MINUTES OF THE PLANNING BOARD MEETING
HELD JUNE 27, 2007

HILLSIDE VILLAGE:

Conservation Restriction:  The Conservation Restriction has at last been finalized by Town Counsel and signed by Mr. Staiti and appropriate members of the Hillside Village Condominium Association Board members.  After further signature by the Board of Selectmen and members of the Conservation Commission, it will be filed with the state.  After recording, a fully executed copy will be returned to the Hillside Village Board.

Drainage Problems:  By letter dated June 22, 2007, Cheryl Peterson, PE, reviewed the operation of the two detention basins at Hillside Village (#1, near the entrance and #2, the large basin in the rear).  She contended that Basin #1 is functioning in the way it was designed to function but Basin #2 is clearly not functioning as designed.  For this reason, she stated that site inspections will be performed to determine exactly what aspect of the basin has failed and then appropriate repairs will be made to the basin.  Mr. Wayne Amico, the Planning Board’s review engineer from VHB agreed with this observation and added that Basin #2 needs to be cleaned, as do the pipes, and sand brought in.  Mr. Staiti noted that following the rainstorms in April, five inches of rain fell in three days and the basin functioned.

Mr. Ray Freeman, whose abutting land is flooded by the runoff, stated that water can only flow in the direction of his property from the spillway.  Floods over the spillway have already occurred and this flooding devalues his property.  A new spillway should be constructed.  Mr. Amico stated that Ms. Peterson has acknowledged that Basin #2 is a problem and she needs to come back with a plan of action.  Mr. Baker stated that there shouldn’t be water coming over the spillway unless there is a 100-year storm and he queried whether any consideration has been given to redirecting the flow away from the Freeman property.  The water is not infiltrating and is therefore spilling out with a greater velocity, Mr. Amico stated.  If the velocity were less, it would go down the swale.
