Minutes of Zoning Board of Appeals Public Meeting

Attendees:      Vern Jacob, Bruce Drucker, William Nicholson, Manny Heylinger,  Roger Putnam, Mick Lynch , Sharon Inger, and Mary Rogers, Committee Secretary.

Chair Jacob opened the meeting at 7:00 p.m. and stated the meeting was being recorded.

13-18 MA Audubon Society’s Wellfleet Bay Wildlife Sanctuary, 291 Route 6, Map 46, Parcel 16:  Application for two Variances:  WZB 6.5.1.2 (windmills) for a height of 120 feet from grade to the center of the rotor and WZB 6.5.1.4 to allow for a 43 foot diameter of the rotor.
Roger Putnam recused himself.
At the request of the applicant, Bruce Drucker moved to continue to September 19, 2013;  Manny Heylinger seconded;  passed 5-0-1.

13-12   Boehringer, 175 Cliff Rd., Map 24, Parcel 83, Application for a Special Permit under 6.1.5.2b to raze existing dwelling and replace with dwelling located at 180 Cliff Rd, now owned by Melinda Krasting.  (Cont’d from 08/01/13) The Board consisted of Sharon Inger, Roger Putnam, Bruce Drucker, Vern Jacob, William Nicholson, and Mick Lynch.  Chester Lay of Slade Associates and Mr. Robert Boehringer came forward to present the proposal to relocate Melinda Krasting’s house to the Boehringer property after the demolition of the house.  A bedroom will be removed from the Krasting house, so that the new dwelling will be a 2-bedroom house.  There will be the addition of a screened porch with a roof deck on top.  Mr. Lay reviewed the percentage allowances in the Seashore District.  To date, there has been no known demolition permit issued.  Mr. Lay said there were four permits necessary, including the ZBA’s Special Permit.  Vern Jacob said that although there had been e-mail correspondence with Lauren McKean of the National Seashore, the ZBA had not received an official letter from National Seashore Superintendant George Price regarding the project.  Bruce Drucker noted a discrepancy in the measurements that had previously been submitted to the ZBA.  Drucker also commented on the 5% coverage allowance in the Seashore District.  Mr. Lay requested that his updated calculations be used for livable space, and he submitted his computations to the Board.  Before ZBA makes a decision, Mr. Lay and Mr. Boehringer need to submit: 1.) the official letter from the Seashore Superintendent; 2.)  color copies of the plans; 3.) copies of the building area calculations; and 4.) the height of the screened porch.  Bruce Drucker moved to continue to September 5, 2013; Roger Putnam seconded; passed 5-0.

13-19 Kay and Libby Nuttall, 90 Cottontail Rd., Map 29, Parcel 5:  Application for a Special Permit under WZB 6.1.5 to construct a three season room within the setback.
The Board consisted of:  Manny Heylinger, Roger Putnam, Bruce Drucker, Vernon Jacob, and Mick Lynch.  Libby Nuttall came forward and explained her request.  Putnam and Lynch no problems.  Inger, Nicholson, Drucker and Heylinger had reservations about there being setback allowances on both sides of the house.  Ms. Nuttall’s builder arrived and answered questions about the proposed stairs.  There could be a modification to the right side of the house that would not need a SP, but The  applicant will change the north side request for the deck expansion & stairs so that it will not go into the setback..  Bruce Drucker moved to continue to September 5, 2013 ; Mick Lynch seconded; passed 5-0.

Vern Jacob said he had invited the Building Inspector to the Audubon hearing on September 19, 2013.

Bruce Drucker moved to adjourn at 7:50 p.m.; seconded by Roger Putnam; passed 7-0.
