APPLICATION FOR SITE PLAN REVIEW

Ms. Halpin opened the continued public hearing at 7:30 p.m. Attorney Burgoyne, representing the applicant, cited the response letter of February 1, 2008 from Mr. Thunberg of Hub Survey, to the abbreviated review letter of VHB, dated January 22, 2008. In his response, Mr. Thunberg addressed the 16 issues raised by VHB including the intent to submit an Access Permit Application to MassHighway for work within the right-of-way and a permit to construct within the right-of-way. A copy of the access permit for the Water Department was attached. Changes to the striping and signage were also addressed. No drainage structures are proposed nor does the applicant propose to seal coat the parking lot. Two handicapped parking spaces are provided and the Site Plan was revised to indicate existing light in the
legend. The Plan was also revised to provide additional dimensions to define the geometric modifications (radii) to the entrance drive.
Ms. Halpin stated that Mr. Amico, Project Manager from VHB, Inc. wishes to make clear that his review letter does not constitute a comprehensive review of the project by VHB.
Mr. Baker queried why a traffic study was not submitted and Mr. Burgoyne replied that this study is optional and, in his opinion, there are no conflicting intersections necessitating such a study. If the entries were changed or the building differently situated on the lot, a study would have been done. Mr. Baker also inquired whether any new parking spaces were added and Mr. Burgoyne replied that there is less parking with this Plan to provide for increased landscaping. Mr. Vignaly queried how a (large, semi) truck will be able to get to the loading dock, unload, and then turn around before exiting the property. He questioned whether the applicant will limit the size of delivery trucks so as to avoid a situation similar to that of Dunkin Donuts, where semis were backing onto Route 12. Mr. Burgoyne stated
that he would prefer to have a condition of approval prohibit backing onto Route 12 by any delivery truck, rather than have a size limit put on delivery trucks.
Mr. Burgoyne reiterated that last summer, the applicant received a Special Permit from the ZBA to allow change of use to a non-conforming lot. He also submitted a list of waiver requests from certain requirements applicable to the Parking and Site Plan standards of the Zoning Bylaws:
Section 3.6.D.1&2:
Photometric lighting: Existing building-mounted lighting is proposed to remain.
Sign location and design: Design is not yet complete but will comply with the Zoning Bylaws and plans will be submitted to the Building Inspector when ready.
Traffic study.
3.6.E. Site Design Standards
DEP Stormwater Management Guidelines: No new impervious areas are being created. All construction and erosion controls to be in accordance with Mass Highway Driveway Permit and DCR Determination of Applicability.
Upon motion of Ms. Paré and second of Mr. Baker, it was unanimously voted to close the public hearing.
