Vice-Chair Bruce Drucker opened the meeting at 7:00 p.m. and stated that the meeting was being recorded.         

Public Hearings:

10-34   Shantz, 100 Old Chequessett Neck Rd., Map 14, Parcel 49:  Application for an Affordable Accessory Dwelling under WZB 6.21 (Cont’d   from 12/02/10).  The Board consisted of Bruce Drucker, Robert Hankey, William Nicholson, Roger Putnam and Tom Reinhart.  Bruce Drucker read the minutes from 12/2/10 into the record.  Attorney Ben Zehnder, Ms. Shantz and her son, Corey Brundage, came before the Board and the updated site plan and revised dwelling plans were acknowledged.  Attorney Zehnder stated the dwelling had been moved back from the front setback 66 feet which presents a minimal exposure to the neighborhood.  Abutter Charlie Adams expressed concern regarding the size of the house and requested the house be moved back further.  Alex Hay stated he is in favor of affordable housing and there is an obvious need in the town.  It was determined the skylights will be in the living area and not the attic.  Manny Heyliger stated he talked to the Health Department regarding the basement plans and what may have been construed as a wall creating an additional room in the basement is a support beam and not livable space.  The Health Agent confirmed it is not a bedroom.  The attic is accessed through a pull down staircase and the basement will be fully open.  The Board expressed concerns regarding the number of bedrooms on the property and the size of the proposed dwelling.  It was stated there are two additional buildings on the property, along with the main house and the proposed affordable accessory building seems excessive in size.  After further discussion between Attorney Zehnder and his client, he requested a continuation.  Roger Putnam moved to continue to February 3, 2011; seconded by William Nicholson; passed 5-0.

11-01 Currier, 1035 Chequessett Neck Rd., Map 19, Parcel 92-1, Application for a Special Permit to install of two Windspire 1.2 kw vertical axis wind turbines for residential use.  The Board consisted of Bruce Drucker, William Nicholson, Manny Heyliger, Robert Hankey, and Mick Lynch.  Mark Robinson and Chet Lay represented the applicant and gave an overview of the project.  The installation would be a two step process and only one turbine would be erected initially.  Chet Lay stated since all the properties are owned by one family, there will be easements in perpetuity for tre so-called fall zone.  The turbines will be 30’ structures.  It was determined Chet Lay and the applicant will draft a proposal regarding the easement, which the Board will forward to Town Counsel for their advice.  Roger Putnam stated the Board should take into consideration the location of the turbines so there will not be any flicker to abutting properties.  Robinson stated people from the road would not see the turbines due to the elevation of the land.  Bruce Drucker stated the bylaws call for fencing and the Board did not feel this type of unit required a fence.  The owners of a turbine would be responsible to dismantle the unit if necessary due to weather.  Robinson stated there has been no problem with frequency levels for emergency signals.  Bruce Drucker moved to continue to 01/20/10; seconded by Robert Hankey; passed 5-0.

11-02  Currier-McCormick, 1025 Chequessett Neck Rd., Map 19, Parcel 92-2, Application for a Special Permit to install one Windspire 1.2 kw vertical axis wind turbine for residential use.  Chet Lay and Mark Robinson requested a continuation.  Bruce Drucker moved to continue to 1/20/11; seconded by Roger Putnam, passed 5-0.

11-03    Currier-Anstine, 1015 Chequessett Neck Rd., Map 19, Parcel 92, Application for a Special Permit to install one Windspire 1.2 kw vertical axis wind turbine for residential use.  The applicant must go before the Conservation Commission and the applicant requested a continuation.  Bruce Drucker moved to continue to 1/20/11; seconded by Roger Putnam; passed 5-0.

11-04    Currier-Anstine, 1045 Chequessett Neck Rd., Map 19, Parcel 92, Application for installation of one Windspire 1.2 kw vertical axis wind turbine for residential use   The applicant must go before the Conservation Commission and requested a continuation.  Bruce Drucker moved to continue to 1/20/11; seconded by Roger Putnam; passed 5-0.

Other Business
                    
Bruce Drucker moved to approve the amended meeting minutes of December 15, 2010; seconded Roger Putnam; passed 5-0.

Bruce Drucker advised the Board he and Roger Putnam had send a memo to the Board of Selectmen and Wellfleet Town Administrator regarding the Building Inspector position.  He reported three Selectmen advised him they would only decide whether to ratify the Town Administrator’s decision regarding the Building Inspector position and the Town Administrator will make the decision if it is a part-time or full-time position

Bruce Drucker moved to adjourn at 8:10 pm; seconded by Robert Hankye; passed 5-0.
