MINUTES OF PLANNING BOARD CONTINUED PUBLIC HEARING
TO AMEND SUBDIVISION REGULATIONS
FEBRUARY 28, 2007
PRESENT: Chairperson Karen Pare, John Baker, Patricia Halpin, Vincent Vignaly, Elise Wellington.
ABSENT: None
OTHERS PRESENT: At times none. At times Gerardo Sarli and Julian Votruba, John Hadley.
Ms. Pare opened this continued public hearing to amend the town’s subdivision regulations at 7:30 p.m.
She reported that she had heard back from town counsel regarding needed changes in the sections relating to performance guarantees and town acceptance of subdivision roads. Atty. Kay Doyle advised her that Section V. - I. and J. (Performance Guarantees) should be changed to read the same as M.G.L Ch. 81. U. The board agreed that Atty. Doyle should be asked to add M.G.L. Ch. 41, Section 81 X. to Section V. M. of our subdivision regulations. Atty. Shirin Everett drafted changes to Section VIII. E. (Acceptance of Roads), with which the board agreed. Atty. Everett also drafted proposed changes to Section VIII. E. 1., adding new sections “f.” (regarding the town’s need for an easement deed for the subdivision’s roads) and “g.” (regarding the need for title certification). These
changes will ensure that the town will have all these needed documents before the town accepts a subdivision road.
Mr. Vignaly, who has been recording our suggested revisions to the subdivision regulations, said that he had added wording to Section V. 6. requiring that ANR plans show existing property lines, as well as proposed lines. Ms. Wellington felt this revision was needed so that the board can clearly see what change is being proposed in the ANR plan. Section IV. A. (Preliminary Plan Application) has been changed so that the Town Clerk will get a copy of Preliminary Plans.
At 7:45 p.m. Mr. Vignaly moved to continue the hearing to later in the meeting to accommodate Mr. Sarli, who wished to discuss his revised site plans. Mr. Baker seconded the motion, which passed unanimously. At 8:10 p.m. this continued public hearing was reopened by the chair and other subdivision changes were agreed upon and recorded by the chair. At. 8:15 p.m., Ms. Halpin moved to close the hearing. Mr. Vignaly seconded the motion, which passed unanimously.
