Ms. Halpin opened the continued public hearing at 7:06 p.m. Mr. Matt Brassard, representing the applicant, Hanioti Properties, submitted revised plans and gave a progress report on the project. An ENF was filed and a MEPA Certificate was received from the EPA with no formal comments or negative responses. A public hearing will be held October 9, 2007 by the DCR on the application for a Variance due to the site’s proximity to Gates Brook. Initial comments have been received back from Mass Highway, which were receptive but requested further information.
The revised plans widened the turning radii into the site from Route 12 and added signage. A water quality swale will be constructed at the rear of the parking lot to control the groundwater and will be a “no disturb” site. The swale was designed to infiltrate water. There will be no detention ponds constructed. There is a 100’ buffer from the wetlands. No vegetation will be removed. The Conservation Commission is reviewing the changes to the original plan and will determine whether an application for an amended Notice of Intent needs to be filed.
Mr. Baker questioned the handling of stormwater flow and Mr. Brassard stated that 80% TSS removal will be accomplished with the swale. There will be a separate roof drain system. A maximum of only one foot of stormwater is calculated to accumulate in the swale so a fence surrounding the swale will not be necessary. In response to a question from Mr. Vignaly, Mr. Brassard stated that an Operations and Maintenance (“O&M”) Plan is included in the application package.

Mr. Amico stated that VHB has received responses to all their issues and inquiries except for the traffic flow data, which is expected next week. Ms. Paré stated that VHB and the Planning Board should wait until the DCR has closed its public hearing before finalizing this review. Mr. Amico stated that the DCR may comment on the placement of the snow storage and inquired what signage was added. Mr. Brassard stated that “Enter Only” and “Do Not Enter” signs were added. Mr. Amico stated his concern that that the entry not be too wide and inquired what size trucks would be delivering to the site. Mr. Amico will review the design and possibly contact Mass Highway to see whether the widened entry is truly necessary. The only fencing that will be erected will be
around the dumpster.
Mr. Baker inquired whether a 20’ wide road clearance will be enough for cars to pass around other cars stopped at the drive thru. Mr. Brassard explained that the 20’ clearance is sufficient. Mr. Baker’s two additional concerns are that the applicant ascertain whether an earth removal permit is necessary, and that notes are put on the plan concerning the operation and intent of the water quality swale. Everyone will then understand how and why it was so designed in the event there are problems with the way it functions in the future. Mr. Brodeur requested that a narrative be added that silt fences and hay bales will be installed to protect the basins. Mr. Amico stated that there should be an erosion and sediment control plan and noted that a temporary swale will be in place
during construction. Mr. Baker requested that, if at all possible, it would be good to save the four maple and oak trees currently growing on the site.
Upon motion of Mr. Vignaly and second of Mr. Baker, it was unanimously voted to continue the public hearing until 7:30 p.m. on October 24, 2007.
