asked if house numbers were included on the plan.
R. Meehok said Yes; they are on the reviewed plans.
G. Jones asked if soils types were now shown.
R. Meehok said yes.
G. Jones asked if abutting subdivisions were marked.
R. Meehok said there are two, and they are indicated.
L. Dion asked if there were any questions from the public.
Ruth Boyles, of 63 Tinkerville Road, asked if the plans were for single-family dwellings.
R. Meehok said yes, they would have to be in both cases.
R. Boyles asked where the stop sign is on the map.
R. Meehok reviewed the location.
D. Lytwynn asked if the septic had to be 75.
G. Jones said public health code requires 75, and that is what is shown.
L. Dion asked at what point the 80 acres would be sold or transferred.
R. Meehok said he is not 100% sure, but John Patton said it is already done. If it is not, it is very close. R. Meehok said he wrote the deed and prepared the Mylars. It is imminent.
L. Dion asked if the property had to be in the hands of the town.
G. Jones said yes, otherwise the subdivision does not comply with regulations and it is moot. He recommended making it a condition.
S. Trueb asked about point of access on Tinkerville Road.
R. Meehok reviewed the map.

L. Dion said this is a pretty straightforward application. It has been under consideration for quite some time and the applicant has worked closely with staff. He asked Gary if everything appeared to be in order.
G. Jones said the commission might want to add a couple conditions on the plans.
L. Dion said disturbance appears to be limited.
G. Jones reviewed the regulations regarding the requested waiver. He does not see where there will be much change in runoff.
The commission reviewed the maps and the file.
L. DION MOVED TO APPROVE THE WAIVER OF A HYDRAULIC STUDY AS REQUIRED IN SUBDIVISION REGULATIONS SECTION 4, CHAPTER 4, AS REQUESTED UNDER FILE #2001-11.

DISCUSSION:
L. Dion said the commission should have all received the letter from Don Berg regarding proposed regulation changes for the issue of A2 surveys. He obviously put a lot of time and effort into it and recommended that everyone review it prior to the next meeting.
L. Dion said a concern was raised by an anonymous woman regarding activity in the men’s room of Rainbow Acres. That week, he, Sue and Ralph contacted Joe Mihaliak and asked to come out for an inspection of the property. The inspection was inconclusive. There had been a recent snowfall and there were no tracks indicating that Joe had been out. However, tracks indicated that there had been a flurry of activity at the men’s room. There were car tracks and fresh footprints in the snow. There is a boiler in there to keep pipes from freezing, however, everything was really inconclusive. Joe knows something is suspected, but there could be no conclusion.
L. Dion said while travelling in Massachusetts recently, he saw a cell tower, which actually looked like a tree. He was very impressed with the ability to camouflage.
L. Dion acknowledged that Mr. Goodale was present and it was good to have him back.
STAFF REPORT:
G. Jones said regarding the concerns of several cars on a lot on River Road, it was checked out and they are all registered.
