REGULAR MEETING                                                                                                           Nov. 19, 2007
TOWN OFFICE BUILDING                                                                                                  6:30 P. M.

First Selectman Eldredge called the meeting to order at 6:30 P.M. with the following in attendance:  Selectmen Patton & Lewis, L. Nicholls and residents.  First Selectman Eldredge led the Pledge of Allegiance.

APPROVAL OF MINUTES
SELECTMAN LEWIS MOVED TO APPROVE THE MINUTES OF 10/15/07
Selectman Patton seconded the motion.

CORRESPONDENCE
A list of correspondence was available at the meeting and in the Selectman’s office.

PUBLIC WORKS
Lynn Nicholls reported that from Sept to present they have taken care of 8 major problems on the list of 57, tonight will take care of 2 more.  This does not include GASB or the honey-do list.  We are setting up the spreadsheets for GASB and the culverts must be measured; the roads have been walked.  We are getting ready for plowing and will deliver sand to the elderly this week.  The lines for parking at the Senior Housing were done.  Discussion followed on plowing the Senior Housing; the road crew will do that as soon as possible so that the management company can do their part.  Selectman Patton asked is the compactor moving along?  Lynn commented she has to get the electrician there.  Discussion on the compactor followed.  Selectman Patton asked about the detention basin on Old Farms/Daleville Road.  Lynn commented it is small and must be dug out.  Discussion followed on making it bigger.  

EMERGENCY ACTION PLAN
This plan has been revised.  Discussion on the revisions followed. Call 911 will be added to the plan.  The second line referring to a fire and employees evacuating immediately will be eliminated since it is in the plan already.  Discussion on training and types of fires followed.  Lynn commented they always have sandy ready as well as fire extinguishers for water and multi-purpose.  This plan would go into effect when sand and extinguishers do not work.  If anyone is unconscious the crew would get him or her out of the building.  Lynn will make the changes.
SELECTMAN PATTON MOVED TO ACCEPT THE EMERGENCY ACTION PLAN WITH THE ADDITION OF CALL 911 AND REMOVAL OF THE SECOND LINE REFERRING TO A FIRE.
Selectman Lewis seconded the motion.

TOWN SAFETY POLICY
Lynn commented it should be the Public Works Safety Policy.  Discussion on this policy followed.  Lynn commented some of it must be fine-tuned but it is OSHA requirements.  The Board needs to approve it and revisions will be added.  OSHA was impressed; it will always have to be updated.  
SELECTMAN PATTON MOVED TO APPROVE THE PUBLIC WORKS SAFETY POLICY AS SUBMITTED.

Lynn asked can I put this into effect or do I have to wait for union approval?  She gave the union a copy but has heard nothing.  Selectman Lewis commented they should be notified that it is going into effect and they should notify you if they have any objections.  Selectman Patton commented you should meet with all the guys to discuss it.  Lynn commented she wants to meet with them to discuss one item each week.

Three contractors were contacted for bids for Kucko and Eldredge Mills Roads.

FIRST SELECTMAN ELDREDGE MOVED TO REAPPOINT PETER ANDERSEN AND PAUL PRIBULA AS REGULAR MEMBERS OF THE CONSERVATION COMMISSION, AND ROBERT BLOOM AS AN ALTERNATE MEMBER OF THE CONSERVATION COMMISSION, ALL TERMS EFFECTIVE 12/1/07 TO 12/1/10.
Selectman Patton seconded the motion.

TAX REFUNDS
FIRST SELECTMAN ELDREDGE MOVED TO APPROVE A TAX REFUND OF $107.04 TO ROSS ENGEL.

FIRST SELECTMAN ELDREDGE MOVED TO APPROVE A TAX REFUND OF $ 50.99 TO DANIEL PIPPIN.

FIRST SELECTMAN ELDREDGE MOVED TO APPROVE A TAX REFUND OF $20.85 TO STEVEN ROBERTS.

SELECTMAN LEWIS MOVED TO ADD DISCUSSION OF ATTORNEY FEES.

SELECTMAN LEWIS MOVED THAT WE HAVE THE TOWN ATTORNEY; HALLORAN & SAGE KEEP AN EYE ON THE ATTORNEY FEES FOR THE LAWSUIT FOR THE TOWN CLERK AND REPUBLICAN AND DEMOCRAT PARTIES.  I WOULD LIKE TO HAVE SOMEONE FROM HALLORAN & SAGE OVERSEE THE BILLS WE GET FROM MURTHA CULLINA.
Selectman Patton seconded the motion.
Discussion on this followed.  Selectman Lewis commented when we interviewed to hire a Town Attorney each attorney was asked if you are hired who do you represent, the Town, the Board of Selectmen or the First Selectman?  All attorneys except Mike Harrington said they would represent the Town.  Halloran & Sage said we would represent the Town, you may not like what we say but we will represent the Town.  Attorney Harrington said he would represent the Town and the First Selectman.  Because of Attorney Harrington’s statement I would like the Town Attorney to oversee the bills from Mike Harrington to make sure they are only

for the Town Clerk.  First Selectman Eldredge commented I think Murtha Cullina is a reputable firm; they would never try something like that.  We can certainly give the bills to Duncan Forsyth to take a look.  Selectman Lewis commented this is only because of Attorney Harrington’s remark.  First Selectman Eldredge commented when they come in we can give them to Halloran & Sage to review but I assure you that Murtha Cullina is a well established law firm and someone like Michael Zizka would never play games or do anything like that but we can certainly give they to Duncan Forsyth.

GOOD & WELFARE
Peter Latincsics commented he would like to extend his thank you and good wishes to the 2 departing board members and asked where do we stand on the law suite?  First Selectman Eldredge commented he only knows what he read in the paper, the plantives have to show why the case should continue by 11/30/07.  First Selectman Eldredge read and presented a plaque to Selectmen Patton & Lewis and thanked both of them for their years of service.
