Minutes of Zoning Board of Appeals Public Meeting

Chair Jacob opened the meeting at 7:00 p.m.
09-13 Risha, LLC (Doris Zelinsky, owner), 170 Pond Avenue, Map 29, Parcel 382: Application for a 40B Comprehensive Permit to build three townhouse condominium homeownership units under MA General Laws Chapter 40B and 760 CMR 56. (Cont’d from 07/09/09). Member Don Palladino did not participate in the hearing. The same Board members presided as at the prior public hearing sessions, including Members Vernon Jacob, Bruce Drucker, William Nicholson, Tom Reinhart and Roger Putnam.
Chair Jacob stated Attorney Devin had requested a continuance. After discussing several options, it was agreed by both Attorneys Devin and Bierhans and the Board the hearing would be continued to September 22, 2009. Bruce Drucker moved to continue the hearing to September 22, 2009 at 7:00 pm; seconded by Roger Putnam; passed 5-0. The ZBA will not meet on the regularly scheduled Thursday, September 24, 2009.
Bruce Drucker moved to approve the meeting minutes of June 15, 2009, June 25, 2009 and July 9, 2009 as amended; seconded by Tom Reinhart; passed 6-0.
At Chair Jacob’s request, Bruce Drucker stated Richa LLC may be recertified and MA Housing will make a decision if there will be any change to the determination of eligibility. He stated the ZBA does not have to wait for MEPA review according to Ms. Quirk.
Roger Putnam moved to adjourn the meeting at 7:10 pm; seconded by Bruce Drucker; passed
6-0.
