Minutes of Zoning Board of Appeals Public Meeting

12-13   Lonnie Briggs, 51 Wireless Road, Map 30, Parcel 605:  Application for a Special Permit under WZB 6.1 to replace a 1950’s cottage, adding 97’ to existing footprint.  The Board consisted of William Nicholson, Manny Heyliger, Tom Reinhart, Sharon Inger, and Mick Lynch.  Lonnie Briggs gave an overview of the project, stating this is a very narrow lot.  Francis Sullivan, architect, also came to the table.  There will be a slight addition to the footprint but not within the setbacks and a volumetric increase. The height of the building is within the guidelines.  The Board requested gutters or a recharge system to provide for water run off and the utility lines will be buried.  William Nicholson moved for Findings of Fact; seconded by Sharon Inger; passed 5-0.
1.      The subject property was built in 1940 per assessor’s records.
2.      This is an application under WZB 6.1 to demolish the existing residential structure and replace it with a new residence.
3.      The existing structure is non-conforming due to an intrusion into the northerly side yard setback.
4.      There is an existing Special Permit for two stables on this property.
5.      The property is located in the National Seashore Park District.
6.      The existing livable area as of September 1, 1959 was 602 square feet.
7.      The new dwelling will be approximately 1,486 square feet.
8.      There will be increase in site coverage of 997 square feet or 0.13%.
9.      There will be no further intrusion into the side yard setback.
10.     The new dwelling will be a net decrease in use, going from a two bedroom to a one bedroom structure.
11.     There will be no public views obscured by the proposed project.
12.     There are no objections from abutters, including the CCNS.
13.     The applicant plans to remove some paving and concrete steps and retaining walls to restore some of the original natural grade of the property.
14.     The Board has considered the purpose, applicability and standards and criteria of Section 6.24 National Seashore Park District Special Permit.
15.     The Board finds that the development will not have a significant adverse impact on views, scale, mass or character of the neighborhood and district.
16.     The new total site coverage is 1,717 square feet.
17.     The proposed new dwelling will not, therefore, be substantially more detrimental to the neighborhood.

Manny Heyliger moved to approve the Findings of Fact; seconded by Mick Lynch; passed 5-0.  William Nicholson moved to grant the Special Permit with the following conditions:
1.      Utilities will be underground.
2.      In lieu of gutters, there will be a gravel drainage ditch to prevent erosion

        Seconded by Mick Lynch; passed 5-0.
