L. DION CALLED A REGULARLY SCHEDULED MEETING OF THE WILLINGTON PLANNING AND ZONING COMMISSION TO ORDER AT 7:34 P.M. FEBRUARY 6, 2001 AT THE TOWN OFFICE BUILDING, 40 OLD FARMS ROAD, WILLINGTON.

1.     File #2001-07-Application for a re-subdivision of Saddle Ridge Lot #1 located off Route 320 Willington Hill Road (Map 8, Lots 19-1 and 23, 7.1 acres). Stephan Amedy & Keith N. & Andrea J. Schmeiske owners/Stephan Amedy applicant. (Received on 02/06/01, hearing by 04/03/01, decision by 06/05/01).

S. Amedy said he has a dilemma of time constraints with this file due to a pending sale of the house.

The commission discussed possible hearing dates.

S. Amedy said he is not aware of any adversities with this file.

L. Dion recommended Mr. Amedy work closely with staff prior to the hearing date to help speed up the process.

3.     File #2001-12-Application for a modification of Lot #5 & #13 of an approved subdivision (Clover Springs Farm). Joseph Voboril owner/applicant. (Received on 02/06/01, hearing by 04/03/01, decision by 06/05/01).

J. Voboril reviewed the subdivision map with the commission and showed the proposed split and approved house site.

A. St. Louis said this is basically just a merge.

J. Voboril said he is making this proposal to eliminate a possible need to cross the wetlands.

S. Trueb said the split will leave the parcels at about 24 & 27 acres.

J. Voboril said he is not adding any more building sites.

The commission concurred a public hearing is not necessary.

A. St. Louis said they are really just moving a lot line.

4.     Miller Farms Subdivision: Request for approval of road. William LePage.

The commission read memos from Sue and a final road inspection report with this file.

Public hearing is scheduled for March 6th.

8.     File #2000-57-Amedments to zoning regulations of the town of Willington to include wireless telecommunications facilities in sections 3, 5, and 11, and clarification of verbiage in various other sections. Town of Willington applicant. (Public hearing on 01/16/01, continued to 03/06/01.

Continuation of public hearing is scheduled for March 6th.


OLD BUSINESS:

1.     File #2000-43-Application for a special permit for a gravel excavation located off Trask Road and Route 32 on 5.62 acres. (Map 29, Lot 4, 31 acres). Joseph Mihaliak owner/applicant. (Received on 09/05/00, 65-day extension requested and approved, Hearing on 11/21/00, continued to 12/05/00, decision by 02/06/01).

L. Dion said at the last meeting the commission noted there were still outstanding items. He noted he was not present at the hearing but has walked the site and reviewed the files and tapes, and feels qualified to act upon the application. He recommended denial without prejudice since the application is still incomplete.

A. St. Louis said he agrees it is incomplete. Also, the special permit stays with the land, not the owner, and while Mr. Mihaliak was always receptive to working with staff and the commission to address any concerns, questions of proper operation may come up in the future under new ownership.

L. DION MOVED TO DENY WITHOUT PREJUDICE FILE #2000-43-APPLICATION FOR A SPECIAL PERMIT FOR A GRAVEL EXCAVATION LOCATED OFF TRASK ROAD AND ROUTE 32 ON 5.62 ACRES. (MAP 29, LOT 4, 31 ACRES). 2.     File #2000-49-Application for a 5-lot subdivision located of Michalec Road (Map 55, Lot 1C, 28.37 acres). Joseph E. Mihaliak owner/applicant. (Received on 10/03/00, hearing on 12/05/00, extension requested an approved, continued to 01/16/01, decision by 03/20/01).

A. St. Louis said he does not have any problems with the subdivision as proposed, but suggested tabling the matter until staff input was available.

DISCUSSION:

L. Dion said he wanted staff to inquire about a day care center which has recently put up a business sign on Route 74 to be sure they are within the legal requirements by which no PZC approval is required. As of yet, no special permit has been requested for the facility.

B. Begansky said there are many antique cars continually parked at a recently-approved eyeglass facility on Route 32. He would like staff to verify that those cars are all legally registered, as the collection seems to be growing.


STAFF REPORT:

None.

PLAN OF CONSERVATION & DEVELOPMENT:

L. Dion said the board of selectmen was supposed to set a town meeting date to review the request for funding for the plan of development, however, their meeting was likely cancelled due to the weather.
The PZC has gone before the Board of Finance twice to present the proposal. They have accepted the transfer of certain line items to cover part of the cost, but before the rest of the money can be allocated it must go to town meeting.

A. St. Louis said the meeting date will likely be set this week. They have already found $30,000 in the budget available for transfer from CAP, and roof repair surplus. They are hoping the remainder can come from LoCIP.

S. Trueb said the board of finance did seem to have a good understanding of why this is so necessary.

L. Dion said they have realized the potential loss of state funding if the Plan is not updated as required by law.

A. St. Louis said this is going to be a great plan if as many people who have expressed interest in it get involved in its planning.
