MINUTES OF THE PLANNING BOARD CONTINUED PUBLIC HEARING
16 WOODLAND STREET APPLICATION FOR SITE PLAN REVIEW
MAY 26, 2010

MEMBERS PRESENT:  Chair Vincent Vignaly, Patricia Halpin, Patrick McKeon, Karen Paré, Lawrence Salate

MEMBERS ABSENT:  None

OTHERS PRESENT:  Wayne Amico, Chris Gagne, John Lugo, Charles Witkus

The Chair opened the continued public hearing at 7:05 p.m.  Mr. Gagne, the engineer representing the applicant, informed the Board of the changes made to the plan since the last hearing.  Lighting fixtures have been changed to full cut-off lumieres.  The size of the outlet pipes and those for the catch basins are 12”.  The entry on Pierce Street has been moved and there is now a 15% grade. There is a new sewer line design and a landscaping plan consisting of a row of arbor vitae.  

Mr. Amico stated that the slope of the driveway is steep, but that is not uncommon.  A pedestrian access ramp from the lower lot has been added.  An Operations and Maintenance Plan has been submitted and all technical issues have been resolved. The DCR will require another soil test (soil texture, groundwater elevation, etc.) as part of the process for granting their Variance, the results of which Mr. Amico suggested should be submitted to the Planning Board. Mr. Amico then reviewed the waiver requests under Section 3.6 of the Zoning Bylaws as well as suggested waivers under Section 5.2.  Mr. Vignaly stated that the Planning Board can only grant waivers under Section 3.6, but can include items under Section 5.2 as “conditions” of approval.   Concerns raised by the abutters about noise while emptying the dumpsters will be conditioned by a time restriction.  Mr. Lugo stated that he has already dealt with that issue and confirmed that the trucks will be coming at 10:00 a.m.  Ms. Paré stated that the normal pick-up times in general for trash should be after 7:00 a.m. and before 7:00 p.m.  Although the existing abutters list is eight month’s old, Ms. Paré checked with the Assessor’s Office and said she is satisfied that no new residents have moved into the neighborhood whom need to be informed of the proceedings.

Upon motion of Ms. Paré and second of Ms. Halpin, it was unanimously voted to close the public hearing.  Upon motion of Ms. Paré and second of Ms. Halpin, it was unanimously voted to approve the Site Plan for 16 Woodland Street with seven waivers from Section 3.6,

including those for scale (1” = 10’); a vicinity sketch extending less than 1,000 feet from the subject property; a plan without lines for abutting streets and driveway locations within 200’ of the property; a plan without showing the height  of existing structures within 200’; a floor plan and a traffic plan.  Conditions will include the requirement for screening of all ground mounted HVAC units and the submission of any plan changes as a result of the review by the DCR.  The time for the dumpster pickup will be restricted to the hours between 7:00 a.m. and 7:00 p.m.

Members of the Planning Board then signed the final, approved plan.  Mr. Gagne will make four copies and return them to the Planning Board.  Final payment of the review fees will be required prior to the release of the Approval, which will be drafted by Ms. Paré and signed at the next meeting of the Planning Board on June 9, 2010.
