T. Murphy called the meeting to order at 7:32.  J. Poole was seated for M. Ellis.   A. Marco arrived at 7:36.

PZC2011-42 Application Special Permit for Fitness and Wellness studio at 11 Phelps Way (Map 30 Lot 14 Zone DC) Owner: Roger Talbot Applicant: Jeanette Dellaripa (Received August 16, 2011 Public Hearing September 20, 2011 Decision within 65 days after close of P.H.)

The Public Hearing has been set for September 20, 2011.

PZC2011-40 Application for Special Permit for entertainment services including ~Disc Jockey and Karaoke Services at 15 River Road (Map 5 Lot 3 Zone DC) Owner: A.M.P.M. PZC2011-38 Application for Re-Subdivision of Lot #4 59 Latham (Map 9 Lot 33 Zone R80) Owner/Applicant: Michael C. Nogas (Received August 16, 2011 Public Hearing September 20, 2011 (Site walk Sept 20, 2011 at 6:00 PM) Decision within 65 days after close of P.H.)

The Public Hearing has been set for September 20, 2011.

PZC2011-44 Application to amend ~Approved Site Plan to add Shed at 60 Old Farms Road (Map 17 Lot 1 Zone R-DER) Owner/Applicant: Town of Willington (Received Sept 6, 2011 P.H. by October 18, 2011 Decision within 65 days after close of P.H.)

Frank Luchon was present for the applicant and submitted a picture for the record. He said they would like to buy a shed to store the items in the cellar because they can no longer use the cellar for storage.  The shed is 12 feet by 20 feet and will be 36 feet from the building and 23 feet from the leaching field.  Mr. Luchon said they would store items for tag sales, outside furniture, and a grill but would not store the propane tank.

Mr. Luchon said, to install the shed, they would have to drive over a culvert.  P. Nevers said this is a question for the town engineer.  A discussion was held on the culvert.

S. Yorgensen said the applicant meets all offsets but they need to update the as-built.  A discussion was held on the permits.  

A. Marco said the commission generally does not make a decision the same night they hear an application but this is a minor modification and pretty straight forward.  

E. Standish motioned to move the application to Old Business.  J. Poole seconded the motion.  All in favor.

PZC2011-45 Application for Subdivision Regulation change to Section 8 Bonding
Applicant: Planning & Zoning Commission (Received Sept 6, 2011 Public Hearing October 4, 2011 Decision within 35 days after closed of P.H.)

The Public Hearing has been set for October 4, 2011.

PZC2011-46 Application for sign permit (Burger King) at 327 Ruby Road (Map 42 Lot 45 Zone DC)Owner: Travel Centers of America LLC Applicant: Sign Pro Inc. (Received Sept 6, 2011 Public Hearing by October 18, 2011 Decision within 65 days after close of P.H.)

Keith Dubois of Sign Pro was present.  He said Burger King did a remodel and wants to replace the existing sign with a sign of the same type and size.  The only change will be the red lettering and it will be low voltage LED.  Mr. Dubois said it is a newer look with different coloring and the new logo.  He said the lumens will be the same; it will not be any brighter and may be less due to the change from white to red lettering.  J. Poole asked if it was rheostat or fixed and Mr. Dubois said fixed.  A. Marco said he would like to see no change in lumens listed on the plans and Mr. Dubois said he would add it.  The commission agreed there would be no need for a public hearing.

P. Nevers motioned to move the application to the next meeting scheduled for Sept 20, 2011. W. Parsell seconded the motion.  All in favor.  

Pre-application

Samuel L Schrager request pre-application conference on Ridgeview Subdivision Tolland Turnpike Willington, CT

Attorney Samuel Schrager was present and said the parcel is very large, 185 acres, and most of the development is on the southerly side.  They are seeking a 4-lot subdivision on 185 acres; 3 building lots and a 4rth lot that will hold the remaining 175 acres.  Atty. Schrager brought four items before the commission.  The first is Open Space Dedication. He said they would like to ask for it to be waived at this time until the 4rth lot is developed.  The second is Improvement Costs; is there a necessity to provide this?  Third is in regards to an Impact Statement and the fourth is signage; posting of signs every 200 feet prior to the public hearing.  Atty. Schrager said, if the commission insists, they will put up the signs but did not feel it was necessary given the characteristics of the land.  He also asked if the open space plan could be waived allowing them to come through with a traditional subdivision.  

Marco said, in regards to the signage, he did not feel 8 signs was a lot for the applicant.  He said the Impact Statement is to make the public, the commission, and the developer aware and felt writing the Impact Statement should be relatively easy.  A. Marcos said there would be improvements and they are looking for an overview because it will change how that section of the town looks.  J. Poole said they would like to see a Yield Plan and Subdivision Plan.  He said they also have a requirement for pure open space and will have to look at the 175 acres that are left over.  S. Yorgensen said it would also go to the Conservation Commission to look at.  A discussion was held on open space.  Atty. Schrager felt they would be getting open space because they would not be coming in to develop lot 4 and they are talking about only developing 6 % of the total site.

A discussion was held on subdividing and how much is given to open space.  A. Marco said the applicant might want to consider what would be the buildable area of the remaining land.   A discussion was held on the Yield Plan.  J. Poole said the Yield Plan is is not outrageous to do.  The commission hired a firm to take 200 acres of Willington land through a trial run several times and it cost approximately $2,000.  Attorney Schrager asked if Open Space Dedication could come out of lot 4 at such time when anything is done on lot 4.  The commission expressed their concerns..  Atty. Schrager asked about granting public access as a conservation easement.  A discussion was held and the commission agreed it was a great concept and possibly something they would consider.  Atty. Schrager said they will do their homework and come back with an application.  

S. Yorgensen reminded all parties that pre-application discussions are non-binding for all parties concerned.    

Steve Amedy request a pre-application for project on Route 32

Steve Amedy presented plans and said the idea was to seek a 4-lot subdivision; 3 lots to be built on and to seek a zone change for the 4rth lot as an adult condo community.  He said they would like to put in 60 units ranging from 1000 square feet to 1500/1600 square feet.  Mr. Amedy said the engineering was 95% to 97% done when they got through wetlands.  He said they would serve the community with a community septic and looked at putting a community water system in.  A discussion was held on the water main and capacity.  J. Poole said the capacity is not big enough.

A discussion was held on a Design Zone Change.  A discussion was held on dedicating open space and the application process. Mr. Amedy said each owner would own 1/60th of the open space but it would not be dedicated as open space until each condo is sold.  A discussion was held on delineating open space and a conservation easement.  

Mr. Amedy said they would stay with the original plan and bring it all in as one go.  He said the sticking point would be looking at how to dedicate open space on a conservation easement.  

Old Business

A. Marco re-opened the application.  

J. Poole motioned to approve the 12 x20 shed with the following conditions; the applicant to provide an updated as-built and approved by the town engineer.  T. Murphy seconded the motion.  All in favor.  

PZC2011-37 Application for 2 Lot Subdivision at 19 Adamec Road (Map 24 Lot 33 Zone R80) Owner/Applicant: Robert & Mary Wiecenski (Received July 19, 2011 Public Hearing August 16, 2011 P.H. closed 8/16/11 Decision within 65 days after close of P.H.)

A. Marco said there was an open question about the waiver for the horizontal datum.  S. Yorgensen said the waiver was for 4.02.02.  J. Poole asked if the applicant followed up with a written document and S. Yorgensen said no the waiver request is in the application.

J. Poole motioned to deny the waiver of Section 4.02.02 requiring the information be submitted in digital form and shall be delivered to the Connecticut State Plane Coordinate system with a horizontal datum of NAD83 and vertical datum of NAVD88 which can be utilized in the Town’s Geographic Information System (GIS).  T. Murphy seconded the motion.  A vote was held.  A. Marco, T. Murphy and J. Poole in agreement with the denial, W. Parsell opposed the denial and E. Standish, J. Sullivan and P. Nevers abstained.  Motion carried.

PZC2011-37 Application for 2 Lot Subdivision at 19 Adamec Road (Map 24 Lot 33 Zone R80) Owner/Applicant: Robert & Mary Wiecenski (Received July 19, 2011 Public Hearing August 16, 2011 P.H. closed 8/16/11 Decision within 65 days after close of P.H.)

J. Poole motioned to approve file PZC2011-37 application for 2 lot subdivision at 19 Adamec Road (Map 24 Lot 33 Zone R80) Owner/Applicant Robert & Mary Wiecenski with the following modifications:

Plans shall be revised to incorporate the comments in the August 8, 2011 memo from Karl Acimovic to Lynn Nicholls and the comments 1-6 of the August 15, 2011 review letter from Joseph Dillon of Nathan L. Jacobson and Associates.

Final plans to be reviewed and approved by staff.

Plans shall also be submitted in a digital format consistent with Section 4.02.02 of the Subdivision Regulations.  

A vote was held.  E. Standish and J. Sullivan abstained.  All others in favor.  Motion carried.

Mr. Wiecenski expressed his concerns on the process.  He said the project is costing him a lot of money and the town wants people to develop but the commissions are holding them back.  Mr. Wiecenski thanked the commission for the approval but was unhappy with the portion that was denied.  

Minutes

T. Murphy motioned to approve the minutes of 8/16/2011.  W. Parsell seconded the motion.  J. Sullivan, P. Nevers and E. Standish abstained.  All others in favor.  

Correspondence

  • State of Connecticut Siting Council letter regarding a notice of intent to modify an existing telecommunications facility located at 426 River Road.
  • Notice of Violation issued to CSB Properties regarding Residential use in a Commercial Zone.

Staff Report and Discussion


S. Yorgensen said the bridge project on Route 74 and the TA sign will be coming back before the commission.  

S. Yorgensen said Love’s Truck Stop withdrew their application to address issues and will resubmit.
