Minutes of Zoning Board of Appeals Public Meeting

Attendees:      Vern Jacob, Robert Hankey, Tom Reinhart, Bruce Drucker, Roger Putnam, William Nicholson, Mick Lynch, Manny Heyliger, and Christine Bates, Committee Secretary.  

Chair Jacob opened the meeting at 7:00 p.m. and stated the meeting was being recorded.

11-17     Benevento, 124 State Highway Route 6, Map 47, Parcel 24:  Application for a Special Permit under WZB 6.1.5.1 to alter pre-existing nonconforming single family residence and WZB 6.21 for an affordable accessory dwelling unit (Cont’d from 06/16/11).   The Board consisted of Bruce Drucker, William Nicholson, Manny Heyliger, Mick Lynch and Roger Putnam.  Attorney Ben Zehnder represented the applicant and stated the revised plan identifies a vegetated screen to block the views from Route 6.  Zehnder stated the applicant didn’t feel relocating the house was in their best interest and they required the addition in the front in order to have the master bedroom enlarged.  He stated for mitigation they would remove the two sheds on the property.  New floor plans were presented for the affordable accessory dwelling unit identifying the square footage of the unit.  Roger Putnam requested clarification of the issue of whether or  not both requests could appear in the same application and Vice Chair Drucker stated they should be separate.  The Board questioned if two separate requests for a special permit should be on the same application.  There was discussion among Board members regarding the 100’ setback issue and the additional substantial intrusion into the front setback; there was not consensus.  The Board was generally in favor of the Affordable Accessory Dwelling Unit.   Zehnder requested a break to discuss the situation with his client.  Attorney Zehnder requested a continuation to July 21, 2011.  Bruce Drucker moved to continue to July 21, 20117/21/seconded by Roger Putnam; passed 5-0.

11-18      Lou Anne Johnson, 35 Tecumseh Road, Map 28, Parcel 167:  Application for an Affordable   Accessory Dwelling Unit under Wellfleet Zoning Bylaw 6.21,  The Board consisted of Vern Jacob, Bruce Drucker, William Nicholson, Manny Heyliger and Robert Hankey.  Lou Anne Johnson represented herself land stated she is before the Board for an Affordable Accessory Dwelling Unit.  Chair Jacob asked the audience if they wanted to make any statement:  Suzanne Norgeot in favor; Sandra Johnson in favor; Pat Roach in favor; William Roach in favor; Sandra Mitchell in favor; Guy Daniels against; Paul Gordon against; Patricia Hurley looking for information; Carolyn Godon looking for information; Penelope Pierce against; Steven Polachack in favor; and Brent Valley in favor.  Letters were read into the record:  Guy Daniels, Richard Collins, Allen Pierce, Scott Reynolds, Susan Shrout, Martha Wilson, Marilyn Cook, Naomi Robbins, Joyce Tibbetts, Meredith Miller/John Walsh, Britta Tate, Donna Pickard, Betsy Williams, Kevin Staley, Susan Magio, George Hirst, Lois Rustier, and Brent Valley.  LouAnne Johnson stated the building was a kit built for storage and now she qualifies financially to have an affordable accessory unit.  Two members of the audience stated she does not sleep at the house.  Guy Daniels stated the other dwelling is rented and he believes Johnson moves back in there during the winter.  The Board was in consensus the property is eligible for an AADU but there were concerns regarding the livable floor area and the failure to show a kitchen on the drawings.  Bruce Drucker explained to the audience that conditions will be placed on the Special Permit, if granted, and there is a system in place by the town for enforcement of an affordable unit.  Ms. Johnson requested a continuation to July 21, 2011.  Vern Jacob moved to continue to July 21, 2011; seconded by Manny Heyliger; passed 5-0.
   
Other Business

The Board will take Sibel Asantugrul to dinner on July 19, 2011 at The Bookstore Restaurant at 6:00 pm. .

Bruce Drucker moved to adjourn at 8:16; seconded by Roger Putnam; passed 5-0.
